A postponement was in order to amend Ordinance No. 2181 as requested to read that the Oldtown Specific Plan would not apply in instances where plans had been filed for building permits or, where a use permit had been filed prior to the effective date of the Specific Plan. The intended purpose of this modification was to afford reasonable assurances that, once initial procedural steps have been taken on a development proposal under the existing zoning; pending changes in the code upon taking effect would not obviate the proposal. Ordinance 2171 and 2181, as amended, are attached for the Council' s consideration. RECOMMENDATION: B The staff recommends the following: 1. Adopt Ordinance No. 2171 (Oldtown Specific Plan) 2. Concern that permit applications will violate the spirit of the zoning ordinance. 1. Applications for 723 Alabama and 201 Frankfort. (see Fig. 1) Soon after the CC approved the Old Town Ordinance, a lady on Alabama phoned me that a permit was being requested f Coastal to demolish a nearby house and replace it with 5 units . ( ( on Fig. 1) . Area residents were upset about this. Several people told me of their concern about a request to Coastal to demolish the warehouse and 2 single-family-dwellings at 201 Frankfort and to replace these with a 16-unit apartment. Area residents are also very concerned about this . ( O1 on Fig. 1) . From Fig. 1 it's readily evident that these proposals are completely incompatible with the area. Because of numerous protests, the warehouse owner may build 5 homes instead of the 16-units (also may not demolish the 2 single-family- residences?) . But the bulk aren't in the Coastal zone and have no recourse to protect their areas until the new zoning becomes effective. 2 . Other applications that violate the spirit of the ordinance The most immediate concern is for the area below Memphis --- that's where the homes are concentrated (although we do not sanction adverse building above Memphis either) . The number of applications to the buildin; Dept might indicate that a number are willing to ruin the area for those who live there. Pr6vious experience with those who "must" develop contrary to the original image of the area. .The f.bllowing examples (a number more exist) are meant to emphasize a point, not to embarrass anyone. We can't change what's happened in the past. But possibly those who don't learn by history may be condemned to repeat it. 1. 22 units at 415 - 15th St. (about 1971) The developer requested a variance to construct 22 units on a 100 foot lot that was zoned for 12 units. 100% of the neighborhood residents opposed it, but it passed. Since I was unaware of what was happening at the time, I can only speculate that the sales pitch went something like : "This area has mainly older sturctures . With the oil wells going out, I can improve the area with my new construction, if you give me the incentive --- the 83% density bonus --- that I 'm requesting." The developer later remarked about this project, "I know that this wasn' t a good development. They 're all bachelor units with a high vacancy factor, transiency and a lot of police problems. But I was just a guy ' trying to make a buck. " Russell BOM told me that he had to move to kee_p__his peace of mind. 2 . Triplex next to a home (about 1971) . A developer asked for a variance to higher density to build a triplex in an R2 area. Objectinns were raised that this was contrary to the image of the area, was at a higher density than the zoning, .that the area was entirely one of a home-residential look and that the developer had submitted no plot plan, floor plan or elevation plan. Old Towne -3- 3-18-77 ` Assurances were liven that the developer wc,-id build an attractive structure in keeping with the area. His request was approved. I didn't oppose it very strongly during the PC hearing because of the inference that not to allow this would adversely limit the developer. And I sympsthized with the developer. What resulted was completely incompatible with the area. He followed this up with a similar box next to a couple who 'd lived in their home over 50 years . The husband (who 'd fought it very hard) died within one year. He widow told me this was due mainly to his frustration over and inability to prevent the triplex being built next to them. They couldn't afford to move . Observations • There will always be those who push to get more than they should out of an area. • People will always have good stories on why they should develop at a higher density than the original character of the area. We'll always have these pressures . • Not being allowed to do this usually doesn't cause