The sites have been greatly disturbed due to the golf course and tennis court facilities (which currently occupy parcels A & B) and maintenance facility construction activities (on Parcel C) and do not appear to support any unique or endangered plant or animal species. Some mature trees do border the project sites. However, as previously discussed, under #1 (a-g) , subsequent development under the ROS zoning would be subject to entitlement and additional environmental review. Should any mature trees be removed due to subsequent development, they will be required to be replaced at a 2: 1 ratio pursuant to standard conditions of approval . It should also be noted that permitable uses under the ROS zoning emphasize compatibility with the natural environment and are therefore anticipated to have a minimal impact on any biological resources, should they develop in the area (as compared to the existing multi-family zoning designations) . X Discussion: The proposed project constitutes an alteration to the existing zoning designations on the subject parcels. The proposed zone change if approved, will eliminate the existing multi-family residential zonings and will allow for only recreational uses on the subject sites. However, the subject sites are currently General Planned Recreational Open Space, are primarily occupied by recreational uses and are adjacent to or primarily surrounded by existing recreational uses. Amend . 92-2 , Orange County - SCH 92041010 The California Environmental Quality Act and the California Endangered Species Act require the lead agency to appropriately condition the project and fully implement the statutory DFG-1 mitigation and monitoring requirements to offset adverse impacts to the following resources which may be impacted by this project . 1 . Endangered or threatened species of plants and animals . if the project would result in take , on or off project site , of any State-listed species or habitat essential to its DFG-2 continued existence , the applicant must obtain authorization from the Department of Fish and Game ( DFG) pursuant to Fish and Game Code Section 2081 . 2 . Wetlands . Compliance with the DFG ' s Wetland Policy requires that there should be no net loss of wet-land acreage or wetland habitat values , either on or off project site, due tc project development . A mitigation and monitoring plan DFG- 3 subject to DFG approval should be required for loss of sensitive habitats including, but not necessarily limited to, freshwater marsh , riparian woodland , oak woodland , and riparian scrub vegetation . 3 . Watercourses . The DFG opposes the elimination of watercourses and/or their conversion into subsurface drains . All watercourses , whether intermittent or perennial , must be retained and provided with setback buffers appropriate to preserve the riparian and aquatic habitat values . Earthen channels should be ' interconnected with adjacent large open DFG-4 space areas to increase their effectiveness as wildlife corridors in urban surroundings . The DFG has direct jurisdiction under Fish and Game Code Sections 1601-1603 in regard to any proposed activities that would divert or obstruct the natural flow or change the bed, channel , or bank of any river, stream, or lake. DFG-4 Formal notification (with fee) under Fish and Game Code contle Section 1603 should be made after all other permits and certifications have been obtained . The project sponsor is subject to the user fee provided by Fish and Game Code Section 711 . 4 , and the fee is payable to the County Clerk at the time of or prior to filing the Notice of Determination by the lead agency . If a Negative Declaration is filed , the user fee is $1 , 250 . If an DFG-5 Environmental Impact Report is filed, the fee is $850 . It is our assessment that this project will result in cumulative loss of fish and wildlife resources and is not exempt from the user fee . In conclusion, if your analysis reveals that the above-mentioned concerns have been fully addressed throughout your decision-making process , we would not object to the project approval . Zoning, on the other hand, is a single-purpose, short-range tool for implementing the General Plan. Just as it is important that the General Plan reflect the desires of the community, it is equally important that zoning is consistent with the intent of the General Plan. This is a matter of law as well as reason. Section 65860 (a) of the Government Code stipulates, 'County or City zoning ordinances shall be consistent with the General Plan. . ." Consistency between zoning and the General Plan is not as simple as determining exactly which one zoning classification should implement a specific General Plan land use designation. Several zoning classifications may be consistent with a particular land use designation depending on whether they meet the intent of the General Plan. This relationship is necessary so that zoning can implement very specifically the land uses which appropriately reflect the intended character of an area as delineated in the General Plan. A zone is consistent with the General Plan in any specific application if the zone furthers or possesses a measure or signif icant degree of compatibility with the General Plan policies and programs. Determination of consistency is to be made by reference to the policies and programs of all of the elements of the General Plan. 4.1 Zoning Consistency With the Elements of the General Plan In practice, consistency between a zoning proposal and the General Plan will be determined by considering all of the policies and programs of each element of the General Plan and their relationship to the proposed zoning. If the size criteria therein do not disallow the possibility of a finding of consistency, then a finding of consistency between the zone and the Land Use Element may be made by reference to the locational criteria contained in the Land Use Element. Reference to the size criteria in Figure 3- 15 will not be made when making a finding of consistency in the City's coastal zone. Unlike the Land Use Element policies, the policies of the other elements of the General Plan are not easily or into matrix form. Consequently determination of consistency must be made through a policy by policy analysis of each element. Finding of Consistency A finding of consistency may only be made after analysis of the proposed zoning in terms of all nine elements of the General Plan. A finding of consistency with only one of the elements, such as the Land Use Element, is not sufficient for a finding of consistency with the General Plan.
