ATTN: DOYLE MILLER, City Administrator. RE: CODE AMENDMENT NO 66-129 an amendment to Division q of the Huntingtpjq,_Beach Ordinance Code. Gentlemen: Transmitted herewith is a proposed amendment to Division 9 of the Huntington Beach Ordinance Code. Said amendment proposes to require right-of-way dedication and improvements to all -uses -abutting on any highway, street or alley. The Planning Commission unanimously approved this matter on June 21, 1966, and recommends adoption by your Honorable Body. The Code provides that a public hearing shall be held on the matter after which an ordinance may be adopted effecting the change. Respectfully P mitted, K.A. Reynolds Planning Director and Secretary KAR/j Encl: Code Amendment No 66-12 PLIEWC HEARING SET FOR: ... 9t4e ---J.UL -------- 5 --- 19M - - --- ---- Section 1, the following sections of Division 9 of the Huntington Beach Ordinance Code are hereby amended, and as amended, shall read in words and figures as follows: I S. 9730.15 RighLzpf-way Dedication for all Uses Abutting on any Highway.- Street, or Alley. Prior to the issuance of a building permit or prior to the use of any land for any purposes, excluding agricultural uses, the 'highway, street, or alley right-of-way shall be dedicated to or vested in the City of Huntington Beach. Said dedication shall be to a width determined by either of the following, whichever is greater: (1) The current Master Plan of Arterial Streets and Highways. ( 2 ) An approved precise plan of street, highway or alley alignment. (3) Department of Public Works Standards. (4) By Ordinance, 9730.16 Installation of I:tp s for gn_y_qse Abutting _�xjy_jj treet or Alleyo No final inspection shall be made or no Certificate of Occupancy shall be issued by the Building Department until: (1) The required dedication of right-of-way as described in Section 9730.15 has been improved by the installation of curbs, gutters, sidewalks, paving, street trees, street lights, street signs, and street drainage in full compliance with City of Huntington Beach Street Standards, or; (2) Until, with the consent of the Director of Public Works,, an agreement is entered into with the City agreeing to install said im- provements. In the event an agreement for the improvements is entered into, the City Council may require that the agreement be secured by a good and sufficient bond. It may accept, in lieu thereof, a cash deposit, Said bond or cash deposit shall be in the amount equal to the cost of improvements estimated by the Director of Public Works.
