RE: Code Amendment No. 75-8
"Revisions to Miscellaneous Lots" .
Attached is Code Amendment No. 75-8 , a proposed amendment which will
modify the procedures for allowing overhead utilities and temporary
Christmas tree sales lots. Specifically, the requirement for approval
of an administrative review application by the Board of Zoning Adjust-
ments has been eliminated. Instead it is proposed that the Director
of Building and Community Development may approve the installat;_on of
overhead utilities and Christmas Tree sales lots subject to the criteria
contained in the amendment.
The proposed amendment was approved by the Planning Commission at its
meeting of October 7 , 1975 by a unanimous vote.
ENVIRONMENTAL STATUS :
The amendment was declared to be a Class II Categorical Exemption under
the guidelines of the California Environmental Quality Act-, 1970.
RECOMMENDATION:
The Planning Commission recommends approval of Code Amendment No. 75-8 .

AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH
AMENDING THE HUNTINGTON BEACH ORDINANCE CODE
BY REPEALING SECTIONS 9730. 9 AND 9730. 10 THEREOF
AMENDING SECTION 9730. 16 THEREOF, AND ADDING
SECTION 9730. 9 THERETO
The City Council of the City of Huntington Beach does
ordain as follows :
SECTION 1. The Huntington Beach Ordinance Code is hereby
amended by repealing Sections9730. 9 and 9730.10 thereof.
SECTION 2. The Huntington Beach Ordinance Code is hereby
amended by amending Section 9730. 16 to read as follows :
9730.16 . CHRISTMAS TREE SALES LOTS. Christmas tree sales
lotsfaay-fie are permitted in any district as a temporary use
subject to approvals -a -ade �ae-�ee�a-a��� eae .by

(a) Storage and display of trees shall be set back not
Zess than ten (10 ) feet from the edge of the street pavement ,
and in no case shall encroach on the public right of way.
(b) Said use incZuding aZZ surplus trees, utility poles,
temporary structures, signs, trash, etc. , shall be completely
removedand from the sitereeteped by January 3 ofeaeh the foZZom-
ing year.
(c ) ARyTemporary shelters shall be constructed according
to Building Department standards .

(g) Prior to issuance of the business license on sites
that are not deveZoped or improved, ague Five Hundred Dollar
($1500) cash bond shall be posted with the Building Department
to insure removal of any structure and cZeaning of the site
upon termination of the temporary use, and to guarantee main-
tenance of the property.
SECTION 3. The Huntington Beach Ordinance Code is hereby
amended by adding thereto Section 9730. 9 entitled "Overhead
Installation, " to read as follows :
9730. 9. OVERHEAD INSTALLATION. InstaZlation of overhead
utility Zines may be permitted by the Director of BuiZding. and
Community DeveZopment for the foZZowing:
(a) Relocation and/or the increase of size of service on
a Zot when it does not necessitate any increase in the number
of existing overhead Zines and/or utility poles;
(b) Any new service when utility poles exist along abutting
property Zines prior to February Z5, Z967, and which are not
separated by any aZZey or public right-.of-way and no additionaZ
utility poles are required;
(c) Temporary uses, incZuding directionaZ signs, temporary
stands, construction poles, water pumps, and similar uses;
(d) OiZ weZZ services.
SECTION 4. The provisions of this ordinance insofar as
they are substantially the same as existing provisions of the
Huntington Beach Ordinance Code relating to the same subject
matter shall be construed as restatements and continuations and
not as new enactments .
SECTION 5. This ordinance shall take effect thirty days
after its adoption. The City Clerk shall certify to the passage
of this ordinance and cause same to be published within fifteen
days after adoption in the Huntington Beach News , a weekly news-
paper of general circulation, printed and published in Huntington
Beach, California.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting thereof held on the 3rd
day of November, 1975 .