nearly the hardship that's inferred. It's nothing compared to the traumas possibly inflicted on some who'll remain in the area. • It's unfortunate when those on lower and moderate incomes (and others) are the ones victimized by having undesireable' development go up near or next to them -- just so that those who'll make tremendous profits anyway can get more . Many of the victims can't afford to move --- or find it impractical to. • Those who'll continue to live in an area should not be permanently stuck with the bad results of someone else 's temporary investment. • I have no empathy for those who're willing to inflict adverse development on area residents . A number of developers etc. show concern about what happens to an area. Good examples incline Mel Hoeffliger, Sally Gipple and the Thomas bros . Profits on Old Town Property should be exceptional even under the new zoning. • A house built 2 years ago on a 27 foot lot doubled in value. • I believe that land values have doubled or more in the last 2 years (54-foot lot now o45, 000 or so) . • The gentleman who had his property for 40 or 45 years probably paid $1,000 or less for a 54-foot lot. It's now probably worth ;�45,000 or more . He 'll be hurt like the person was hurt who only bet 010 on the winning horse instead of $100. The investors/speculators etc. had the possibliity of foreknowledge . The Land Use Element was passed about 2 years ago. Is one unit per 25 to 27 foot frontage too low a density to expe$bt for a "Low Density Area?" 45% of the resident owners and 33% of the absentee owners (sampled by the PD in the 2 Districts) preferred houses on 50-foot lots. That's half the , density t&r the new ordin4ce for District One (Low Density) , The ordinance had its first PC hearing on 9-21-76 (about 6 months ago) . New ordinance on building permits . We know that most CC members firmly support the Old Town zoning ordinance. My impressi is tha the 2nd reading of the zoning ordinance was resc6huled to Apr. 4 solepy as a. procedural matter to coincide with the 2nd reading of the building,.permit ordinance. Old -4- 3-18-77 Also that the building permit ordinance is written because the Building Dept feels it can't process all the permit applications for the previous zoning before the new zoning becomes effective. None of us were present Mar. 14 to give our viewpoint since our infor- mation was that the 2nd reading is almost automatic. Concerns over undesirable developments . The main concern is that a significant number of permits will be requested for multiple units by and near homes --- that the barn door will be left open long enough for all the horses to get out. This is all the more possible since the 2nd reading is postponed for 3 weeks. Possible ways to improve the situation include: 1. The Building Permit ordinance: not to include conditional use permits . These permits give a one-year leeway, which we definitely don't want. Also see previous comments. . to handle only permits under the old zoning , that they'd have handled by Aprl 13 (the time the new zoning ordinance would become effective If it.had had it's second reading as scheduled on Mar. 14) . 2 . Have the 2nd reading of the Old Town ordinance on Mar. 21. 3 . A moratorium on Old Town permits in excess of the new zoning within 150 feet of property that contains one or more single-family-dwellings. } e a A . ' Huntington Beach Planning Commission P.O. Belsito, City Administrator DATE: February 17, 1977 SUBJECT: CODE AMENDMENT NO. 76-12 "OLDTOWN SPECIFIC PLAN" Upon continuing the matter of Code Amendment No. 76-13 Oldtown Specific Plan to the February 22, 1977 meeting, the City ,, Council requested that, in view of the split vote by which the issue was approved by the Planning Com- mission, it would be desirable to gain a further understanding of the view- points expressed by Commissioners upon passage of the ordinance proposal. The majority report is essentially the Planning Commission' s original trans- mittal to the Council on this matter. However, the discussion in the trans- mittal was of a general nature and did not include specific reasons as to why the Planning Commission approved the document. Minutes of the Planning Commission action on the Oldtown Specific Plan are attached from the Council ' perusal. The Planning Commission' s reasons for approving the specific plan are as follows: 1. The proposal would enable single family homes and thus contribute to the preservation of the neighborhood character. 2. Approval of the specific plan would not result in appreciable economic impacts upon the City, residents, or developers. 