Yes [ ] New Policy or Exception )� v Statement of Issue, Recommendation,Analysis, Funding Source,Alternative Actions,Attachments: STATEMENT OF ISSUE: As part of the reorganization of Division 9 , staff is recommending a change in format and a change in location for the Definitions section . Since the definitions apply generally to all of Division 9, their adoption as Article 908 at the beginning of the code with the introductory articles is appropriate . The format change concerns numbering. Previously, every time the Planning Commission or City Council has wanted to modify a definition, several pages of text would have to be printed; each section number covered one letter of the alphabet . Proposed Code Amendment No. 86-9 assigns a different section number to every definition . In this way, individual definitions can be changed easily . In addition, the numbering is set up so that there is room to add up to nine new definitions between each existing definition. Words and phrases whenever used in this division shall be construed as defined in this article unless from the context a different meaning is intended and more particularly directed to the use of such words and phrases. S. 9700.1 Words beginning with the letter "A" shall have the following definitions: (1) Accessory. A detached structure, building, or portion of either, the use and maintenance of which is subordinate and purely incidental to that of the main building or main use of the land and which is located on the same therewith. (495, 556, 1366) (2) Apartment. A room or suite of two or more rooms. which is designed or intended for use and/or occupancy by only one family which may ,do its own cooking in said room or suite. (3) Arterial. Any street, highway or road having been designated as an arterial on the circulation element of the General Plan. (2221-9/77) (4) Automobile Accessory Dealer. An automotive dealer of a specialized nature who operates on a one-day, turn-around basis. The intent of this definition is to include a specialty shop such as a muffler shop, a transmission shop, and so forth. This definition is not to be confused with the definition of minor automobile repair. (1673=11/71) (5) Automobile Parking Space, Automobile Storage Space, or Garage Space. A permanently maintained, privately-owned space of not less than 144 square feet in area, accessible to and usable by, an average size automobile under its own power for .temporary, off-street parking or storage thereof. Said automobile storage space, whether or not located within a building, shall be exclusive of driveways, walks, ramps, columns, and areas devoted to other purposes than the storage or parking of automobiles. (495, 556, 1366) 9/85 PLANNING GENERAL PROVISIONS S. 9700.1(6) (6) Automobile Repair shall mean and include the following: (1675-11/71) (a) Minor Repairs shall mean tire changing and repairing (excluding recapping and retreading); battery charging and replacement; radiator cleaning and flushing (excluding steam cleaning); lubricating; servicing and replacing of brake cylinders and brake shoes; wheel balancing; testing, adjusting and installing carburetors, coils, condensers, fan belts, distributor caps, smog control devices, filters, generators, points, . rotors, spark plugs, voltage regulators, water and fuel pumps, water hoses and wiring; and similar minor repairs. (b) Major Repairs shall mean painting, body and fender work, steam cleaning, welding, tire recapping, radiator repair and rebuilding, turning brake drums, battery repairing and rebuilding; engine repairing, overhauling and replacing, transmission and differential repairs or replacing, and other similar major automobile repairs. S. 9706.2 Words beginning with the letter "B" shall have the following definitions: (27809/85) (a) Bedroom. Any room which meets the minimum requirements of the building code for a habitable room, which is _ constructed in such manner that less than 50 percent of one wall is open to an adjacent room or hallway, and which can be readily used for private sleeping purposes shall be counted as a bedroom in order to determine the parking areas or other requirements. Exceptions to this definition shall be those rooms which regularly make up a standard dwelling unit such as one kitchen, living, family or recreation and dining room, and the customary sanitary facilities. (b) Block. All the real property abutting one side of a street between the end of said street of a city limit line and the nearest cross street, or between two consecutive cross streets. (c) Building. A structure, having a roof supported by columns or walls for the support