Planning Commission January 19, lg82 Page 3 A. code amendment which establishes a Specific Plan setting forth development criteria for 60+ acres of property located at the south- east corner of Beach Boulevard and Adams Avenue, and a request to change the zoning on the subject property from C2 (Community Busi- ness District) , RA-0 (Residential Agricultural District combined with oil production) , RA-01 (Residential Agricultural District com- bined with oil production) , R1-0 (Low Density Residential combined with oil production) , and R1-01 (Low Density Residential District combined with oil. production) to Seabridge Specific Plan. Also con- sidered was Final Environmental Impact No. 81-1 which assesses tha eni,aronmental effects of the code amendment and the zone change. Jim Barnes introduced Mr . Charles Piicher to the Commission who gave an oral. report of the highlights of the EIR which his company , EDAW, Inc . , prepared . Chairman Winchell opened the public hearing . Frank Mola, the appli- cant, gave a prepared taped presentation of the project. Richard Harlow also spoke in favor of approving the EIR along with the zone change and code amendment . { The following persons spoke in opposition to the certification of the EIR and the approval of the zone change and code amendment: Dan Lispi, Resident John DuVal , Resident Jim Keef, Resident John Corgono, Resident Irwin Haydock, Chairman of Environmental board Mike Molde, Resident The main issues raised in the testimony against approval were as follows: 1 . .Impact of 1600 new residents in the area with 80 (this figure was questioned) elementary school children entering the local school district . It was brought to the attention of the Com- mission that Pederson Elementary School Has recently closed. 2 . Loss of park land and wetland area . 3 , Incompatibility with original Genera? Plan and overall image of the area . Opposition to high density in the area . 4 . objection of the U. S. Department of Fish and 0amea to the adequacy of the: EZR. t`. 5. Who will pay for "open water system"? Possible water waste. 12. Regarding sewerage - if flood control channel is built too high, project will be underwater . 13 . Against removal of existing eucalyptus trees. 14 . Wildlife in the area is threatened . The public hearing was closed. The consensus of the Commissioners was that due to public testimony, 4hey would feel uncomfortable aoout dealing with the applications until more clarification was presented . Also mentioned was burial of the oil lines prior to development. Staff stated that questions of this nature could be dealt with at tbs time of the tentative tract application. TO: Planning Corinission FROMr Department of Development Services DATE: February 2, 1982 SUBJECT : ZONE CHANGE No. 81-15/CODE AMENDMENT NO. 81-16/ENVIRONMENTAL IMPACT REPORT NO. 81-3 (SEABRIDGE SPECIFIC PLAN) On January 19 , 1981 the Planning Commission continued Zone change 81--15, Code Amendment 81-16, and EIR 81-3 pending the submission of additional information supplementing the EIR. Staff has coordinated with EDAW, Inc . to prepare the attached document cupplementing EIR 81--3. The supplement addresses the environmental issues identified by the Planning Commission at its January 19 meeting . Also attached is a revised specific plan document prepared by the appli- cant incorporating the suggested revisions contained in Section 6 . 0 of thn January 19 staff report and a letter from the applicant (dated January 26 , 1982) suggesting options for ensuring that the development concept being proposed is ultimately carried out . In response to the Planning Commission ' s concerns regarding the general intent and function of a Specific Plan , staff has attached secti:jns of the Public Resources Code p-rtaining to b,- cific Plans . In this staff ' s view, what a Specific Plan is and how it lunctions are best described by a comparison with the General Plan. The purpose of the General Plan is to express in general terms the City ' s planning of its future environment . As its name implies, the General. Plan functions as a general blueprint of future development within the City . The General Plan is adopted by the City as a legislative act and may thereafter be ame-nded as required by changing circumstances . The Specific Plan, on the other hand, is a device used to implement the General Plan. In the simplest sense , a Specific Plan is a more detailed version of the General Plan . The Specific Plan focuses on a particular parcel or parcels , articulates the planning con- siderations for such parcels , and imposes regulations or controls on thy:, use of such parcels . The Specific Plan may be adopted and amended by legislative action, and when adopted controls all development within the affected area . The Specific Plan is a bridge between the General Plan and zoning, which serves both a planning function and a regulatory function SUGGESTED ACTION: Staff re-:omnendn that the Planning Commission recommend to the City Council that Final EIR No . 