3. The proposal is consistent with the General Plan of the area. 4. The legitimacy of zone change by code amendment is valid. 5. The proposal would promote construction of a variety of housing types .thus preventing an undue concentration of tri-plex and four-plex units in the subject area. 6 . The effects of a specific plan of this type have proven successful in the Townlot Area. In the 4 to 3 vote to approve Code Amendment No. 76-12 , Commissioners Gibson, Siates, and Shea dissented. The following synopsis recaps the viewpoints of those Commissioners. { Page Twp , Commissioner Gibson was concerned about the boundaries of the two dis- tricts within the Oldtown Specific Plan and questioned the need to in- clude a larger 3-1/2 acre site located soutrr of Adams between Delaware and Huntington Streets within the boundaries of the Specific Plan, and therefore, was not completely satisfied with the proposed ordinance. He also felt that inasmuch as the Specific Plan was amended in part at Planning Commission hearing, the matter should have been continued for renotification of property owners. Commissioner Shea stated she felt that the majority of people within the Oldtown Area were not in favor of the proposed plan, and for that reason voted against it. Commissioner Slates questioned the need of repealing the existing alter- native residential suffix zone because it applied to other areas outside the Oldtown and further expressed his opposition to the Plan with the feeling that the proposal would not remedy the problem of construction of repetitive four-plex apartments in the area. He further stated he was opposed to zone change by code amendment. This information has been transmitted in the City Administrator' s communi- cations because the Planning Commission meeting to review the Council' s request was subsequent to the deadline for Council packet information. BOX 190.9264E TO: Planning Commission FROM: Environmental Review Board DATE: March 4 , 1975 SUBJECT: EIR 74-7 (Townlot Assessment District No. 73-01) APPLICANT: City of Huntington Beach BACKGROUND: EIR Number 74•-7 was prepared by the Department of Environmental Resources.. The EIR analyzes the environmental effects of a Specific Plan that encompasses 58 acres of land in the northwest corner of what is referred to as the Townlot District of Hunting- ton Beach. The improvements to be constructed in this assess- ment district; bounded by Goldenwest, 17th Street, Palm, and Orange, are as follows: 1. Replacement of streets and curbing; 2. Installation of parking court/cul-de-sac street ends; 3. Installation of sidewalks; 4 . Undergrounding of street lights and utility systems; 5. Landscaping; 6. . Installation of storm drain system. The Public Hearing for the draft EIR was held before the Environ- mental Review Board on February 18 , 1975. All comments received as a result of this process have been addressed in the addendum to the draft. The draft Environmental Impact Report., plus the adden- dum, constitutes the final .EIR. RECOMMENDATION: The mitigation measures set forth in the EIR are adequate and ac- ceptable to the Environmental Review Board. In addition, the Environmental Council suggests that the siltation basin proposed for the 22nd Street storm drain is a very necessary condition to mitigate problems presented to beachgoers by surface runoff that will empty into the ocean. They also recommend that when construc- tion of the project commences streets in the area should be kept clean to minimize dust and untidiness presented by grading and earth moving processes. w Planning Commission - EIR 74-7 March 4, 1975 Page 2 ADOPTION: EIR 74-7 for the Townlot Assessment District was adopted by the Environmental Review Board on March 4 , 1975. This articZe is intended to provide deveZopment standards that reasonabZy relate site size to the intensity of residentiaZ deveZopment, soZve existing parking problems, estabZish proper buiZding bulk and site size relationships, and generaZZy implement the goals and objectives of the GeneraZ PZan of the City of Huntington Beach. It is recognized that when a full bZock (twenty-eight (28) twenty-five (25) foot Zots) or one-haZf (Z/2) bZock (fourteen (Z4) twenty-five (25) foot Zots) is con- soZidated that deveZopment standards based on increments of twenty-five (25) feet of street frontage may not aZZow for maximum design fZexibility. Therefore, when a full or one-haZf (Z/2) block is consoZidated, an appZicant may appZy for a use permit pursuant to the provisions of Article 98Z. Approval of such use permit shaZZ be contingent with the deveZoper 's compZi- ance with aZZ the criteria contained in the current standards for apartment deveZopment (ArticZe 932) or pZanned residentiaZ deveZopment (ArticZe 93Z) except that deveZopment intensity (Section 9365. 