BOX 190 CALIFORNIA 92648 TO: Honorable Mayor and FROM: Planning Commission DATE: December 11, 1974 ATTN: David D. Rowlands, RE: Code Amendment No. City Council City Administrator 74-12 -7 0 G Z_ Transmitted herewith is Code Amendment -No. 74-12 the intent of which is to clarify the term permanent open space as it relates to rear yard setbacks in the low density residential district. The clari- fication resulted in the use of the term "open land" rather than "open space" being incorporated into the provisions for rear yard setbacks. That section will thus allow a reduction of the rear yard requirement from 10 to 5 feet on lots abutting open land. Open land includes golf courses, schools, and public utility right-of-ways that provide a minimum of 100 feet in clear width. In addition, the amendment makes deletions of words and phrases which caused confusion and lack of clarity in the provisions.for the rear yard setbacks. The Planning Commission at its meeting of November 19, 1974 approved the code amendment by a unanimous vote. The amendment is exempt from the requirements of the California Environmental Quality Act, 1970.' RECOMMENDATION: The Planning Commission recommends approval of Code Amendment No. 74-12.
