RE: CODE AMENDMENT NO. 65-11, an amendment to Article 973
of the Huntington Beach Ordinance Code.
Gentlemen:
Transmitted herewith is a proposed amendment to Article 973
of the Huntington Beach Ordinance Code.
This provision islan amendment to Article 973.-Miscellaneous,
which will permit home occupations in the R-1, Rl-PD5, R-21
R-3, and R-4 Vistricts,subject to approval of a Use Permit.
The Planning Commission unanimously approved this matter
January 4, 1966, and recommends adoption by your Honorable
Body.
The Code provides that a public hearing shall be held on the
matter after which an ordinance may be adopted effecting the
change.

a)
The business shall be restricted to one .room
only in the dwelling and all material, equipment
or facilities shall be kept therein.
b")
No garage shall be used '-I'n connection with such
business, except for parking of business
vehicles.

Only persons residing on the premises may be
employed.
d')
There shall be no display of merchandise, products,
operation,, signs or nameplates of any kind vl!Able
from outside the dwelling.
e)
In no way snall the appearance of the dwelling
be altered or the operation of the business
withiD the dwelling be such that the dwelling
may be reasonably recognized as serving a
nora-residential use. whether by colors materials.
construction, 1-ighting, windows, signs, sounds
or any other means.
There shall be no storage of materials, supplies,
equipment 3r products outside of the one room of
the dwelling used for a home occupation.

The occupation shall not generate pedestriv-ri Jr
vehicular traffic beyond that normal to the
neighborhood in which it is located.
h)
The occupation shall not involve the use of
commercial vehicles for delivery of materials
to or from the premises.
L)
No commercial vehicle or equipment used in cor-
janction with the occupation shall be parked
overni&t on the street or in the front yard
of the premises.
The occupation shall not create noise, odor,
dust. vibration, fmes, or smoke readily
discernible at the boundaries of the parcel
on which it, is sitRiated, nor create any
electrical disturbances adversely af-fecting
the operation of any applimee or eTaipmewt-
not on the same parcel.
All provisions of the Fire Prevention Code
shall be complied with.,
1)
Any violation of the conditions for approval
of a home occupation shall be cause nor revocation
of the business license and immediate cessation
of the occupation.
m)
Any license issued under the conditions set
forth shall be for a period not to exceed
one year. Said License may be renewed from
year-to-year, provided that no complaints have
been registered regarding the conduct of such
business dtu?ing the period for which it has
been licensed. If a complaint has been registered,
a review and determination on the renewal of
said license shall be made by the Board of
Zoning Adjustments, If a complaint. -is
justified and a v_folation of the conditions
of approval exists, the Board shall cause the
revocation of the business license and the
immediate cessation of the occupation.
n)
An affidavit shal.". be signed by the applicant
at the time he takes out a business license.
He shall certify that he understands all conditions
of approval
