[Ves [ ] New Policy or Exception T'es ", s'9.5�� Statement of Issue, Recommendation,Analysis, Funding Source,Alternative Actions,Attachments: STATEMENT OF ISSUE: Transmitted for your consideration is Code Amendment No . 88-3A which reflects the approved language as modified by the California Coastal Commission on October 12, 1988 . RECOMMENDATION• Staff recommends that the City Council approve Code Amendment No . 88-3A, accepting the modified language as approved by the California Coastal Commissigia, by adopting Resolution No. and Ordinance No . Z ANALYSIS• On May 16, 1988, the City Council adopted Ordinance No . 2942 which revised the Downtown Specific Plan. The revisions included provisions to allow separate residential structures as part of a larger mixed-use project in District 3 ; conversion from mixed use commercial to 100% residential in District 4; commercial parking requirements in Districts 3 and 5 and language in the Downtown Specific Plan. Minor revisions were made throughout the document to reorganize, clarify and add new language. Staff transmitted the approved revisions to the Coastal Commission and on October 12, 1988, the Coastal Commission approved revisions to the Downtown Specific Plan with minor language changes . Pursuant to Coastal Commission regulations Section No . 13551, 13544 and 13544 . 5, it is necessary for the City to accept the modifications as approved by the Coastal Commission. Code Amendment No . 88-3A . includes the suggested modifications as acted upon by the Coastal Commission on October 12, 1988. \, • ','"... PIO 5/85 4 Acceptance of the modified language represents the formal action by the City to implement revisions to the Downtown Specific Plan. As a result of the Coastal Commission' s action on October 12, 1988, the City was directed to adopt modified language as follows : Modification Number Summary of Revised Languaae 1, 2 . In Section 3 , (§3 , 2, 1) District 4 shall remain a mixed use area where residential uses shall be primary use . The Coastal Commission approved the City' s request to allow single family detached dwellings within the mixed-use designation. 3 . In Section 4 , (§4 .2 . 13) the Coastal Commission approved modified language for commercial parking in districts 3 and 5 . The Coastal Commission approved language which requires on-site parking to the maximum extent feasible. Off-site parking shall be provided in a public parking facility within walking distance not to exceed 350 feet . 4 . In District 1, (§4 . 3) the Coastal Commission approved reinstating the original language for mixed use projects . 5, 6, In District 3 , (§4 . 5) the Coastal Commission approved the 7, 8 . City' s request to allow residential south of Main Street. As part of the approval, the Coastal Commission added language to ensure ample visitor serving commercial opportunities and balanced mixed use projects . 9 , 10 . In District 4, (§4 . 6) Coastal Commission approved detached single family dwellings as part of the mix of permitted use in Mixed Use land use designation. 11 . In District 6, (§4 . 8) the Coastal Commission directed City to reinstate original language. 12 . In District 7, (§4 . 9) the Coastal commission modified the City' s request for Professional Office as permitted use. Two limitations were imposed: a. Professional office shall not exceed fifty (50) percent of total floor area . b. Entire street level shall be devoted to visitor-serving commercial uses . 13 . In District 7, (§4 . 9) the City requested the deletion of the MH (Mobilehome)overlay. Since the mobilehome park that was located in District 7 has been vacated, the Coastal Commission directed the City to add language which makes a reference that the closing of the mobilehome park complied with the City' s existing Article 927 Mobilehome Park Conversion Ordinance. RCA - 11/21/88 -2- (1434d) COASTAL STATUS• Pursuant to Section 13551(b) (2) of the California Coastal Commission regulations, the approved language as modified by the,Coastal Commission requires formal local government adoption by means of a resolution. FUNDING SOURCE• Not applicable. ALTERNATIVE ACTION: The City Council may modify Code Amendment No. 88-3A as deemed appropriate. ATTACHMENTS: 1 . Resolution No. 2 . COASTAL STATUS: Pursuant to Section 13551(b) (2) of the California Coastal Commission regulations, the approved language as modified by the Coastal Commission requires formal local government adoption by means of a resolution. ON FILE: A copy of the proposed request is on file in the Department of Community .Development, 2000 Main Street, Huntington Beach, California 92648, for inspection by the public.
