Statement of Issue, Recommendation,Analysis, Funding Source,Alternative Actions, Attachments:�&i STATEMENT OF ISSUE: Transmitted :for .your consideration. is Code Amendment 81-1; an amendment to the C2, Community Business. District, establishing a provision which would allow gasoline .dispensing in conjunction with convenience markets, pursuant to the approval of a conditional use permit. ) RECOMMENDATION: 1 The Planning Commission and Planning staff recommend that the City Council approve Code Amendment 81-8 and adopt the attached ordinance. ANALYSIS: Applicant: City of Huntington Beach Location: City-wide within the C2 and C4 zoning districts. Request: A code amendment which would allow gasoline dispen- sing in conjunction with convenience markets pur- suant to the regulations established within Code Amendment 81-8 .and the approval of a conditional use permit .by the Planning Commission. Planning Commission Action on June 2, 1981 : ON MOTION BY BANNISTER AND SECOND BY KENEFICK CODE AMENDMENT 81-8 WAS APPROVED FOR RECOMMENDATION TO THE CITY COUNCIL FOR ADOPTION: AYES: Bannister, Kenefick, Winchell, Porter, Schumacher, Paone NOES: None ABSENT: None ABSTAIN: None DISCUSSIQN: - Code Amendment 81-8 establishes criteria to allow gasoline dispensing in conjunction with convenience markets. Said criteria include re- quired offstreet parking for convenience markets/gasoline stations, P10 4/81 C.A. 81-8 June 25, 1981 Page 2 landscaping requirements which are consistent with the requirements set forth in the service station standards,: a convenience window for customers purchasing only.-gasoline, and a restriction on the number of major -identification signs to one major identification sign per site and one detached sign for the purpose of providing gasoline pricing information.. Also included within these provisions is a re- quirement for each proposed convenience market/gasoline station to be reviewed. by -the Planning Commission and the approval of a conditional use permit. Also included in Code Amendment` 81-8 is a. section which prohibits normal service station uses in conjunction with such convenience markets/gasoline stations . This provision is to prohibit uses .that .are normally found in conjunction with full-service stations such as engine tune-up or repair, truck and/or utility trailer rental, and outside commercial activities commonly found .in full-service service stations. Said convenience markets/gasoline stations would be permitted in the C2, Community Business District, pursuant to .a conditional use permit and in the C4, Highway Commercial District, also pursuant to a condi- tional use permit. After reviewing the proposed..:criteria established in Code Amendment 81-8, the Planning Commission approved said code amendment and recom- mended its adoption. by the City Council. ENVIRONMENTAL STATUS: Pursuant .to the provisions set forth in the California Environmental Quality Act, Code Amendment 81-8 is exempt from environmental review. FUNDING SOURCE: Not applicable. ALTERNATIVE ACTION: The Council may consider denying Code Amendment 81-8, which would pro- hibit. gasoline dispensing in conjunction with convenience markets. SUPPORTING INFORMATION: 1. The proposed, Code Amendment would allow convenience markets/gasoline stations within the C2 , Community BusineSs' District subject to the approval of a Conditional Use Permit. In addition, convenience markets/gasoline stations would be allowed within the C4 , highway Commercial District subject to the .provisions and development criteria contained within the C2 Community Business District. The suggested development criteria outlined within the C2 District includes provisions for "permitted uses" , 'prohibited uses" , "signing" , "off-street parking" , and "landscaping" .