81-3 as amended be certified as being adequate land in Conformance with the California Environmental Quality Act and State 49ft e _ .,2-, A IV�` A•IM-t]a EIR Guidelines . He informed the Commission that the Environmental Board put their comments re- garding the EIR and that copies were distributed to them for their ` perusal . Charles Pilcher from EDAW give a presentation of a supple- mental information packet which was prepared by the firm in answer to questions asked at the last regular meeting. The following areas were addressed : solar access, tra:'Lls systems, secondary ve- hicular access, cumulative traffic analysis, scenic corridor, sewage line capacity, lo;ee height and backwater effects, elevation of resource production areas, energy costs and water consumption, and school district contacts. Commission discussed the above concerns at length. Commissioner Paone stated that he listened to the tape of the public hearing and would be eligible to vote. Chairman Winchell reopened the public hearing asking that the public limit their comments to issues that have not previously been dis- cussed. Speaking against the adequacy of the EIR were Dan Lisby, Steve Olburger, and Mike McDonald . Speaking in favor, was Richard harlow. The public hearing was closed. Commission discussion ensued. Discussed in detail was the gtiestion of accumulative effects of the sewer system. George Tindall, of Public Works, stated that the coast trunk line will more than ade- quately handle the excess. He further stated that any problems occurrirrj mould probably arise from the treatment facilities, however, ' this is an ongoing problem which the County of Orange is well aware of . Discussion took place regarding what determines adequacy or inadequacy of the EIR. Secretary Palin reminded the Commissioners that the EIR is a disclosure document and that specific mitigation measures 'need not be discussed to determine the adequacy of the EIR. -2- 2-2-82 P .C . 44 Minutes, H .H . The applicant, in the attached letter and revised Specific Plan document, has itemized the com- ments expressed by the Planning 4ommission and presented responses to ea,-,h comment. The staff has reviewed the tape of the June 15, 1981 City Council hearing to attempt to clarify .direction given by the City Council regarding density and preservation of the ponding area. In the staff ' s view the Council ' s direction was to permit a maximum of 8100 units on the entire site, with 400 units on each side of the flood control channel . Through testimony, it was understood by the City Council that the existing pond on the site would be re-configurated . After reviewing the applicant 's proposed modifications to the Specific Plan document, staff recommends the following changes : 1 . Page 12 DENSITY STANDARDS. The applicant has introduced provisions for the max mum number of bedrooms per gross acre. Staff recommends that the maximum number of bedrooms allowable per gross acre in Area B be established at 50 bedrooms per acre , which is consistent with R3 District standards . 2 . Page 13 PARKING. The applicant is proposing that the parking standards for efficie`�'�"y units be reduced from 2 spaces per unit (as previously proposed) to 1 . 5 spaces per unit. Staff .recommends that this standard remain at 2 parking spaces per unit. RECOMMENDATION: Staff recommends that the Planning Commission recommend to the City Council that zone Change No. 81-15 and Code Amendment No . 81-16 be adopted by resolution , subject to the findings contained in Section 7. 0 of the January 19, 1982 stafg report and pursuant to revisions J Seabridge Specific Plan February 17 , 1982 Page 2 suggested in the February 10 , 1982 letter submitted by the applicant, . and to the staff recommendations stated above. Research , it was agreed that the City would revise its reponse to comments submitted by the Department of Fish and Game pertaining to the biological assess- ment contained in EIR 81-3. Pursuant to the agreement reached by the agencies present at the February 25 meeating, the following re- vised. response is focused on the Department: of Fish and Game ' s teconmendation that the existing wetland area defined by Coastal salt marsh vegetation on the development site be retained and dev- eloped into a functioning saltwater marsh ecosystem nor, instead of postponing development of the saltwater marsh project until term- ination o f oil extraction . Re:sidential development could then pro- ceed within the oil production areas when the wells are abandoned. Also, Fish and Game believes public access roads leading