3) and parking (Section 9365. 7) provisions of this Specific PZan articZe shaZZ prevaiZ. 3. 9362. 4. USES PERMITTED. MEDIUM DENSITY RESIDENTIAL. Permitted uses are single-family dwellings, duplexes, triplexes, other multiple dwelling structures, multiple dwelling groupings, and the customary accessory uses and structures. RECREATION SPACE DIMENSIONS. Any recreation space provided in accordance with Section 9362. 6 shall have a minimum dimension of twelve (Z2) feet. 9362. 8. FRONT YARD SETBACK. The minimum front yard setback for all main and accessory structures shall be ten (ZO) feet. However, said setback may be reduced to six (6) feet for any lot provided:_ (a) The six (6) foot setback is on fifty (50) percent or less of the total building width; and 4. (b) An average ten (ZO) foot setback is maintained for the totaZ building width. 9362. 9. REAR YARD SETBACK. Rear yards for aZZ main and accessory structures shaZZ have a minimum setback of eight (8) feet measured from the rear property Zine; except where the front yard setback is ten and one-haZf (ZO Z/2) feet, the minimum rear yard setback shaZZ be seven and one-haZf (7 Z/2) feet from the rear property Zine. 9362. ZO. SIDE YARD SETBACK. The setbacks of both side yards for aZZ main and accessory structures shaZZ not be less than fifteen (Z5) percent of the site width. Such setbacks shaZZ be aZZocated between the side yards subject to the foZZow- ing: (a) A minimum of five (5) feet must be provided on both side yards except that the setback may be reduced to zero for fifty (50) percent of the buiZding Zength aZong one side yard. If zero side yard is used, it must be within the rear seventy- five (75) percent of the Zot depth. (b) The side yard area reduced by the above procedure must be made up eZsewhere in either side yard. (c) Side yards abutting an arteriaZ street shaZZ maintain a minimum setback of ten (ZO) feet. (d) Side yards abutting a ZocaZ street shaZZ maintain a minimum setback of eight (8) feet. (e) The totaZ side yard setback for a site with only twenty-five (25) feet of site frontage shaZZ be a minimum of six (6) feet and may be apportioned as desired, provided a mini- mum separation of five (5) feet is maintained between adjacent structures. Except that the side yard setback may be reduced to zero on one side of the site where (Z) the abutting site is heZd under the same ownership at the time of initial construction; or (2) the owners of abutting properties record an agreement or deed restriction and consent in writing to such zero setback and a minimum separation of four (4) feet between structures. Where one side yard setback is zero, the opposite side yard shaZZ be a minimum of four (4) feet. (f) The side yard setback abutting an arteriaZ or ZocaZ street for a site with only twenty--five (25) feet of site frontage shaZZ be a minimum of five (5) feet. 5. 9362. ZZ. PARKING. (a) Each bachelor, single, or one bedroom unit shaZZ be provided with not Less than one parking space. (b) Each two (2) bedroom dwelling shaZZ be provided with not Less than one and one-half (Z Z/2) parking spaces. (c) Each three (3) or more bedroom dwelling shall be pro- vided with not Less than two (2) parking spaces. (d) Each dwelling shall be provided with not less than one-half (Z/2) guest parking space. (e) Each dwelling shaZZ have a minimum of one (Z) garage Located on site. ALL other required parking may be Located off site within the specific plan boundaries. 9362. Z2. MINIMUM SITE AREA. The minimum net site area shaZZ be 2, 875 square feet. 9362. Z3. MINIMUM SITE WIDTH AND FRONTAGE. The minimum site frontage and width shall be twenty-five (25) feet. 9362. Z4. BUILDING HEIGHT. The maximum building height for all main buildings shall be thirty (30) feet. The maximum building height for accessory buildings and garages shaZZ be fifteen (Z5) feet. 9362. Z5. AREA OF ACCESSORY BUILDINGS AND GARAGES. The total aggregate floor area of all accessory buildings and garages shaZZ not exceed five hundred (500) square feet per dwelling. Accessory buildings and garages shaLZ not be con- structed on any site which does not have a main structure meeting the requirements of this article. 