STATEMENT OF ISSUE•
Code Amendment No. 88-8 reinstates two different sections of the code
related to temporary uses (maximum time period of five (5) years).
For the Residential Agriculture (RA) District, Section 9101(d)3
proposes to allow, by conditional use permit, the temporary
relocation of businesses that have been displaced due to property
acquisition by a governmental agency. For the Restricted
Manufacturing (M1-A) District, Section 9510.15.1 proposes to allow by
conditional use permit temporary recreational vehicle storage at
existing business sites.
RECOMMENDATIONS•
Planning Commission action on August 16, 1988:

VOTED TO APPROVE CODE AMENDMENT NO. 88-8 AND RECOMMEND ADOPTION BY
THE CITY COUNCIL, BY THE FOLLOWING VOTE:
AYES: Livengood, Silva, Leipzig, Ortega, Higgins, Kirkland
NOES: None
ABSENT: Slates
ABSTAIN: None
FINDINGS FOR APPROVAL:
1. The proposed code amendment will permit temporary uses that
will be compatible with the respective zoning designations.
2. The requirement for conditional use permit will ensure that
proper review of all requests will be made by the Planning
Commission.

3. The specific regulations adopted work to mitigate any adverse
affects through screening, landscaping and other requirements.
Staff recommendation is identical to that of the Planning Commission.
ANALYSIS:
The two provisions under discussion were repealed during the
consolidation and reorganization of Division 9 over the past few
years with the intent to readopt them in new sections. Approving
Code Amendment No. 88-8 will accomplish this goal.
The RA District proposal for allowing the relocation of businesses
has been used in the past. In 1979, the Planning Commission
approved a request to allow the Gustafson Brothers automotive repair
business on Crystal Street. The business' former location had been
acquired by the City as the site for a water department warehouse
facility. The potential for RA District properties to serve as
relocation sites in the future should be preserved. Adequate
measures are contained in the proposed code to ensure that all
requirements, including landscaping, parking and setbacks, are met.
The M1-A District provisions for permitting temporary recreational
vehicle storage as part of an existing business were applied to the
Weiser Lock facility at the corner of Graham and McFadden. A code
amendment was originally processed in 1982 to allow these uses,
which are generally compatible with other industrial operations.
The limitations placed in the code include setback and screening
requirements, and maximum land area. The reintroduction of both
provisions is appropriate.
ENVIRONMENTAL STATUS:
The proposed code amendment is categorically exempt from the
provisions of the California Environmental Quality Act.

Deny Code Amendment No. 88-8 with findings.
