Palin, Director, Development Services • Subject: CODE AMENDMENT NO. 82-10 Statement of Issue, Recommendation, Analysis, Funding Source, Alternative Actions, Attachments:'7f�/ STATEMENT OF ISSUE: In February, the Council adopted an ordinance providing Iocational criteria for game arcades. After nine months of working with this ordinance, staff has suggested some modifications which would clarify .and more precisely define the criteria. The Planning Commission ap- proved the changes at their meeting on December 7, 1982. RECOMMENDATION: Following a public hearing, adopt. the ordinance amending Section 9332 of the Huntington Beach Ordinance Code relating to game arcades. PLANNING COMMISSION ACTION: The Planning Commission recommended approval of Code Amendment 82-10 on December 7, 1982 by the following vote: ON MOTION BY LIVENGOOD AND SECOND BY WINCHELL CODE AMENDMENT NO. 82-10 WAS APPROVED AND RECOMMENDED TO THE CITY COUNCIL FOR ADOPTION, BY THE FOLLOWING VOTE: AYES : Higgins, Livengood, Winchell, Paone, Porter, Schumacher, Mirjahangir NOES: None ABSENT: None ABSTAIN: None ANALYSIS: Code Amendment No. 82-10 was initiated by the Planning Division to clarify and further define the locational criteria for game arcades which were adopted by the Council on February 16, 1982. The proposed changes, which are discussed below, relate to two areas: buffers and distance from schools. r�� Code Amendment 82-10 December 21, 1982 Page 2 1. A brief statement is added specifying the purpose which buffers are intended to serve. This statement reads, "Buffers shall be sufficient to separate residential properties physically and acoustically from noise, trash and any other nuisance generated be patrons of the arcade" . The buffer criteria is also broadened to include two hundred feet of parking lot or landscaped area as a qualified buffer. Furthermore, the criteria proposes to specify that buffers will be required to separate a game arcade facility from all property "general-planned and zoned for residential use" , not simply from "residential property" as it does now. 2. The criteria for distance from schools has been changed to state that "distance" will be the shortest walking distance. The walk- ing distance is frequently different from the driving distance because of cul-de-sacs, vacant land which can be traversed on foot, and other unforeseen possibilities. Since it is the temp- tation of the game arcade to attract school-aged children before or during school that is of concern, it seems logical that walking distance would be the distance that should be measured. The Planning Commission approved Code Amendment No. 82-10 on Decem- ber 7, 1982, and recommended it to the City Council for adoption. FUNDING SOURCE: None needed. ALTERNATIVE ACTIONS : Do not adopt the ordinance amending Section 9332 of the Huntington Beach Ordinance Code relating to game arcades. In this case, the locational criteria, as they . are presently constituted, would continue to regulati game arcades.