from Beach Boulevard into Area A on the site should be allowed only if the wetland resource would not be adversely affected. The appliceint is proposing to develop access roads and residential units in a major portion of the existing wetland and to mitigate the loss of this existing coastal marsh habitat by providing replace- msant marsh habitat in an existing oil production area when all oil production activity has ceased. A freshwater marsh adjacent to Beech Boulevard will be developed immediately in the existing pond- ng area and will represent partial compensation for the :immediate less of habitat. FcAllowing are specific factors of overriding importance which in the view of the Department of Development Services make the applicant ' s proposal more acceptable than the alternative proposed by the Department of Fish and Game : 1 . A recent amendment to the State EIR Guidelines , as well, as a number of other environmental protection laws, require that a lead agency consider housing effects along with environmental goals in its evaluation of a project. Fish and Game ' s propcsal would eliminate approximately 150 residential units prcposed for near-term construction in Area B . As stated in the City' s pre- vious response to Fish and Game ' s comments, the Housing Element to the General Plan stresses the current need for in-.-reasing the housing stock. It is likely t at the unit types proposed in Area B will meet current criteria for affordability as defined in the City ' s Housing Element and thus will be consistent with another major goal recently ad.Lpted by the City . 2 . Fish and Game ' s proposal may require relocation of '--he main collector street within the development connecting .Adams Avenue and Beach Boulevard . The main collector street as proposed intersects Adams Avenue and Beach Boulevard at loce.tions which are adjacent to other local streets and are sufficient distances from the Beach/Adams intersection to allow for signalization,. Page 2 0 a Access to Beach :Boulevard under the applicant 's proposal is concentrated at the intersection of Beach Boulevard and Memphis Avenue. This intersection will be signalized to facilitate traffic flow from the project and along Beach Boulevard. The proposal by Fish and Game may preclude this possibility, since the route as presently proposed cuts across the existing wetland . For safety purposes, development on the ;rite would not be allowed to take place with only one major access point. Therefore, an alternative to Fish and Game ' s proposal may require the collector street within Area A to tie in with local public streets in the adjacent single--family area. This would be unacceptable from the Ci.ty ' s standpoint since local streets are not designed to handle traffic generated from the collector: street. Other alter- natives would be to move the collector street west of the channel in a southerly direction or to construct it as proposed and compen- sate for the loss of a portion of the exi-sting wetland. Moving the street in a southerly direction may result in the loss of additional units on the site . The problems associated with enhanc- ing the existing wetland are discussed in Number 3 below. 3 . The applicant ' s proposal to provide funding for creation of a saltwater marsh within the re-,,Durce production area is a part of the mitigation measures which are offered to offset impacts caused by development within the existing wetland. The applicant has not expressed a willingrss to forego near-term development opportunities while at the same time undertaking the expense to develop the existing wetland into a functioning saltwater marsh. As stated in the City ' s previous response, the City has indicated no interest in the site for development as a future park. There is no indication of the availability or source of public funds for enhancement of the existing marsh. Therefore, it is likely that the marsh if preserved in its present location would continue to remain -in a degraded state. From the standpoint of lonq-term productivity, it may be desirable to take advantage of the private financing being offered to establish a new, viable adlt- water marsh which will function as a valuable biological resource in the future . 4 . As the existing wetland is in a degraded state, its visual char- acter would detract from adjacent housing . Also, there is great probability that nearby residents would object to the condition of the site in dry summer months , requiring that weed abatement and dust control measures be taken. A restored marsh in the resource production area would be farther removed from resider - tial development on the site , and thus the potential for intrusion and disturbance from residents of the development would be much less than if the existing wetland is pieserveTd.