housing, shelter and/or enclosure of. any person, animal, or chattel; and when any portion thereof is separated from every other portion thereof by a masonry wall without openings, extending from the ground to the upper surface of. the roof, then such portion may be deemed a separate building. (d) Building Height. The vertical distance from the lowest elevation of the ground immediately adjacent to the building to the highest point of the roof. (e) Building Site. The ground area occupied by a building or buildings together with all the yards and open spaces required by applicable provisions of Division 9. (f) Bungalow Court. A group of three or. more detached or semidetached one-family or two-family dwellings located upon a single lot having a common court or yard and a separate entrance on the ground floor for each apartment or dwelling, including dwelling groups and house courts but not automobile courts. 9/85 P NIPIING _ GENERAL PROVISIONS S. 9700.3 S. 9700.3 Words beginning with the letter "C shall have the following definitions: (a) Camp Car, Motor Home, Camper or Tent Trailer. A vehicle with or without motive power, which is designed or used for temporary recreational human habitation. (b) Commission. The Planning Commission of this city (c) Colt shall mean a male horse up to the age of two (2) calendar years. (d) Commercial Horse Stable shall mean the entire parcel of land upon which equines are boarded, maintained, kept, housed, lodged, fed, trained, sold, bred, or where instruction is offered as a commercial activity. A commercial horse stable shall also mean any parcel on which five (5) or more equines are maintained. (e) Corral shall mean an enclosure for holding one or more equines. (f) Commercial Recreation Use and/or Center shall mean recreation facilities operated as a business and open to the general public for a fee. (g) Commercial Vehicle. A commercial vehicle is any vehicle, motorized or nonmotorized, that is used or maintained for the transportation of persons for hire, compensation, or profit; or designed, used or maintained for the transportation of property. (h) Community apartment project shall mean a project in which an undivided interest in the land is coupled with the right of exclusive occupancy of any apartment located thereon. (i) Condominium shall mean an estate in real property consisting of an undivided interest in common in a portion of a parcel of real property together with a separate interest in space in a residential, industrial or commercial building on such real property, such as an apartment,. office or store. A condominium may include in addition a separate interest in other portions of such real property. Such estate may, with respect to the duration of its enjoyment, be either (a) an estate of inheritance or perpetual estate, (b) an estate for life, or (c) an estate for years, such as a leasehold or a subleasehold. (2429-6/80) S. 9700.4 Words beginning with the letter. "D" shall have the following definitions: (2780-9/85) (a) Director shall mean the Director of Development Services or his duly authorized representative except where specifically provided otherwise. (b) District. Any area, or areas, similarly classified whether contiguous or not, and shown by specific and similar designations on the maps which are a part of Division 9. (c) Dwelling. A building or portion thereof, designed and occupied exclusively for residential purposes including single-unit and multiple-unit dwellings,' but not including hotels or boarding houses. An individual dwelling unit shall contain only one kitchen and be designed for occupancy by one family for living and sleeping purposes. 9/85 S. 9700.4(d) GENERAL PROVISIONS PLANNING (d) Dwelling, Multiple Unit. A building or buildings designed for and occupied by two or more families, all living independently of each other and having separate kitchen and toilet facilities for each family. (e) Dwelling, Single-unit (Family) . A detached building designed primarily for the use of a single family, no portion of which is rented as a separate unit. S. 9700.5 Words beginning with the letter "E" shall have the following definitions: (a) Equestrian shall mean that which. pertains to horses or horsemanship, or to one who rides on horseback. (b) Equine shall mean a horse, mule, burro, pony, .. jack (jinny or jenny) , and includes quadrupeds of the genus equus.. (1769-8/72). S. 9700.6 Words beginning with the letter "F" shall have the following definitions: (a) Family. A family is defined as two or more persons living together in a dwelling unit, sharing common cooking facilities, and possessing the character of