Palin, Director, Development Services 0 Subject: MOBILEHOMES IN SINGLE-FAMILY ZONE � a73 � Statement of Issue, Recommendation,Analysis, Funding Source,Alternative Actions, Attachments: STATEMENT OF ISSUE: During the 1980 session of the State Legislature, Senate Bill 1960 was enacted which mandated that cities and counties permit the establishment of mobilehomes/manufactured homes on individual lots in single-family residential areas. (Federal law describes mobilehomes as manufactured homes . ) The effective date for the bill was July 1, 1981 . Because the Huntington Beach Ordinance Code presently prohibits temporary structures in the R1 residential zoning districts, revision of the City Ordinance will be necessary to comply with the new law to allow mobilehomes on permanent foundations . RECOMEMNDATION: The Planning Commission and the Planning Staff recommend that the City Council approve Code Amendment No . 83-15 and adopt Ordinance No . .2 , and Negative Declaration No. 83-17 . ANALYSIS: State law allows the City to designate the single family lots that are compatible for such use. Determination of compatibility may be found by a zone change to add the (-MFH) suffix to property zoned R1 . Once the suffix .is affixed, a property owner may develop under the base zone requirements or base zone and manufactured home criteria. This criteria addresses items such as roof overhang, roof material, and exterior siding. Ordinance No. consists of two sections . Section One amends the definition of mobilehome to conform to State Code. Section Two adds a minimum residential size to Article 910 and also adds Article 910.5 which establishes standards to permit manufactured homes in single family residential districts . Negative Declaration No. 83-17 JWP:SP:ajh (1260d) ORDINANCE NO. 2735 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY AMENDING SECTION 9700. 13 , TO DEFINE MANU- FACTURED HOME; AND ADDING THERETO NEW ARTICLE 910. 5 ENTITLED , "MANUFACTURED HOMES ON SINGLE- FAMILY LOTS The City Council of the City of Huntington Beach does ordain as follows : SECTION 1 . The Huntington Beach Ordinance Code is hereby amended by amending section 9700 . 13 to read as follows : 9700. 13. Words beginning with the letter "M" shall have the following definitions : (a) Mobilehome/Manufactured Home means a structure , trans- portable in one or more sections , which , in . the traveling mode , is eight feet or more in width , or 40 body feet or more in length , or , when erected or, site , is 320 or more square feet , and which is built on a permanent chassis and designed to be used as a dwelling with or without a permanent foundation when connected to the re- quired utilities , and includes the plumbing , heating , air condi- tioning , and electrical systems contained therein ; except that such term shall include any structure which meets all the require- ments of this paragraph except the size requirements and with re- spect to which the manufacturer voluntarily files a certification and complies with the standards established by this article . "Manufactured home" includes a mobilehome subject to the National Manufactured Housing Construction and Safety Act of 1974 (42 U. S. C. , Sec. 5401 , et seq. ) . (b) Mobilehome Accessory Building or Structure . A subordi- nate buil ing or structure located on a mobilehome space or lot , the use of which is customarily incidental to that of the main mobilehome . (c) Mobilehome or Travel Trailer Lot or Space. An improved plot within a mobilehome e parT­or travel trailer park which is designated or used for the occupancy of a mobilehome or travel trailer. RCS:ahb 9/24/84 0094K Rev. 1 . (d) Mobilehome Park . An improved area or tract of land where mobilehome spaces or lots are rented or leased or held. out for rent or lease to accommodate mobilehomes used for one stopover exceeding thirty (30) consecutive days . (e) Motel . A building or group of buildings designed for the accommodation of transient automobile travelers in sleeping units which have a direct outside entrance and conveniently-located parking spaces on the same lot . Said sleeping units may have kitchens or kitchenettes up to a maximum of 25 percent •of the total number of sleeping units. (f) Motor Vehicle Dismantling or Wrecking Yard. A motor ve- hicle dismant ing or wrecking yard shall mean t e use of any lot or any portion of a lot for dismantling , disassembly, . or demol- ishing motor vehicles . This definition shall not be construed to allow storage of motor vehicles , whether impounded or not, nor as a yard for the storage of scrap metals , scrap materials or junk. (g) Motor Vehicle Storage Yard . A motor vehicle storage yard shall mean the use of any lot or any portion of a lot for the storage of motor vehicles , whether impounded or not. This defini- tion shall not be construed to include dismantling , wrecking , re- pairing or altering of any vehicle. T (h) Mare shall mean a female equine which has attained the age of four 4) calendar years . (i ) Maximum Wind Energy Conversion System Height shall mean the height of the tower and the furthest vertical extension of the rotor measured from grade. SECTION 2. The Huntington Beach Ordinance Code is hereby amended by adding thereto section 9108. 7 and new article 910. 5 entitled , "Manufactured Homes on Single-family Lots ," to read as follows : 9102. 7 . MINIMUM RESIDENTIAL SIZE. The minimum residential size shall be as follows : (a) The minimum residential floor area shall be one thousand (1000) square feet . (b) The minimum width of a residential structure shall be twenty (20 ) feet . A reduction in minimum width for a portion of or addition to the main building is subject to approval by the Director . 2 . 910. 5 . 1 . PURPOSE. The purpose of this article is to estab- lish standards to permit manufactured homes in single family resi - dential districts . 910. 5 . 2. APPLICATION OF ARTICLE. The provisions of this article shall apply to all real property located in a low-density district , "R1 , " when the suffix "MFH, " representing manufactured homes , has been added to a low-density district designation. Real property designated "MFH" shall be developed to conform to the provisions of this article and the requirements for the base dis - trict , and all other applicable provisions of this code . The pro- perty owner shall also have the option of developing solely under the provisions for a low-density district . 910 . 5 . 3 . DEVELOPMENT CRITERIA. The manufactured home shall meet all of the following criteria: (a) Shall be occupied as a residence . (b) Shall be subject to all base district provisions . (c) Shall be attached to a permanent foundation which com- plies with all applicable building regulations . A foundation per- mit shall be required . (d) Shall have a minimum width of twenty (20) feet . (e ) Shall be covered with an exterior material customarily used on conventional single-family dwellings and approved by the Department of Development Services . The exterior covering material shall extend to the ground except that such covering material need not extend below the top of the foundation when a solid concrete or masonry perimeter foun- dation is used. (f) Shall have a shingled , pitched roof of not less than two (2 ) inches of vertical rise for each twelve (12 ) inches of hori - zontal run. (g) Shall have eave overhangs of not less than twelve (12) inches . (h) Shall have the same exterior material covering the garage as that of the main dwelling . (i ) Shall have an insignia of approval issued by the United States Department of Housing and Urban Development . S 3 . x. (j ) Shall not have been altered in violation of applicable codes . (k-) Shall be assessed park and recreation fees as a single- family dwelling. 910. 5 . 4. SURRENDER OF REGISTRATION. Prior to occupancy or final inspection of an existing manufactured home , which complies with these provisions , any vehicle license plate , certificate of ownership , and certificate of registration , issued by a state agency shall be surrendered to the Department of Development Services for transmittal to the appropriate state agency. The owner of a new manufactured home which has never been reg- istered with the California Department of Motor Vehicles , shall furnish to the Department of Development Services a statement to that effect , from the dealer selling the manufactured home , prior to issuance of a building permit. SECTION 3 . This ordinance shall take effect thirty days after its passage . .