9362. Z6. LANDSCAPING. ALL Livability space, setback areas, and recreation space shaZZ be Landscaped and permanently maintained in an attractive manner. Such Landscaping shaZZ primarily consist of ground cover, ferns, trees, shrubs, and other Living plants. A minimum of one (L) thirty (30) inch box tree or minimum of one (Z) twenty-four (24) inch box tree and two (2) fifteen (Z5) gallon trees, or four (4) fifteen (45) gallon trees shaZZ be provided for each dwelling. Decorative design elements such as fountains, pools, benches, sculptures, planters, and similar elements may be permitted provided such elements are incorporated as an integral part of the Landscaping plan. A Landscaping plan shaZZ be submitted that indicates the spacing, sizes and specific types of Landscaping materials, and 6. shall be submitted for approval by the Board of Zoning Adjustments prior to issuance of a building permit. Permanent sprinkler facilities shaZZ be provided in all landscaped areas. 9362. Z7. TRASH ENCLOSURES. Areas shall be provided on site for trash, refuse, or other discarded materials. Such trash areas shaZZ have an enclosure of sufficient height, equipped with a gate, to screen trash receptacles from view. All such trash areas shall be constructed of materials and in a manner which blends with the architecture and aesthetics of the main structure. 9362. Z8. ARCHITECTURAL FEATURES. Architectural features, including eaves and fireplaces, may project to within thirty (30) inches of the side site line and four (4) feet into the required front and rear yards, provided such features main- tain a minimum distance of five (5) feet from any portion of any other building on the same site. In addition, an eave return may project to within eighteen (Z8) inches of the side site line for a distance of twelve (42) feet. Said twelve (Z2) feet shall be measured from the beginning of the eave return at the front of the house. All eaves shaZZ set back thirty (30) inches when over windows. This provision does not allow other architectural features to encroach closer than thirty (30) inches to any property line. 9362. Z9. MINIMUM TURNING RADIUS FOR REQUIRED PARKING SPACES. Every private garage, carport, or open parking space entered directly from an alley or drive shaZZ be provided with a minimum turning radius of twenty-seven (27) feet. The turning radius shaZZ be measured from the portion of the door, doorway, or parking space nearest to the opposite side of the aZZey or drive. 9362. 20. LOTS ABUTTING ARTERIAL HIGHWAYS. When a site abuts upon an arterial highway and an alley or local street, the only access to any garage, carport, or parking space shaZZ be from such abutting alley or local street, and not from an arterial highway. When a site abuts two arterial highways, access shall be subject to review and approval by the Director of Public Works. 9362. 2Z. FENCES, WALLS OR HEDGES. Fences, waZZs or hedges which are not over six (6) feet in height may be located on any portion of the site except the front and rear yard setbacks as required in Sections 9362. 8 and 9362. 9 subject to the follow- ing limitations: (a) Corner site. Fences or walls which do not exceed six (6) feet in height may be erected in the exterior side yard of 7. a corner site provided they are not cZoser than twenty-five (25) feet to the front property Zine. (b) Street intersection. Within a triangular area formed by measuring twenty-five (25) feet along the front and twenty- five (25) feet aZong the exterior side Zot Zines of the corner site, there shaZZ be unobstructed vision between forty-two (42) inches above grade to and including seven (7) feet above grade. (c) Corner site abutting an aZZey. Within a triangular area formed by measuring ten (ZO) feet aZong an aZZey and exterior side site Zines, there shaZZ be no structure, fence, waZZ, hedge, or Zandscaping or structure erected or maintained over forty-two (42) inches in height. (d) Height measurement of fence or waZZ. Where a retain- ing waZZ is combined with a fence, no portion of the retaining waZZ wiZZ be measured in meeting fence height. Any combination of retaining waZZ and fence over eight (8) feet high must be built with a variation in design or materiaZ between retaining portion and fence. 9362. 22. APPEARANCE STANDARDS. In order to retain and strengthen the unity and order .of the surroundings, and to insure that structures enhance their sites and are harmonious with the highest standards of improvements in the TownZot Area and the community, the foZZowing standards shaZZ apply: (a) ArchitecturaZ features and generaZ appearance of the proposed deveZopment shaZZ not impair the orderZy and harmonious deveZopment of the area, the occupancy thereof, or the community as a whole. (b) ArchitecturaZ features, incZuding materials, coZors, and variations in setback shaZZ be incZuded in the design of aZZ verticaZ exterior surfaces of the buildings in order to create an interesting, aestheticaZZy pleasing project when viewed from outside the project as weZZ as within. (c) ArchitecturaZ features, including materials, coZors, and variations in setback, as weZZ as Zandscaping eZements, incZuding trees, shrubs, and ground cover, ' shaZZ be incZuded in the design of aZZey eZevation and setbacks in order to create an interesting and aestheticaZZy pleasing appearance from the rear entrance of the project and aZZeys. 