Statement of Issue, Recommendation,Analysis, Funding Source, Alternative Actions, Attachments: STATEMENT OF ISSUE: As part of the implementation phase of the Local Coastal Plan, the California Coastal Commission funded the City to review and update, as necessary, the municipal zoning ordinances related to oil pro- duction. Last August, the City Council activated an Oil Committee, composed of public officials, industry representatives and City Staff, to help with the review of these ordinances. The Oil Com- mittee found the sections of the code related to Oil Districts (Article 968) to be confusing and to contain superfluous pro- visions. The Oil Committee has recommended revisions to Article 968 which are intended to make it clearer and more concise while increasing the protection afforded both to the oil operator and to neighboring uses. RECOMMENDATION• 1. Approve Code Amendment 81=4 and adopt attached Article 968, ' "Oil Districts. " 2 . Unless Council directs otherwise, staff will 1) identify all active oil wells which are on properties which ate not now in an oil district, and 2) initiate proceedings to add the 0 suffix to those properties. Recommendation to establish 110" suffix on active well sites. r PIO 4/81 Page Two PLANNING COMMISSION ACTION ON' APRIL 21 1981: ON MOTION BY KENEFICK AND SECOND BY WINCHELL CODE AMENDMENT NO. 81-4 WAS ADOPTED FOR RECOMMENDATION TO THE CITY COUNCIL FOR ADOPTION, BY THE FOLLOWING VOTE: AYES: Bannister, Kenefick, ,Winchell, Paone NOES: None ABSENT: Porter:, Schumacher ABSTAIN: None ON MOTION BY PAONE AND SECOND BY KENEFICK STAFF WAS DIRECTED TO IDENTIFY ALL ACTIVE OIL WELLS WHICH ARE ON PROPERTIES WHICH ARE NOT NOW IN AN OIL DISTRICT., AND TO INITIATE PROCEEDINGS TO ADD THE "O" SUFFIX TO THOSE PROPERTIES, BY THE FOLLOWING VOTE AYES: Bannister., Kenef ick, Winchell, Paone NOES: None ABSENT: Schumacher ABSTAIN: Porter The principal changes to Article 968 which would be effected by this code amendment are discussed briefly below (refer to Attachment #1) : • Section .9680 ("Purpose") : This has simply been "streamlined, " without significant changes to the content. • Section 9680..1 ("Definitions") : Certain terms referred to in the ordinance but not previously defined have been included; other terms which are not relevant to the provisions of the Article have been removed. • Section 9680..3 ( !,Plan Required") : This section requires persons who wish to subdivide or develop properties on which oil operation sites exist to submit a plan for the disposition and treatment of existing and .proposed oil facilities. The purpose of such a plan is to help protect potential neighbors to the existing oil facilities and to satisfy the legitimate needs of the oil operator for access to a street. or alley and for enough open surface area to continue his operations safely and efficiently. Section 9681 ("0 Districts") : This section has been changed to prohibit buildings in an 0 District which would not otherwise be permitted in the base zone. This provision was added to preclude the development of warehouses and large storage sheds in residential, commercial and other districts where such uses are inappropriate. Section 9681.2 ("Minimum- Surface Area Required") : This section sets a minimum allowable size for an 110" district. Section 9681. 3 ( "Informatio.n Required") : This section requires persons who want to. reinstate an 0 district to submit to the Planning Commission with their, zone change application a legal description of the property, a plot plan of the site, and the location of adjacent- buildings, roads and alleys. Page Three Section 9682..1 ( "Minimum Surface Area Required") : This section sets a minimum allowable size for 0-1 districts; (-these are the only districts in which the drilling of new wells is permitted) . The 0-2 district has been deleted. The 0-1 and 0-2 districts both al- lowed the same uses. The only difference between-..suffixes was the relative sizes and distribution of the corresponding districts in the City. . Different suffixes. are generally used to define different sets of permissible uses and are not necessary for determining. the size and location of functionally equivalent use districts. If the code amendment is .approved and adopted,. all 0-2 districts should be rezoned 0-1. (Very little rezoning will actually occur because there are currently very few 0-2 districts in the City. ) In addition., the Oil Committee has recommended that. the. "0" district suffix should be applied to all sites on which active wells are not now zoned for oil,: This action would make such active wells "con- forming uses" in terms of Division 9 of the Municipal Code. The application of the 0 district would not allow new wells on these sites, but would explicitly permit servicing and repair work for the existing, active wells. It would also allow redrilling of existing wells; this may increase the life of these wells but would not entail new pumping units on the surface. If Council wishes to act on this recommendation., the next step would be for staff to identify the parcels in the City on which active wells are present but which are not now zoned 0., and to prepare zone change proposals for those parcels.