a relatively permanent single bona fide housekeeping unit in a domestic relationship based upon birth, marriage, or other domestic bond of social, economic and psychological commitment to each other, as distinguished from a group occupying a boardinghouse, club, dormitory, , fraternity, hotel, lodging house, motel, rehabilitation center, rest home or sorority. (2273-5/78, 2773-7/85) (b) Filly shall mean a female horse up to the age of four (4) calendar years. (2273-5/78, 2773-7/85) (c) Final Environmental Evaluation means that point in time prior to rendering a decision for entitlement of a project in which the . environmental effects of the project have been assessed for recommended action to the discretionary body. Final environmental evaluation dates are established as follows: (2773-7/85) (i) Exempt Projects: date of application acceptance; (2773-7/85) (ii) Negative Declarations: date of expiration of the posting period as required by law; (2773-7/85) (iii) Environmental Impact Reports: the date when public hearings conducted by the Environmental Review Committee have been concluded. (2273-5/78, 2773-7/85) (d) Foal shall mean a colt, gelding, or filly up to the age of twelve (12) calendar months. (2273-5/78, 2773-7/85) (e) Fortunetelling, as used in this code, shall include astrology, palmistry, phrenology, lifereading, fortunetelling, cartomancy, clairvoyance, clair audience, crystal gazing, mediumship, spirit photography, spirit writing, spirit voices, spirit materialization, etheralization, prophecy, augury, divination, magic, necromancy, fortunetelling by handwriting analysis, or other similar business act. (2773-7/85) 9/85 PLANNING ,:: ,ENER.AL PROVISIONS S. 9700.7 S. 9700.7 Words beginning with the letter "G" shall have the . following definitions: (a) Game arcade shall mean any place of business where more than four (4) commercially-operated amusement devices are available for public use. (b) Garage, Private. An accessory to, or a portion of a main building, used or designed for use only for the shelter and/or storage of passenger vehicles, or trucks of not more than one-ton rated capacity, owned or operated by occupants of the .main building and including usable space and .convenient ingress and egress thereto. (c) Gross Acreage. The area computed by including all property within property lines of a proposed development, except when such property lines abut a street in which case such area shall be computed from the center line of such street. (d) Gross area shall mean the total of an area, computed within the boundary .lines of an area of land before deduction of public streets, easements, or other areas to be dedicated or reserved for public use. (2539-2/82) S. 9700.8 Words beginning with the letter "H" shall have the following definitions: (1) Health Centers and Health Clubs (under 2500 Square Feet). A health center or health club shall mean a commercial or private establishment for the purpose of recreation and/or physical fitness activities such as handball, racquet , or tennis courts, or exercise/conditioning facilities including weight training, dance exercises, or other such uses. (2) Horticulture shall mean the science and art of growing for wholesale purposes fruits, vegetables, flowers, or ornamental plants, and may include tree, vine or field crops, flower or vegetable gardening, nurseries or greenhouses, (1853-6/73) (3) Hotel. A building or portion thereof, containing six (6) or more guest rooms designed, arranged, intended to be used, let or hired out to be occupied, whether the compensation for hire be paid directly or indirectly in money, goods, wares, merchandise, labor or otherwise, and in which no provision is made for cooking in any individual guest room or suite, but is used as the more or less temporary abode of individuals. r. S. 9700.9 Words beginning with the letter "I" shall have the following definitions: (1) Idle Service Station .shall mean any service station which has not been open for business for at least sixty (60), eight (8) hour days as a service station, as defined in Section 9700.17 (1) of this article, out of any 180 consecutive days. (1799-12/72) S. 9700.10 Words beginning with the letter "J" shall have the following definitions: (1) Junk Yard. A junkyard shall mean the use of any lot or any portion of a lot for the storage or keeping of junk, including scrap metal or other scrap materials. Said yard may include all uses permitted in a motor vehicle dismantling or wrecking yard. (1241) 9/85 S. 9700.11 _ GENERAL PROVISIONS _ _ PLANNING S. 9700.11 Words beginning with the letter "K" shall have the following definition: (278.0-9/85) Kitchen shall mean any room or portion thereof containing facilities designed or used for the preparation of food including a sink and stove, oven, range and/or hot plate. Kitchen shall not include a wet bar. S. 9700.12 Words beginning with the letter "L" shall have the following definitions: (1) Landscaping. Landscaping shall include . the planting and continued maintenance of vegetation. Said vegetation shall be limited to ferns, flowers, grasses, mosses, shrubs, trees and vines. (1261) (2) Local Street shall mean a public roadway having two (2) or more divided lanes. (2221-9/77) (3) Lot. A parcel of real property shown on a map recorded in the office of the County Recorder of either Los Angeles County or Orange County, California, designated on such map by a separate number or other character which applies only to the parcel so marked, or any area of land under one ownership abutting upon at least one street, alley or recorded easement. S. 9700.13 Words beginning with the letter "M" shall have the following definitions: (a) Mobilehome/Manufactured Home means a structure, transportable in one or more sections, which, in the traveling mode, is eight feet or more in width, or 40 body feet or more in length, or, when erected on site, is 320 or more square feet, and which is built on a permanent chassis and designed to be used as . a dwelling with or without a permanent foundation when connected to the required utilities, and includes the plumbing, heating, air conditioning, and electrical systems contained therein; except that such term shall include any structure which meets all the requirements of this paragraph except the size requirements and with respect to which the manufacturer voluntarily files a certification and complies with the standards established by this .article. "Manufactured home" includes a mobilehome subject to the National Manufactured Housing Construction and Safety Act of 1974 (42 U.S.C. , Sec. 5401,. et seq. ) . (1673-11/71, 2735-1/85) (b) Mobilehome Accessory Building or Structure. A subordinate building or structure located on a mobilehome space or lot, the use of which is customarily incidental to that of the main mobilehome. (1673-11/71, 2735-1/85) (c) Mobilehome or Travel Trailer Lot or Space. An improved plot within a mobilehome park or travel trailer park which is designated or used for the occupancy of a mobilehome or travel trailer. (1673-11/71, 2735-1/85) f (d) Mobilehome Park. An improved area or tract of land where mobilehome spaces or lots are rented or leased or held out for rent- or lease to accommodate mobilehomes used for one stopover exceeding thirty (30) consecutive days. (1673-11/71, 2735-1/85) 9/85 GENERAL PROVISIONS _ _ ' S. 9700.13(e) (e) Motel. A building or group of buildings designed. for the accommodation of transient automobile travelers in sleeping units which .have a direct outside entrance and conveniently-located parking spaces on the same lot. Said sleeping units may have kitchens or kitchenettes, up to a maximum of 25 percent of the total number of sleeping units. (1366, 1673-11/71, 2735-1/85) (f) Motor Vehicle Dismantling or Wrecking Yard. A motor vehicle dismantling or wrec ing yard shall mean ' the use of any lot or any portion of a lot for dismantling, disassembly, or demolishing motor vehicles., This definition shall not be construed to allow storage of motor vehicles, whether impounded or not, nor as a yard for the storage of scrap metals, scrap materials or junk. (2735-1/85) (g) Motor Vehicle Storage Yard. A motor vehicle storage yard shall mean the use of any lot or any portion of a lot for the storage . of motor vehicles, whether impounded or not. This definition shall not be .construed to include dismantling, wrecking, repairing or altering of any vehicle. (2735-1/85) (h) Mare shall mean a female equine which has attained the age of four (4) calendar years. (1769-8/72, 2735-1/85) (i) Maximum Wind Energy Conversion System Height shall mean the height of the tower and the furthest vertical extension of the rotor measured from grade. (2632-8/83, 2735-1/85) . S. 9700.14 Words beginning with the letter "N" shall have the following definitions: (a) Nonconforming Building. Any building or structure or portion thereof which does not conform to the provisions of the Huntington Beach Ordinance Code and which lawfully existed at the time the provisions with which it does not conform became effective. (495, 556, .1566-4/70) (b) Nonconforming Lot or Parcel. Any lot or parcel whose area, width or other dimensions do not conform to the provisions of the Huntington Beach Ordinance Code and which lawfully