The Code Amendment was reviewed and approved by the Planning Commission on September 6 , 1989 . RECOMMENDATION: Planning Commission action on September 6, 1989 : On motion by Ortega and second by Williams the Planning Commission voted to approve Code Amendment No. 89-9 with the following findings and recommend adoption by the City Council by the following vote: AYES: Ortega, Williams, Bourguignon, Mountford, Shomaker, Kirkland NOES: None ABSENT: Leipzig ABSTAIN: None FINDINGS FOR APPROVAL: 1. Code Amendment No. 89-9 creates regulations consistent with the policies of the City Council . 2 . Code Amendment No. 89-9 establishes procedures to satisfy the goals and policies of the General Plan. Staff recommendation is identical to that of the Planning Commission. ANALYSIS• Code Amendment No. 89-9 intends to revise Article 985, Design Review Board to bring the regulations into conformance with the policy of the City Council . The duties and membership of the Design Review Board have been amended. Other minor revisions and clarification of code sections are included. PIO 5/85 I ENVIRONMENTAL STATUS: Pursuant to the environmental regulations in effect at this time, the Department of Community Development posted draft Negative Declaration No. 89-24 for ten days, and no comments, either verbal or written, were received. The staff, in its initial study of the project, has recommended a negative declaration be issued. Prior to any action on Code Amendment No. 89-9, it is necessary for the City Council to review and act on Negative Declaration No. 89-24 . FUNDING SOURCE: Not applicable ALTERNATIVE ACTION: 1. The. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH AMENDING ARTICLE 985 OF THE HUNTINGTON BEACH ORDINANCE CODE RELATING TO THE DESIGN REVIEW BOARD The City Council of the City of Huntington Beach does ordain as follows : SECTION 1 : Article 985 of the Huntington Beach Ordinance Code is hereby amended to read as follows : Article 985 DESIGN REVIEW BOARD Sections : 9850 Design Review Board Established 9851 Duties 9852 Appeals 9853 Members 9853 . 1 Terms of Office 9853 . 2 Removal of Members 9853 . 3 Bylaws 9853 . 4 Secretary 9853 . 5 Advisors and Assistants to the Board 9854 Design Review by Application Form and Content of Application for Design Review 9854 . 1 Criteria for Approval 9854 . 2 Factors to be Considered in Applying Design Criteria -1- 9850 Design Review Board Established. There is hereby created a Design Review Board for the City of Huntington Beach referred to herein as the "Board. " (2381-7/79) 9851 Duties . The duties of the Board shall include the following : a . Encourage, control, and maintain harmonious , compatible, attractive, and aesthetic development within special and unique areas of the city. b. Review and act on the design of any structure, facility, landscaping or architecture to be constructed, altered or modified in areas designated Civic Facilities , Civic 7 Districts , Redevelopment Survey and Project Areas , and/or other areas so designated by the City Council . C . Approve, conditionally approve, or deny any design review . application forwarded to them by the Director, Zoning Administrator,, Planning Commission and/or City Council . d . Recommend to the Director, Zoning Administrator, Planning Commission and/or City Council either approval, conditional approval or denial of any design review application. 9852 Appeals. Any action of the Board may be appealed to the Planning Commission as provided in this code. -2- t 9853 Appointment of Membership. The Board shall be composed of five (5) members appointed by and responsible to the City Council . The membership shall consist of at least one ( 1) Planning Commissioner, two (2) City residents, and two (2) staff members . 9853 . 1 Terms of Office . The terms of office of Board members shall be as follows : Two (2) citizen members shall be appointed initially for a four (4) year term, and Planning Commission and staff members shall be appointed initially for a two (2) year term except that after the expiration of these initial terms , all Board members shall be appointed for four (4) year terms . 9853 . 2 Bylaws . The Board may adopt bylaws and rules as it deems necessary for the selection of its officers , the time and place of its meetings and such other matters relative to its work and administration of its duties which are not otherwise provided for by statute, ordinance or resolution. 9853 .3 Secretary. The Director of the Department of Community Development , or a person so designated by the Director, shall serve as secretary to the Design Review Board without the power to vote . 9853 . 5 Advisors and Assistants to the Board . The Board may request attendance at its meetings of any officer or employee of the City to assist the Board . The Board may make investigations and employ persons , subject to approval of the City Administrator, as it may deem necessary to perform its duties and functions . -3- 9854 Design Review by Application. Prior to the issuance of any permits a project within areas designated for design review must first submit an application to the Department of Community Development . The Board shall act on all applications within thirty days of submittal . 9854 . 1 Criteria for Approval . The Board shall utilize the following criteria in the review of applications : (a) The architectural and landscape design of a project must integrate harmoniously with the existing or planned character of the immediate neighborhood. (b) The design must stabilize and protect civic facilities or civic district areas and be compatible in scale and aesthetic treatment . (c) The design must enhance the desirability and/or enjoyment of the immediate neighborhood. (d) The design must improve community appearances by preventing extremes of dissimilarity or monotony in new construction or alterations of facilities . 9854 . 2 Factors to be Considered in Applying . Design Criteria . The Board shall consider the following factors in applying criteria to a design being considered under this article: : -4- - L (a) Height, location, bulk, area, materials, type and variations in any structure, facility, landscaping or architectural feature so considered. (b) Site layout, orientation and relationship to open areas, topography and existing or proposed structures in the surrounding neighborhood . (c) Sign design and its relation to the proposed use and surrounding neighborhood . (d) The probable and useful life of other structures on the site and in the immediate area . (e) All applicable provisions of this code . (f) Relation of the proposed use to other existing and proposed facilities .
