that the City Council approve Code Amendment No 79-1 and approve the attached ordinances ANALYSIS Applicant Planning Commission Request 1 Amend Section 9481 17 1 of the Ordinance Code to eliminate the need for a special sign permit to include price information on the service station major identification sign and to allow ten (10) square feet of additional sign area per space if pricing information is included on the major identi- fication sign 2 Amend Section 9430 5 of the Ordinance Code to allow health centers and health clubs under 2500 square feet as a permitted use in the C2 District 3 THE FOL- LOWING VOTE AYES Higgins, Russell, Stern, Finley, Cohen, Bazil, Paone NOES None ABSENT None ABSTAIN None Discussion Service Station Signs Attached as Figure 1 is the draft ordinance pertaining to service station signs At the Planning Commission' s December 19 , 1978 meeting the Commission directed the staff to initiate the amendment providing for an inclusion of pricing informa- tion on service station major identification signs Section 9481 17 1 of the ordinance code presently permits one major identi- fication containing only the name or symbol of the business at each service station site The code requires the placement of price information on a separate sign Code Section 9481 17 2 permits the placement of one price information sign for each street the service station abuts The proposed code amendment would allow price information on the major identification provided that no other signs are permitted on the site The code will still allow the present option of including price information on separate signs provided that the major identi- fication sign contains only the name or symbol of the business which it identifies The amendment essentially allows the option of combining the signs presently allowed in the two code sections In the staff' s view, the net effect of this code amendment will be to reduce the number of signs at service station sites The inclusion of price and identifi- cation information on one sign is less costly than the multiple signs now required Cost savings should act as an incentive to include all of the information on one sign Signs recently approved by the Planning Commission allowing the inclusion of price information on the major identification sign appear to have a higher aesthetic quality than signs approved under the existing requirements At the Planning Commission' s direction, as an incentive to combine the signs, the staff has added a provision allowing ten (10) square feet of additional sign area per face if pricing information is included on the major identification sign In summary, the proposed code amendment conforms with the intent of the ordinance code by _ reducing obstructions and_maintainina_high_ standards for the visual __ environment by virtue of a reduction in the total number of signs and by providing a more visually desirable sign Health Centers/Health Clubs Attached as Figure 2 is a draft ordinance pertaining-to -health-centers-and-health-clubs.— At-the-November-1, --1978- _Planning Commissionmeeting, the Commission_d-irected _staff to-in-tiate an amendment to the ordinance code _eliminatina_the need fora condi -_ tional use permit for health centers and health clubs in existing ' commercial shopping centers In the past year, three of these facili- ties have been approved in shopping centers with a finding that the Code Amendment No 79-1 April 16, 1979 Page 3 use did not increase the intensity of the shopping center nor require parking which cannot be accommodated All three are located in existing shopping centers and range in size from approximately 1500 to 2000 square feet The Planning staff in its observation of these existing health centers of this size have found no special problem which would require conditions upon the pro3ects Health centers and health clubs under 2500 square feet appear to be an appropriate and compatible use for shopping center development The attached ordinance contains three new code sections pertaining to health centers and health clubs - Section 9700 8 is amended to include a definition of health centers and health clubs Section 9430 5 is amended to allow health centers and health clubs under 2500 square feet in the C2 District The size limitation is based upon the City' s experience with facilities which can be accommodated in existing commercial centers without creating problems in terms of parking demand or compatibility with adDacent uses Section 9331 is amended to add health centers and health clubs over 2500 square feet as an unclassified use sub3ect to a conditional use permit Two subsections are proposed to specify parking requirements for the use The proposed parking requirements for handball, racquet ball, or tennis court facilities were derived through contact with other cities with similar facilities It is the staff' s feeling that health centers and health clubs over 2500 square feet should be sub- Dect to a conditional use permit because of the problems or character- istics which would be inherent in their size ENVIRONMENTAL STATUS Code Amendment No 79-1 is exempt from provisions of the State EIR Guidelines FUNDING SOURCE Not applicable ALTEERNATIVE ACTION The City Council may choose to add or delete from any of the measures stipulated in the proposed code ances and directed staff to set Code Amendment 79-1 for public hearing SERVICE STATION SIGNS Attached as Figure 1 is the ordinance per- taining to service station signs The amendment provides for the inclusion of price information on the service station ma]or identi- fication sign The code presently permits one ma]or identification sign and requires placement of price information on a separate sign Under the existing code section, one price information is allowed for each street the service station abuts The proposed amendment essentially would allow the placement of all the information onto one sign HEALTH CENTERS/HEALTH CLUBS Attached as Figure 2 is the ordinance pertaining to health centers and health clubs The amendment eliminates the need for conditional use permits for health center and health clubs in existing commercial shopping centers These facilities have recently been approved in shopping centers with a finding that the use does not increase the intensity of the Huntington Beach does ordain as follows SECTION 1 The Huntington Beach Ordinance Code is hereby amended by amending Section 9481 17 1 to read as follows 9481 17 1 MAJOR IDENTIFICATION SIGNS One (1) follows SECTION 1 The Huntington Beach Ordinance Code is hereby amended by amending Sections 9332, 9430 5 and 9700 8 to read as follows 9332 UNCLASSIFIED USES SUBJECT TO A CONDITIONAL USE PERMIT A conditional use permit may be granted in all dis- tricts except residential, Al, SP-1 and S1 for the following unclassified uses (a) Public and quasi public uses such as private clubs or lodges , rest homes , sanatoriums , convalescent hospitals and hospitals (b ) Airports (general aviation stage one ) (c) Heliports (d) Amusement enterprises (e) Transportation terminals (f) Commercial recreation uses and/or centersiexcluding golf courses (g) Golf driving range (h) Kennels , animal hospitals or clinics (1) Miniature golf courses (j ) Museums (k) Open air and/or drive-in theaters (1) Commercial horse stables pursuant to all provisions of /ahb 2/15/79 Article-949-- 938 8 939 (m) Radio or television transmitters (n) Recreational vehicle parks , subject to locational criteria as adopted by resolution of the City Council (o) Post offices (p) Health centers and health clubs (over 2500 square feet) subject to the following (Z) If the facility includes the &nstallattion of handball, racquet, or tennis courts, the parking requirement shall be four (4) spaces for each court plus any additionaZ parking spaces deemed necessary by the PZanning Commission for floor area not calculated as court area (2) If the facility does not incZude the installation of handball, racquet, or tennis courts, the parking require- ment shall be one (Z) space for each two hundred (200) feet of gross cleaning units , none of which shall have a rated capacity in excess of forty (40 ) pounds , using cleaning fluid which is nonexplosive and noninflammable at a temperature below 130 degrees Fahrenheit E Electric distribution, substations H Health centers and health clubs (under 2500 square feet) M Medical and dental laboratories Movie theaters Music conservatories 2 P Public garages S Saving and loan associations Skating rinks , ice or roller 9700 8 Words beginning with the letter "H" shall have the following definitions (1) Health Centers and Health Clubs A health center or heaZth club shaZZ mean a commerczaZ or private estabZzshment for the purpose of recreation and/or physzcaZ fit- ness activities such as handbaZZ, racquet or tennis courts, or exercise/conditioning faczZitzes zncZuding weight training, dance exercise , or other such uses (2) Hotel A building or portion thereof, containing six ( 6) or more guest rooms designed, arranged, intended to be used, let or hired out to be occupied, whether the compensation for hire be paid directly or indirectly in money, goods , wares , merchandise , labor or otherwise , and in which no provision is made for cooking in any individual
