These ordinances have been prepared pursuant to City Council direction which resulted from several discussions between the Council and City Staff on the status of existing horse stables in the City of Huntington Beach. Code Amendment No. 75-10"B" is an ordinance which. will provide the procedure and standards for the development of temporary horse stables. Code Amendment No. 75-10"A" is a miscellaneous revision to the existing commercial horse ordinance which will provide for permanent horse facilities and will also provide for similar wording and organization as that contained in Code Amendment No. 75-10"B" . The Planning Commission, after discussing the proposal at numerous B study sessions, approved the proposed ordinances at its meeting of January 20, 1976 by a unanimous vote. Subsequent to the approval, a written request was filed by a group of horse owners requesting a reconsideration by the Planning Commission in order to allow further review and input by this citizen group. The Commission concurred with this request and by the following motion and vote have requested the City Council to continue their scheduled public hearing on the matter to February 17 , 1976 . The Council concurred with the Planning Commission' s recommendation. As a means of expediting and providing as full a review as possible , _ the Planning Staff and Planning Commission Subcommittee met several times with the Horse Users Committee and analyzed all of the proposed standards. As a! result of these meetings a number of minor revisions and points of clarification were recommended to the Planning Commission by the subcommittee and staff. These included the following revisions to Code Amendment No. 75-10"B" : 1. Sec. 9391 Uses Permitted: "horse convalescent stables" was deleted as a specific use under the horse facilities ordinances because it was determined that this type of horse use was sufficiently specialized to warrant its exclusion from the general development standards. Instead horse convalescent uses will be processed as an unclassified use in Article 933 : Animal Hospitals. -Page Two 2 . Sec. 9392 . 2 Minimum Frontage: The minimum frontage requirement was recommended to be modified to apply only where a horse stable use abuts a public street or highway. It was felt that the nature of the use would allow for use of interior parcels without necessarily mandating street frontage. 3 . Sec. 9392 . 4 Yard Requirements: The 300 foot setback was recommended to be modified to provide a minimum distance from a residential structure on property zoned and general planned residential, rather than strictly from the property line. 4 . Sec. 9392. 7 (a) Landscaping: The Commission recommended that the 10 foot wide planter area be modified to 6 feet in order to be consistent with other commercial property development standards. 5. Sec. 9391. 2 Time Limit: It was recommended that the initial approval period be modified to reflect five (5) years instead of three (3) , with an annual review of all approved horse stables. 6. Sec. 9392 . 5 (b) Yard Setback Requirements: The interior and rear yard setbacks were recommended to be reduced to 20 feet instead of 25 feet for temporary horse stables. This is consistent with the consolidation of the landscaped areas and the desired emergency access widths. 7 . Sec. 9393. 1 Corrals, Racks, and Stalls : The staff is recommending that the mandatory non-combustible, construction be incorporated into the general fire protection systems. This deletion provides for more flexibility in the overall fire protection systems. 8. Sec. 9393. 4 Wash Racks: It was recommended that provisions for multiple wash racks be incorporated provided that all requirements are multiplied by the number of horses that can be washed at any one time. 9. Sec. 9395 (2) Rodent Control: The Commission clarified this provision by indicating that the 50 foot setback applies only to commercial or bulk amounts of grain or hay. These revisions were incorporated into the proposed ordinance and ap- proved by the Commission on February 3 , 1976 . It should be noted that where applicable, these revisions were incorporated into Code Amendment No. 75-10"A ADDITIONAL INFORMATION: During the public hearing on the reconsideration of the proposed amendments, Mr. Michael Springer, a spokesman for the Horse Users Committee, addressed the Commission and expressed concern over the necessity of a 300 foot setback from dwelling units located on properties zoned and general planned residential. It should be Page Three noted that this concern was discussed at the Committee meetings with the Planning Commission Subcommittee recommending that the 300 foot setback should be measured from the actual dwelling structure and not from the property line as was originally proposed. Mr. Bruce Greer, an adjoining property owner, addressed the Commission expressing his concerns over the inadequacy of the 300 foot setback proposal, specifically the fact that it does not address non-conforming residential uses.