9362. 23. ADMINISTRATIVE REVIEW. All uses in the TownZot Specific Plan Area Two shaZZ be subject to approval of an administrative review appZication before the Board of Zoning Adjustments unless a use permit appZication is required. The 8. s foZZowing criteria shaZZ serve as guidelines for the Board in approving, conditionaZZy approving, or denying such appZications: (a) Relationship of the structure to the site, incZuding setbacks and site planning. (b) Compatibility of structures with surroundings. (c) ReZationships of the Zivability space to the dwellings. (d) Landscaping. (e) ReZationship of parking and vehicular and pedestrian circulation areas. SECTION 2. This ordinance shall take effect thirty days after its adoption. The City Clerk shall certify to the passage of this ordinance and cause same to be published within fifteen days after adoption in the Huntington Beach News , a weekly newspaper of general circulation, printed and published in Huntington Beach, California. Precisely, the specific plan area includes the real property described as : Block 417, Lots 1-28; Blocks 420-422, Lots 1-28; Blocks 517-522, Lots 1-28; Blocks 617-622, Lots 1-28, Seventeenth Street Section as recorded in Miscellaneous Maps of Orange County, Book 4, page 10. In addition, all public rights of way within Assessment District No. 73-01 are included. 9362. DEFINITIONS. For the purposes of this article, the following words and phrases shall have the meanings hereinafter set forth: (a) Arterial shall mean any street , highway or road having been designated as an arterial on the Master Plan of Arterial Streets and Highways . Arterials have a minimum right of way of eighty (80) feet. (b ) Dwelling unit shall mean a single unit providing complete, independent living facilities for one or more persons including permanent provisions for living, sleeping, eating, cooking, and sanitation. (c) Floor area shall mean the area of the several floors of a structure or structures measured from the exterior faces of the exterior walls, or from the centerline of walls separating two buildings. All stairways and corridors are included as part of the floor area. Attics, garages, parking structures , or decks are not included as floor area. (d) Livability space shall mean the site area minus the site coverage and minus the area of the site devoted to garages or parking structures and driveways and other open parking areas. Generally, livability space is that portion of the site set aside for walks, gardens, landscaped areas, private patios, lawns, and active and/or passive recreation areas, located on the ground level- (e ) Local street shall mean a low speed, low volume high- way primarily for access to residential, business or other abutting property. (f) Site coverage shall mean the area of the site covered by roofed structures measured from the exterior faces of the exterior walls or from the centerline of walls separating two buildings . All stairways , balcony projections, covered patios and interior corridors shall be included. Areas allotted to garages or parking structures are not included. 2. (g) Site frontage shall mean the smallest dimension of the site adjacent to a public street . (h) Recreation space shall mean the portion of the required livability space exclusively set aside as common active or passive recreation areas . 9362.1. PRIVATE LAND DEVELOPMENT. The following general land use designations are established: (a) Medium density residential; and (b ) Recreation center. The designation, location, and boundaries of these uses are delineated upon the plan entitled, "Townlot Specific Plan Area Two. " The above general land use classifications corre- spond to the land' use designations included in the Land Use Element of the General Plan of the City of Huntington Beach. Wherever a building or structure is erected, reconstructed, or structurally altered in the specific plan area, all applicable sections of the Huntington Beach Ordinance Code shall apply unless in conflict with the provisions of this article, in which case the provisions of this article shall take precedence. 9362,2, PUBLIC RIGHTS OF WAY. All improvements to be made in the public rights of way shall conform to final plans developed for Assessment District No. 73-01. 