Statement of Issue, Recommendation, Analysis, Funding Source, Alternative Actions:
STATEMENT OF ISSUE:
Transmitted for consideration is Code Amendment No. 80-1, a Code
Amendment amending Articles 931, 936, and the Definition Section
of Division 9 to incorporate provisions to govern conversions of
existing developments to condominiums, . community apartments, and
stock cooperatives types of development.
RECOMMENDATION:
The Planning Commission and Planning Staff recommend that .the:' City
Council approve Code Amendment No. 80-1 and adopt the attached
ordinance.
ANALYSIS:
Applicant: Initiated by direction of the City Council
Location: Citywide
Request: Incorporate provisions for all types of condominium
conversions of existing apartment developments into
the existing planned residential ordinances.

DISCUSSION:
This Code Amendment was prepared by the Department of Development
Services on direction of the City Council in order to amend
Articles 931 and 936 and the Definition Section to incorporate
provisions to govern conversion of existing apartment develop-
ments to condominiums, community apartments, and stock cooper-
atives types of development.
This Ordinance is not intended to be the ultimate Conversion
Ordinance which the staff is also pursuing at this time, but it
is an interim measure to assure that all common ownership develop-
ments are subject to review and proper entitlement by the City
for reasonable development standard.
The staff is presently in the process of preparing a Conversion
Ordinance that will eventually govern conversions of apartments
to condominiums, community apartments, and stock cooperatives.
ENVIRONMENTAL STATUS:
The Environmental Resources Section- of the Department of Development
Services has reviewed this Code Amendment, and pursuant to provisions
of the California Environmental Quality Act of 1970, the Staff has
determined that there is no environmental assessment required for
Code Amendment No. 80-1.
FUNDING SOURCE:
Not applicable.
ALTERNATIVE ACTION:
The City Council may consider denying Code Amendment No. 80-1, which
could leave the City unprotected insofar as existing apartment units
converting to condominiums or stock cooperatives without proper
review and approval by the City.
