Any questions, Please call. *1 -J� 2. 1D I respectfully request an update on the status of the report Council requested regarding the blocks within the Downtown Specific Plan that are designated -MIXED USE! These designations require the owner/developer to create commercial & residential uses combined in these areas. Specifically, concerns include: -Are these secondary uses (locations) suitable for commercial operations? -Are the parcels located in this area served by the Parking Structure? -Do these predominately 25 foot frontages accommodate commercial or residential uses? -Even with revisiting the use of "Eminent Domain" and therefore the potential for lot consolidation, should this present zoning be reevaluated? 2. The issue of the Park Improvement District should be revie ed. Specifically, I present a motion for consideration" -"It is moved that the timing for the Park Improvement District's Advisory Vote be moved from the current proposed Special Election in the Spring of 1996 to the General Election of 1996, and that the minimum vote required to have the City Council consider such action be 66 2/3rds % vote." The issue of moving this Advisory Vote is paramount to any serious consideration of this proposed $30 Million new tax for our resident because of the usually low turn -out at Special Elections and the significant voter turn -out at presidential elections in my mind at least. However, some discussion would be accepted as to a minimum standard of no less than 60% "Advisory Vote" approval for such action is essential for my support. The state of California mandates a full 66 2/3rd % vote for new taxes, our own City Charter requires a full 70% vote; we should require nothing less than the same for our own constituents, however, I remain open to discussion. Those items arc to: 1. Set the Landscape and Assessment District vote for November 1996 instead of March 1996. 2. Requirc a 2l3 majority for the District to take effect. Save Our Kids would like to go on record in the following manner. 1. A number of discussion on March verses November for the vote have been had. Positions have been animated for each date, but not substantive. A few points that did come out which lead me to our conclusion are: a. Momentum is built out of need. A short focused campaign where the energy of the City is focused on the issue, will be more successful. b. The March election is a City election. The issues are issues that relate to the City and will garner more concentrated attention, than during a Presidential election. c. Evaluation of the momentum in early November toward the March election would give the Council time to change the date to November then, if needed but the reverse is not true. Therefore, Save Our Kids supports leaving the election date March 1996 with in evaluation point in November to assess the potential. 2. A 2/3 vote for approval is a show stopper. The City is too large to go back to the Town Meeting, concept. The basis of City Councils and Mayors is for the elected officials to examine the pro and Con of a situation and do what is best for the City as a WHOLE. I realize that Prop 13 and Measure C initiatives represent part of the reality of current government. However the Council does not need to follow short-sighted, misdirected initiatives and abrogate their ability to make a decision for the City in this case. Save Our Kids would like to have the Council defeat the request for a 2J3 votes. y agard Chairman
