George Farquhar, being duly sworn on oath, says: That he is a
citizen of the United States, over the age of twenty-one years.
That he is the printer and publisher of the Huntington Beach
News, a weekly newspaper of general circulation printed and pub-
lished in Huntington Beach, California and circulated in the said IJ
County of Orange and elsewhere and published for the dissemination
of local and other news of a general character, and has a bona fide
subscription list of paying subscribers, and said paper has been
established, printed and published in the State of California, and
County of Orange, for at least one year next before the publication

NOTICE IS HEREBY GIVEN that a public hearing will be held
by the City Planning Commission of the City of Huntington Beach,
California, for the purpose of considering Code Amendment .
No. 74-7 generally referred to as "Retail Nurseries - Unclassified
Uses" . - The intent of the proposed code amendment is to
provide for retail nurseries in areas in addition to the
. commercial districts , however such uses would be subject to
a conditional use permit.
Said hearing will be held at the hour of 7:'00 P .M. , on
August 61 1974 , in the Council Chamber Building of
the Civic Center , 2000 Main Street , Huntington Beach, California.

If approval has been recommended, the City Council will be required to
hold a public hearing on this matter. Although there is a 10 day appeal
period, we suggest that the matter be set for the earliest possible City
Council meeting, because the purpose of any appeal is to have a hearing
before the City Council and this is already being accomplished. We
further suggest that you not accept any appeal, as it will serve no purpose.
If approval has been recommended other than as requested, the City Council
will be required to hold a public hearing on this matter. However, there
is a possibility that the Planning Commission's decision will be appealed;
therefore, we suggest that publication be held off until the 10 day
appeal period has expired.
If denial has been recommended, the City Council may summarily deny the
request. However, we suggest that the matter not be scheduled on the
City Council agenda until the 10 day appeal period has expired.

RE: CODE AMENDMENT NO. 74-7
Transmitted herewith is .a copy of Code Amendment No. 74-7 . The intent
of said Amendment ,is -to ,provide for retail nurseries as an unclassified
use, which will allow their •inalusion in areas in addition to the
commercial districts. As unclassified uses, the retail nurseries will
require a Conditional Use Permit, however retail nurseries in the
commercial districts, as well as wholesale nurseries in the RA
(Residential Agriculture) and ,Al (Agricultural District) are not subject
to the Conditional Use Permit process.
The Planning Commission considered .the proposed amendment at its meet-
ing of August 6, 1974, and after discussions with the Planning staff,
unanimously approved Code Amendment No. 74-7, and recommends approval
by your Honorable Body.
The Environmental Review Board, at its meeting of, July 16, 1974 , granted
the Code Amendment Exemption Declaration No. 74-95, having found that
the proposed project will not have a significant adverse effect upon
the physical environment. It was the consensus of the Board that the
retail operation as proposed by the Code Amendment would be less
environmentally offensive than that of a wholesale operation.
The State Planning Act requires that a public hearing be held, after
which the Code Amendment -may be adopted by Ordinance.

SUBJECT: Exemption Declaration No. 74-95 (CA 74-7)
The Environmental Review Board, at its meeting of July 16, 1974,
granted the above exemption declaration, having found that the
proposed project will not have a significant adverse effect upon
the physical environment.
No environmental impact report has been prepared for this project,
and the Negative Declaration issued for the project has been
properly posted in the office of the City Clerk.
These findings are based on information contained in the Exemp-
tion Declaration request.
Additional Information:
The Board had received a letter of protest regarding this appli-
cation: Following is the Board' s discussion on the letter filed:
The Board reviewed the difference between, retail and
wholesale nursery operation. It was the consensus that
the retail operation as. proposed :by. the Code Amendment
would be less environmentally offensive that the whole-
sale operation, as such uses would:
1. Not require the types .and quantities of chemicals, in-
secticides, and fertilizers normally used at wholesale
operations
2. Under the formal applications to permit the retail uses,
the city would require . parking to serve the use to al-
leviate traffic problems
3 . The permit would also require storage facilities and
screening walls to aesthetically improve the site.