existed at the time the provisions with which it does not conform became effective. (1566-4/70) (c) Nonconforming Use. Any use of land, buildings, structures or portions thereof which does not conform to the provisions of Huntington Beach Ordinance Code and which lawfully existed at the time the provisions. with which it does not .conform became effective. (495, 1566-4/70) (d) Noncommercial Horse Stable shall mean the entire parcel of land upon which an equine or equines are maintained. It is the intent of this definition that such equines be owned by the resident and are maintained for private use. A noncommercial horse stable shall be any parcel on which four (4) or fewer equines are maintained: except that more than (4) equines may be .kept on a site where such equines are owned by the persons residing on such site (1769-8/72) 9/85 S. 9700.14(e) GENERAL PROVISIONS _ PLANNING ' (e) Net Site .Area shall mean the total of an area of a legally-created- parcel of land, computed within the parcel boundary lines exclusive of the following: all public and private streets, roads, accessways or easements which provide access over, across, and upon such property that physically prohibit the surface use for other than vehicular ingress and egress. (2340-2/79) S. 9700.15 Words beginning with the letter "0" shall have the following definitions: (2780-9/85) (a) Open or Public Land. Open or public land shall include parks dedicated or proposed to be dedicated for public use, school sites, easements or rights-of-way for electrical transmission lines, or areas set aside for public water uses or flood control channels. (b) Open Space shall mean any part of a lot or parcel unobstructed from the ground upward, excepting architectural features extending no more than thirty (30) inches from the structure and excluding any area of the site devoted to driveways and other parking areas. (c) Open Space, Common shall mean belonging to, shared by, or having an undivided interest in the use of real property by all members, individuals or residents of a particular real property development. (d) Open Space, Private shall mean belonging to, or restricted to the use and enjoyment of the occupant of a particular unit. (e) Overspeed Control. A mechanism used to limit the speed of blade rotation to within the design limits of the wind energy conversion system. S. 9700.15.1 Oversize Vehicles. An oversize vehicle is any vehicle, motorized or non-motorized, that exceeds twenty-five (25). feet in length, or exceeds seven (7) feet in width, and/or exceeds 'seven (7) feet in height. Oversize vehicles shall include all buses, truck tractors, semi-trailers, motor trucks, trailers, campers, camp trailers, house cars, trailer coaches and other equipment or machinery regardless of width, length or height. (2115-11/76) (a) Buses. A "bus" is any motor vehicle, other than a motor truck or truck tractor, designed for carrying more than ten (10) persons, including the driver, and used or maintained for the transportation of passengers. (b) Camp Trailer. A vehicle designed to be used on a highway, capable of human habitation for camping or recreational purposes, that does not exceed sixteen (16) feet in overall length from the foremost point of the trailer hitch to the rear extremity of the trailer body and does not exceed ninety-six inches (96") in width and includes any trailer coach. (c) Campers. A camper is a structure designed to be mounted upon a motor vehicle and to provide facilities for human habitation or camping purposes. A camper having one axle shall not be considered a vehicle. (d) House Car. A house car is a motor vehicle originally designed, or permanently altered, and equipped for human habitation or to which a camper has been permanently attached. 9/85 TGENERAL PROVISIONS _ �. 9700.15 JLej (e) Motor Truck. A motor truck is a motor vehicle designed, used, or maintained primarily for the transportation of property. (f) Semi-trailer. A semi-trailer is a vehicle designed for carrying persons or property, used in connection with a motor vehicle, and so constructed that some part of its weight and that of its load rest upon, or is carried by, another vehicle. (g) Trailer. A trailer is a vehicle designed for carrying persons or property of its own structure and for being drawn by a motor vehicle and so constructed that no part of its weight and that of its load rest upon, or is carried by, another vehicle. (h) Trailer Coach. A trailer coach is a vehicle, other than a motor vehicle, designed for human habitation, or human occupancy for industrial, professional, or commercial purposes for carrying property on its