STATEMENT OF ISSUE:
Transmitted for your consideration is Code Amendment No . 89-2, a
request by the Department of Community Development to grant citation
power to Land Use Code Enforcement personnel for the purpose of
enforcing the Zoning and Municipal Codes .
RECOMMENDATION:
1. Approve Code Amendment No. 89-2 and adopt the attached
ordinance granting citation power to Land Use Enforcement.
ANALYSIS•
In November, 1988, the Planning Commission formed an Ad Hoc
Committee to study land use code enforcement within the community.
In its final report to the City Council, the Ad Hoc Committee
recommended citation power be given to land use staff . The
committee noted that citation power would be used only in cases
involving health and safety or in cases involving chronic violators .
A survey conducted by the committee showed that the majority of
Orange County Cities have citation powers, including Anaheim, Santa
Ana, Garden Grove, and Costa Mesa. The Department of Community
Development supports the Ad Hoc Committee' s recommendation to grant
citation power to the Land Use staff, finding that compliance time
for chronic violators is decreased, the process becomes more cost
efficient, and would free-up City Attorney staff to concentrate on
more serious legal matters .
In a January 20, 1988 memorandum to Jim Silva, past chairman of the
Committee for Community Preservation, City Attorney, Gail Hutton,
supported the use of citation power if used "intelligently,
discretely, and in selected types of cases" . The City Attorney also
states that if citation powers are granted, the following items
should also be implemented: '

1. Change current misdemeanor violations to infractions
for A) parking on lawns HBOC S 9110 . 10, B) illegally
parked vehicles -- various code sections, C) portable
signs HBOC S 9610 .4 (m) & (n) .
2 . Provide a citation power -- Penal Code S 853 . 6 to
Senior Land Use Investigators .
3 . Senior Land Use Investigators shall receive peace
officer training before issuing citations pursuant to
Penal Code S 832.
4 . All issued citations shall be forwarded to the City
Attorney for review and approval.
5 . Citations will be filed with the court through the
Police Department process .
The Community Development staff supports the granting of citation
power to the Land Use staff for the following reasons : 1) decreased
compliance time for serious land use violations, 2) savings to the
taxpayer due to more efficient system, 3) will free-up City Attorney
personnel to concentrate on more serious legal matters . Both
Community Development and the City Attorney' s Office concur that
citations will not be issued by the Land Use staff until the case
has been fully reviewed and discussed by both Departments . Only
then, would a citation be issued. This check and balance system is
necessary to eliminate potential civil liability.
ENVIRONMENTAL STATUS: Pursuant to the environmental regulations
in effect at this time, the Department of Community Development
posted draft Negative Declaration No. 89-5 for ten days, and no
comments, either verbal or written were received. The staff, in its
initial study of the project, has recommended that a negative
declaration be issued. Prior to any action on Code Amendment No.
89-2, it is necessary for the City Council to review and act on
Negative Declaration No. 89-5.
FUNDING SOURCE:
Minor increase in revenue due to the issuance of citations .
ALTERNATIVE ACTIONS:
Deny Code Amendment No. 89-2 .

Background
Staff has reviewed the environmental information form noted above and has determined
that a negative declaration may be filed for the project. In view of this, a draft negative
declaration was prepared"and was published in the Daily Pilot and posted in the Office of
the City Clerk for a ten (10) day public review period commencing February 10, 1989 and
ending February 19, 1989. If any comments regarding the draft negative declaration are
received, you will be notified immediately.
Recommendation
The Environmental Resources Section recommends that the City Council approve
Negative Declaration No. 89-5 finding that the proposed project will not have a
significant adverse effect on the environment.

Environmental. Quality Act and not exempted under any of the

STATEMENT OF ISSUE•
Code Amendment No. 89-2, a request to grant citation power to Land
Use Enforcement Personnel was scheduled and advertised for the
March 6, 1989 City Council meeting. The ordinance granting citation
power to the Land Use staff is presently being revised by the City
Attorney' s office. The revised ordinance will be completed prior to
the March 20, 1989 City Council meeting .
RECOMMENDATION•
Staff recommends that the City Council reschedule Code Amendment No.
89-2 to the March 20, 1989 Council meeting to permit the City
Attorney' s office additional time to revise and broaden the proposed
ordinance.
ANALYSIS•
The staff is recommending rescheduling of Code Amendment No. 89-2, a
request to grant citation power to Land Use Personnel, to the
March 20, 1989 City Council meeting. The rescheduling of Code
Amendment No . 89-2 is necessary to permit the City Attorney
additional time to broaden the scope of the proposed ordinance
granting citation power to Land Use staff, with review by the City
Attorney' s office prior to issuance of a citation. Community
Development staff concurs with this proposed procedure. The new
ordinance will be completed and distributed prior to the March 20,
1989 Council meeting .

The Citv Attorney has reviewed the use of citation power by other
public agencies and conferred with the Ad Hoc Committee and
members of Community Development in an effort to resolve concerns
regarding the use of : citation power for land use violations . She
has informed me of her interest in supporting the granting of
citation power 10.intelligently-, discretely and in selected types of
cases ,
The following, is her . recommendation to the Ad- Hoc Committee which
