Statement of Issue, Recommendation,Analysis, Funding Source, Alternative Actions, Attachments: STATEMENT OF ISSUE : Transmitted for your consideration is Code Amendment No. 84-18, to permit "dancing and/or live entertainment" subject to the issuance of a conditional use permit and "teen dance halls" subject to specific locational criteria and the issuance of a conditional use permit in the C2 (Community Business) District, C4 (Highway Commercial) District, North Huntington Center Specific Plan, and Downtown Specific Plan. (Code Amendment No. 84-18 was initiated by the Planning Commission. ) RECOMMENDATION: The Planning Commission and Planning staff recommend that the City Council approve Code Amendment No. 84-18 and adopt the attached ordinance . ANALYSIS: Applicant: City of Huntington Beach Location: Citywide within the C2 District, C4 District, North Huntington Center Specific Plan and Downtown Specific Plan. Request: A code .amendment which would allow "dancing and/or live entertainment" and "teen dance halls" pursuant to specific locational criteria, subject to the approval of a conditional use permit by the Planning Commission within certain districts of the City. Planning Commission Action on August 7, 1984: ON MOTION BY ERSKINE AND SECOND BY MIRJAHANGIR CODE AMENDMENT NO. 84-18 WAS APPROVED AND RECOMMENDED TO THE CITY COUNCIL FOR ADOPTION, BY THE FOLLOWING VOTE: /V PIO 4/81 C.A. 84-18 September 6, 1984 Page 2 AYES : Erskine, Livengood, Mirjahangir , Porter , Winchell NOES: None ABSENT: Higgins, Schumacher ABSTAIN: None DISCUSSION: Code Amendment No. 84-18 requires a conditional use permit for all dancing and/or live entertainment establishments and teen dance halls for patrons under the age of 21. In addition, specific locational criteria for teen dance halls are included as follows: 1. The facility shall be separated from all property general-planned and zoned for residential use by a buffer which may include, but is not limited to, buildings, utility easements, permanent open space, or arterial streets. Block walls shall not be considered buffers. Buffers shall be sufficient to separate residential properties physically and acoustically from noise, trash, and any other nuisance generated by patrons of the dance hall. For the purpose of this subsection, permanent open space shall include golf courses, parksites, public utility and flood control rights-of-way at least one hundred (100) feet in clear width, and two hundred (200) feet of parking lot or landscaped area. 2. Hours of operation shall be established by the Planning Commission. 3. There shall be at least one supervisory employee twenty-one (21) years or older in attendance during operating hours. 4. To eliminate obstruction of the public sidewalk and entryway to the facility, a special area shall be set aside and designated for bicycle parking, or bicycle racks shall be provided. 5. The facility shall comply with all fire and building code regulations. 6. The facility shall comply with all applicable provisions of Chapter 8.40 , Noise Control, of the Huntington Beach Municipal Code. Currently, dancing and/or live entertainment in conjunction with a restaurant have been considered permitted uses in the same districts as restaurants without a conditional use permit. Teen dance halls have been considered private clubs and require approval of a conditional use permit without locational requirements. Imposition of a conditional use permit will enable the Planning Commission to review these uses for the following : q/ C.A. 84-18 September 6, 1984 Page 3 1. Adequacy of parking. More off-street parking spaces are required for dancing facilities than for restaurants. 2. Compatibility with surrounding properties and land uses. 3. Mitigating loud noise from dancing and/or live entertainment establishments. 4. Hours of operation. 5. Security. 6. Possible detrimental effects upon the general health, welfare and safety of persons residing and/or working in the vicinity. 7. Conformance with the General Plan. An ordinance to amend Districts C2 and C4 and the North Huntington Center Specific Plan are attached for adoption. After further analysis, staff recommends not adopting a resolution to amend the Downtown Specific Plan because "dancing and/or live entertainment" is currently permitted by C.U.P. and demand for a teen dancing facility in the downtown area does not presently exist. ENVIRONMENTAL STATUS: Pursuant to the provisions set forth under the California Environmental Quality Act of 1970, Code Amendment No. 84-18 is categorically exempt and no environmenal review is necessary at this time. FUNDING SOURCE : Not applicable. ALTERNATIVE ACTION: If the Council does not concur with Code Amendment 84-18 , the current review process for dancing and/or live entertainment and teen dance halls would remain in effect.