9362. 3, TOWNLOT SPECIFIC PLAN DEVELOPMENT STANDARDS. Said twelve (12) feet shall be measured from the beginning of the eave return at the front of the house. All eaves shall set back thirty (30) inches when over windows . This provision does not allow other architectural features to encroach closer than thirty (30) inches to any property line. 9362. 19. MINIMUM TURNING RADIUS FOR REQUIRED PARKING SPACES. Every private garage, carport , or open parking space entered directly from an alley or drive shall be provided with a minimum turning radius of twenty-seven (27) feet . The turning radius shall be measured from the portion of the door, doorway, or parking space nearest to the opposite side of the alley or drive. 9362.20. LOTS ABUTTING ARTERIAL HIGHWAYS . When a site abuts upon an arterial highway and an alley or local street, the only access to any garage, carport, or parking space shall be from such abutting alley or local street, and not from an arterial highway... When a site abuts two arterial highways , access shall be subject to review and approval by the Director of Public Works. 9362. 21. FENCES, WALLS OR HEDGES. Fences, walls or hedges which are not over six (6) feet in height may be located on any portion of the site except the front and rear yard setbacks as required in Sections 9362. 8 and 9362. 9 subject to the follow- ing limitations: (a) Corner site. Fences or walls which do not exceed six (6) feet in height may be erected in the exterior side yard of 7. a corner site provided they are not closer than twenty-five (25 ) feet to the front property line. (b) Street intersection. Within a triangular area formed by measuring twenty-five (25) feet along the front and twenty- five (25) feet along the exterior side lot lines of the corner site, there shall be unobstructed vision between forty-two (42) inches above grade to and including seven (7) feet above grade. (c) Corner site abuttin an alley. Within a triangular area formed by measuring ten 10 feet along an alley and exterior side site lines, there shall be no structure, fence, wall, hedge, or landscaping or structure erected or maintained over forty-two (42) inches in height. (d) Height measurement of fence or wall. Where a retain- ing wall is combined with a fence, no portion of the retaining wall will be measured in meeting fence height. Any combination of retaining wall and fence over eight (8) feet high must be built with a variation in design or material between retaining portion and fence. 9362.22. APPEARANCE STANDARDS. In order to retain and strengthen the unity and order of the surroundings , and to insure that structures enhance their sites and are harmonious with the highest standards of improvements in the Townlot Area and the community, the following standards shall apply: (a) Architectural features and general appearance of the proposed development shall not impair the orderly and harmonious development of the area, the occupancy thereof, or the community as a whole. (b ) Architectural features, including materials, colors , and variations in setback shall be included in the design of all vertical exterior surfaces of the buildings in order to create, an interesting, aesthetically pleasing project when viewed from outside the project as well as within. (c) Architectural features, including materials , colors, and variations in setback, as well as landscaping elements, including trees, shrubs , and ground cover, shall be included in the design of alley elevation and setbacks in order to create an interesting and aesthetically pleasing appearance from the rear entrance of the project and alleys. 9362. 23. ADMINISTRATIVE REVIEW. All uses in the Townlot Specific Plan Area Two shall be subject to approval of an administrative review application before the Board of Zoning Adjustments unless a use permit application is required. The 8. following criteria shall serve as guidelines for the Board in approving, conditionally approving, or denying such applications : (a) Relationship of the structure to the site, including setbacks and site planning. (b ) Compatibility of structures with surroundings. (c ) Relationships of the livability space to the dwellings . (d) Landscaping. (e) Relationship of parking and vehicular and pedestrian circulation areas. SECTION 2. This ordinance shall take effect thirty days after its adoption. The City Clerk shall certify to the passage of this ordinance and cause same to be published within fifteen days after adoption in the Huntington Beach News , a weekly newspaper of general circulation, printed and published in Huntington Beach, California.
