"SPECIAL EVENT PERMIT"
Attached herewith is proposed Code Amendment No. 76-13 "Special
Event Permit" which was approved by the Planning Commission on
September 21, 1976. Specifically, the proposed amendment would
establish an application process for review of proposals to con-
duct a special event in the City.
Currently, the Board of Zoning Adjustments reviews proposals for
special events to insure that such events are conducted in a safe
and acceptable manner to the City. There is no application process
established, however, and this is the essence of the proposed code
amendment.
ON MOTION BY PARKINSON AND SECOND BY SHEA, CODE AMENDMENT NO. 76-13
WAS APPROVED .BY THE PLANNING COMMISSION ON SEPTEMBER 21, 1976 BY THE
FOLLOWING VOTE:

ENVIRONMENTAL STATUS:
The proposed code amendment was granted a categorical exemption by the
Department of Environmental Resources as the proposal is a change in
present procedure. The Department' s Notice of Exemption No. 76-44 is
attached.
RECOMMENDATION:
The Planning Commission recommends approval of Code Amendment No. 76-13.

CODE AMENDMENT NO. 76-13
NOTICE IS HEREBY GIVEN that a' public hearing will be held by the
City Council of the City of Huntington Beach, in the Council
Chamber of the Civic Center, Huntington Beach, at, the hour of
77:or..00 P.M. , or as soon thereafter as possible, on Tuesday,
the 26th day of October 19 76 for. the,� purpose of
considering proposed Code Amendment No. 76-13 initiated by the City Council.
Generally referred to as "Special Events", the proposed Code Amendment would
establish an application process for review of proposals to conduct a special
event within the City. Minor modifications to Article 976 (Sign Code) are also
proposed in order to eliminate potential conflicting ordinances if the Special
Event procedure is established.

RE: SPECIAL EVENT PERMITS
The City Council on past occasions has indicated its concern regarding the
procedure and criteria for processing special event permits. These events
are usually for the raising of funds for the various service organizations
within the City.
The present procedure, as previously established by the City Administrator' s
Office, has the Board of Zoning Adjustments reviewing and approving all such
events. The Board is currently reviewing three such requests: a festival-
fair to be held from August 25 through September 6 at the southwest corner
of Beach Boulevard and Atlanta Avenue, a request for a religious outreach
center for an approximately 60-day period during August and September on the
City-owned property on Pacific Coast Highway between Second and Third Streets ,
and a carnival to be held on the 24th, 25th, and 26th of September by the
Huntington Beach Playhouse on property located on the corner of Main Street,
Gothard, and Garfield.
The Planning Department has been receiving an increasing number of these
requests, with the magnitude of the requested events becoming more signifi-
cant in terms of time and area involved. Therefore, the Planning staff is
pursuing an amendment to the ordinance code which would provide more
legitimacy in the reviewing process and also provide for enumerated and
consistent criteria for evaluation of special event requests.
The Planning Department requests the City Council' s "concurrence on three
items related to this issue:
1. That the proposed ordinance is a more proper procedure than presently
exists.
2. That the present procedure continue until the ordinance is effective.
3J. That the three aforementioned events are acceptable to be processed
by present procedures.
Upon Council' s concurrence, the proposed amendment will be b. , the

SUGGESTED ACTION:
Approve Code Amendment No. 76-13.
1. 0 BACKGROUND INFORMATION:
Code Amendment No. 76-13 "Special Events" is a proposal to require
a review process by the Board of Zoning Adjustments for special
events, as defined. . Minor modifications to related sections of
the code have been made' to gain consistence with the proposed
process. (See attached amendment. )
The context of the proposed code amendment was reviewed in concept
by the Planning Commission at its meeting, of August 31, 1976 . At
that time the staff was directed to set the matter for public hearing.
In summary, the proposed amendment would:
(a) Allow special events to be conducted„ in any district subject to
approval of an administrative review application. A public
hearing and notification of adjacent property owners is required
if such event exceeds a period of .three consecutive days, other-
wise the administrative review is processed without a public
hearing.-
(b) Regulate the location of a special event.
(c) Define special event.
(d) Enable revocation proceedings for non-compliance with conditions
of approval.
(e) Make minor changes to the Sign Code to gain consistence with the
proposed revisions.
(f) Provide an appeal period of two days in lieu of ten days after a
decision is rendered.

2. 0 ENVIRONMENTAL STATUS:
The proposed code amendment was granted a categorical exemption by
the Department of Environmental Resources as the proposal is a
change in present procedure. The Department' s Notice of Exemption
No. 76-44 is attached for the Commission' s perusal.
3. 0 SUGGESTED ACTION:
The staff recommends approval of Code Amendment No. 76-13. The
staff' s report to the Commission dated August 31, 1976 containing
additional information relating to this subject is attached for the
Commission' s information.

This is a change in present procedure, to require an Administra-
tive Review application before the BZA rather than a policy
review for a "special event" in the City of Huntington Beach.
Each Administrative Review application will in turn require
separate environmental evaluation.