own structure, and for being drawn by a motor vehicle. (i) Truck . Tractor. A truck tractor is. a motor vehicle designed and used primarily for drawing "other vehicles and not so constructed as to carry a load other than a part of the weight of the vehicles and load so drawn. S. 9700.16 Words beginning with the letters "P" and "Q" shall have the following definitions: (a) Parallel Parking. . Parking which is immediately adjacent to and parallel to the edge of a private or public roadway or driveway. (1563-3/70) (b) Planned Residential Development. A land development designed and developed as a unit for individual ownership of dwelling units or. sites or air space rights in the area occupied by said dwelling units, with normal accessory residential uses, and permanently maintained common property with each resident having an undivided interest in the common area for use as parks, waterways, golf courses, or other recreation areas that are integrated with the dwelling units for the sole enjoyment of residents within the development. (1.563-3/70) (c) Private club or lodge shall mean any facility or meeting place of an organization requiring bona fide membership. (1853-6/73) . (d) Private street or roadway shall mean privately owned and maintained roadway exceeding twenty-five (25) feet in width, which is primarily used to provide vehicle access from a public street or highway to the front, side or rear of two or more abutting private . properties. (2487-6/81) S. 9700.17 Words beginning with the letter "S" shall have ' the following definitions: 6 (a) Service Station shall mean any retail business which offers for sale petroleum products, automobile accessories and replacement parts; and includes among its services automobile washing by hand, waxing and polishing. (b) Site shall mean the legally created parcel of land bounded by property lines after dedication. 9/85 S. 9790.17 c GENERAL_PROVIS_-oN_ PLANNING - (c) Site Coverage shall mean the building area of all structures on a site as measure from all exterior .building surfaces, including any patio covers, and any balconies and stairways with or without support posts. Architectural features such as bay windows, eaves and fireplaces that do not project more than thirty (30) inches, and decks that do not exceed more than. forty-two (42) inches in height are excluded. (d) Repealed - (Ord 2588-1/83) (e) Stall shall mean a compartment for one equine in a stable. (f) Stallion shall mean a male horse attaining the age of two (2) calendar years. (g) Stock cooperative shall mean a corporation which is formed or availed of primarily for the purpose of holding title to, either in fee simple or for a term of years, approved real property, if all or substantially all of the shareholders of such corporation received a right of exclusive occupancy in a portion of the 'real property title to which is held by the corporation, which right of occupancy is transferable only concurrently with the transfer of the share or shares of stock in the corporation held by the person having such right of occupancy. (h) Structure. Anything constructed or erected, the use of which requires more or less permanent location on the ground, or attached to the ground or attached to something having a fixed location on the ground. S. 9700.18 Words beginning with the letter "T" shall have the following definitions: (a) Trailer Court. ' Any area of land, improved or unimproved, which is designed to accommodate two or more trailers, house trailers, movable dwellings,. tents, sleeping quarters or outfits, or which is used, let or held out for rent to campers, tenants or guests furnishing their own equipment and paying directly for said space or indirectly through trade or labor. This definition shall also apply to "trailer park," "trailer camp," and to similar uses known by various designations. (b) Travel Trailers. A vehicle other than a motor vehicle which is designed or used for temporary human habitation and for travel or recreational purposes, which does not at any time .exceed eight (8) feet in width and forty (40) feet fn length. (c) Travel Trailer Park. An improved camping or vacationing area or tract of land where one or more spaces or lots are rented or held out for rent to accommodate travel trailers, campers, camp cars or motor homes for one stopover not to exceed thirty (30) consecutive days, and are then removed. (d) Townlot Area shall mean the area and parcels within the area bounded by Pacific Coast Highway on the southwest, Goldenwest Street on the northwest, Palm Avenue on the north and northeast, and Lake Street on the east and southeast. 9/85
