Statement of Issue:
There is a need to modify Resolution 2002-129 relating to the park fees pursuant to 230.20 of
the Huntington Beach Zoning and Subdivision Ordinance. The modification is administrative
in nature and makes no change to the current amount of fees collected.
Funding Source: Not Applicable.
Recommended Action:

Huntington Beach Zoning and Subdivision Ordinance.
Alternative Action(s):
Do not modify Resolution No. 2002-129 and direct staff accordingly.

Analysis:
Resolution 2002-120 specifies that the fees collected pursuant to Section 230.20 of the
Zoning and Subdivision Ordinance (Park Fees) would be used for financing park and
recreation facilities and improvements that are identified in the "Park Development and
Rehabilitation Capital Improvement Plan" as adopted by the City Council on an annual basis
(Attachment 1, Paragraph 2).
In reviewing this administrative process, it has been determined that the Park Development
and Rehabilitation Capital Improvement Plan is not a single document, but a combination of
two documents, including the city's Capital Improvement Program (CIP) list compiled and
submitted to the City Council by Public Works staff, as well as the Park Acquisition and
Development (PAD) budget, both approved by the City Council on an annual basis.
In order to better define the administrative documentation process for approved Park Fee
projects, the attached updated resolution is being recommended for adoption. Language in
the proposed resolution deletes the reference to the Park Development and Rehabilitation
Capital Improvement Plan and includes the "City's capital improvement program and the
Park Acquisition and Development budget as approved each fiscal year by the City Councif'
(Attachment 1, Item 1). Approval of this modification will ensure that projects that may not
be included on the CIP list submitted by Public Works (which historically focuses on
construction projects), but are eligible park and recreational facility improvements per State
law meet all reporting requirements. Examples of park improvements that would not typically
appear on the CIP list submitted by Public Works include land acquisition, needs assessment
and/or design activities, unforeseen repair and rehabilitation of existing park facilities, and
Youth Sports Grants.
As delineated in Attachment 1, Item 2, all other portions of Resolution No. 2002-129 will
remain in force and effect.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF HUNTINGTON BEACH MODIFYING THE PERMITTED USES OF FEES COLLECTED
PURSUANT TO SECTION 230.20 OF THE HUNTINGTON BEACH
ZONING AND SUBDIVISION ORDINANCE
WHEREAS, on December 16, 2002 the City Council of the City of Huntington Beach adopted
Resolution 2002-129 entitled "A Resolution of the City Council of the City of Council of the City of
Huntington Beach Relating to the Payment of Park Fees Pursuant to 230.20 of the Huntington Beach
Zoning and Subdivision Ordinance;" and
Resolution 2002-129 specified that the fees collected pursuant to Section 230.20 of the Zoning and
Subdivision Ordinance ("Park Fees") would be used for financing park and recreation facilities and
improvements that are identified in the "Park Development and Rehabilitation Capital Improvement Plan"
as adopted by City Council on an annual basis; and
State law requires that Park Fees collected by the City be used to fund park and recreational
facilities and there are many eligible park development programs and projects that are not included in the
Capital Improvement Projects list approved by City Council each fiscal year,
The City Council of the City of Huntington Beach does hereby find, resolve and determine as
follows:
1. That Park Fees collected by the City pursuant to Section 230.20 of the Zoning and
Subdivision Code shall be used to finance the park and recreational facilities and improvements included
in the City's capital improvement program and identified in the Park Acquisition and Development
Budget as approved each fiscal year by the City Council.
2. Except as changed herein by this Resolution, all portions of Resolution No. 2002-129 shall
remain in force and effect.
PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a regular
meeting thereof held on the 1 5thday of November ,200 4 .
