STATEMENT OF ISSUE•
Code Amendment No. 87-4 was prepared in response to Planning
Commission direction to staff at the February 18, 1987 meeting . At
that time, Conditional Use Permit No. 87-6 and Conditional Exception
(Variance) No. 87-11 were under consideration. The request was to
allow the complete rebuilding of a non-conforming second unit at 522
13th. Street .
A second unit on a forty-five (45) foot wide lot is not allowed by
the Townlot standards because the code currently states that a
minimum of fifty (50) feet of frontage is required in order to build
more than one unit.
Staff recommended that the Planning Commission deny the applicant ' s
request but direct staff to initiate a change in the code to allow
duplexes on such lots . The Planning Commission chose to continue
the applications to May 19 , 1987, and directed staff to process a
code amendment .
RECOMMENDATION•
Planning Commission action on March 3 , 1987 :

ANALYSIS:
In reviewing the existing code, staff tried to determine a simple
and easily understood way to modify the density provisions for lots
with less than fifty (50) feet of frontage.
The top portion of the chart contained in Section 9130 .3 explains
that only one unit is allowed on lots with less than fifty feet of
frontage. The proposed ordinance changes this provision to read one
unit per 2, 500 square feet of net lot area .. This change will ensure
that lots with forty-five feet of frontage can legally accommodate
two units .
Using a 45 foot wide lot as an example, a 115 foot by 45 foot lot
contains 5, 175 square feet of net lot area. 5, 175 square feet
divided by 2, 500 equals 2 . 07, which' is rounded down to allow 2
dwelling units .
ENVIRONMENTAL STATUS:
Code Amendment No. 87-4 is categorically exempt from the provisions
of the California Environmental Quality Act .

1 . 0 SUGGESTED ACTION:
Approve Code Amendment No. 87-4 and recommend adoption by the City
Council.
2 .0 GENERAL INFORMATION:
Code Amendment No. 87-4 is the result of Planning Commission
direction to staff at the February 18, 19.87 meeting . At that time,
Conditional Use Permit No. 87-6 and Conditional Exception (Variance).
No. 87-11 were under consideration . The request was to allow the

that lots with less than fifty feet of frontage are allowed a
maximum of one dwelling unit . The proposed ordinance changes this
provision to read one (1 ) unit per 2,500 square, feet of net lot area
(see Draft Ordinance, Attachment 1 ) .
This change will ensure that lots with forty-five feet of frontage
will legally accommodate two units. Using a 45 foot wide lot as an
example, a 115 foot by 45 foot lot contains 51175 square feet of net
lot area. 5, 175 square feet divided by 2,500 equals 2 .07, which is
rounded down to 2 dwelling units.
The density factor of 1/2500 would actually translate into a yield
of 2 units beginning with a- 44 foot wide lot, but staff felt it was
important to choose a round number. In addition, there are no 44
foot wide lots that exist . ( It should be noted that if a 45 wide
lot is on a corner, additional dedication is required for a radius
curve . This reduces the net site area to 5, 089 square feet . Such a
lot would also yield two units under the proposed ordinance. )

We are the owner of a 45 foot wide lot , located at 522 13th
Street , which had 2 units already built on it when we
purchased it a few years age .
The rear unit is older and rather rundown . We desire to
rebuild it with an attractive modern new unit . It will be
a two story structure in keeping with the surrounding
architecture and will cover approximately the same ground
area as the existing unit . This unit would provide additional
covered and off street parking and comply with the current
city standards . It will be a one bedroom unit , same as the
existing unit , and the size of the open space would be
basically unchanged .
We are not able to obtain Planning Department approval to
rebuild beacause the property is 45 feet wide rather than 50
feet wide ; althrough there is another 45 foot wide lot in the
same block which had 2 unit constructed a few years ago .
We are more than anxious to upgrade the property and hope the
City Council will approve the Planning Commission proposal to
amend the code in the Town Lot Pacific Plan to permit 2 units
on a 45 foot lot .
