STATEMENT OF ISSUE•
Code Amendment No. 89-3, which revises Article 908 of the Huntington
Beach Ordinance Code, was advertized for public hearing to be held
on October 16, 1989 . Staff has determined, however, that additional
changes need to be made to complete the ordinance. As such, it is
necessary to continue this item for a twa week period.

Transmitted for your consideration is Code Amendment No. 89-3 which
revises Article 908 by adding, amending and/or deleting
definitions . The Code Amendment was reviewed and approved by the
Planning Commission on September 6, 1989 .
RECOMMENDATION.
Planning Commission action on September 6, 1989 :
On motion by Ortega and second by Williams the Planning Commission
voted to approve Code Amendment No. 89-3 with the following findings

implement and enforce the provisions of the Ordinance Code.
2 . Code Amendment No. 89-3 is consistent with the goals and
policies of the General Plan.
Staff Recommendation: Approve as per recommendation of the Planning
Commission.
ANALYSIS:
During various study sessions, the Planning Commission reviewed and
recommended changes to several definitions . The proposed ordinance
reflects the following amendments to Article 908 :

As part of the Code Amendment, the numbering system will be deleted
and all definitions will be listed in alphabetical order only. The
current numbering system used for each definition creates a
cumbersome burden to add new definitions to Article 908 .
ENVIRONMENTAL STATUS:
Pursuant to the environmental regulations in effect at this time,
the Department of Community Development posted draft Negative
Declaration No. 89-14 for ten days, and no comments, either verbal
or written, were received. The staff, in its initial study of the
project, has recommended a negative declaration be issued. Prior to
any action on Code Amendment No. 89-3, it is necessary for the City
Council to review and act on Negative Declaration No. 89-14 .

Due to the lateness of the hour, this item was continued from the
August 15, 1989 Planning Commission meeting.
At the July 6, 1989 Planning Commission meeting, staff was directed
to make changes to Code Amendment No. 89-3 and continued the public .
hearing to August 1, 1989 . The changes requested were incorporated
into the attached document; however, the public hearing was
continued to August 15, 1989 to allow re-advertisement of the final
draft .

(a) Minor repair. Light repair and sale of goods and services
for vehicles including brake, muffler, tire shops, oil and lube
and their accessory uses, but not including any of the activities
listed below as major repair.
(b) Major repair . Heavy automotive/vehicle repair including
but not limited to transmission, battery, radiator, and engine
repair or overhaul; welding; turning brake drums; steam cleaning,
body and fender work; painting; and upholstery.

nonmedical care to children under 18 years of age in need of
supervision on less than 24-hour basis Child day care facilities

9080 Dwelling. Studio Unit A dwelling unit consisting of
one kitchen one bathroom and one combination living room and
sleeping room The gross floor area shall not exceed 500 square
feet or it shall be considered as a one bedroom unit. Also known as
a single. a bachelor. or an efficiency unit.
9080 Dwelling. Second Unit A fully equipped dwelling unit
which is ancillary and subordinate to a principle dwelling unit
located on the same lot in the R1 zone.
9080 Dwelling Unit One or more habitable rooms with only
one kitchen. and designed for occupancy as a unit by one or more
persons living as a household unit with common access to all living,
kitchen. and bathroom areas.
9080 Final Approval Ten days after approval by the
discretionary body and no appeal of that decision has been filed.
9080 Grade The surface of the ground or pavement at a
stated location as it exists prior to disturbance in preparation for
a project by this code, includes natural grade.
9080 Gross Floor Area The total area of each floor within
the building exterior walls.

landscape material so arranged as to form a physical barrier or
enclosure,
9080 Hostel A supervised, inexpensive lodging for use by
youth. See Hotel,
9080 Industrial Use The manufacture, assembly, storage or
wholesale distribution of a product.
9080 Liquor Store Any establishment in which the primary
use is to offer any alcoholic beverage for retail sale for
consumption off-premises,
9080 Lot Frontage The linear length of a lot measured
along the Property line adjacent to a street or easement.

designed wherein at least one Person per unit is over 60 years of
age.
9080, Wholesale Use, A business which stores large stocks of
goods and sell them in bulk quantities to retail outlets Sales to
the general public do not occur on the site, nor is the location of
the business advertised through newspapers, flyers or other media
designed to reach the consumer.

shall be calculated as indicated for the following types of lots :
(a) Rectangular lot shall be measured along a line
equidistant to and twenty (20) feet from the front property line.
(b) Cul-de-sac and knuckle lots shall be measured twenty (20)
feet from the front property line along a line perpendicular to the
bisector of the front property line.

(c) Cul-de-sac lots siding on another street, channel, or
similar properties shall be measured along a line perpendicular to
the interior side property line and twenty (20) feet from the front

9080. 111 Parking Structure A structure used for parking of
vehicles where parking spaces, turning radio, and drive aisles are
incorporated within the structure
9080.125 Retaining Wall ' A structure designed to protect
grade cuts or retain the fill of dirt, sand or other grading material
9080. 126 Senior Citizen Housing Any housing exclusively
designed wherein at least one person per unit is over 60 years of age
9080. 150 Wholesale Use. A business which stores large stocks
of goods and sell them in bulk quantities to retail outlets Sales
to the general public do not occur on the site nor is the location
of the business advertised through newspapers, flyers or other media
designed to reach the consumer.
