STATEMENT OF ISSUE:
Transmitted for your consideration is Code Amendment No. 83-10, a
request by the City of Huntington Beach to amend Article 984, Con-
ditional Use Permits and Section 9811. 4, Plot Plan Amendments.
This code amendment will allow for alterations of developments
prior to, or after construction has commenced on a project. Through
the use of a site plan amendment application, each decision-making
body (Planning Commission and Board of Zoning Adjustments) will
have a mechanism to consider revisions to previously approved site
plans. The Planning Commission would bb able to act on revisions
to plans which they previously approved. , While the Board of Zon-
ing Adjustments will be provided with a formal mechanism for al-
terations to plans which they acted upon
RECOMMENDATION-
The Planning Commission and Planning staff recommend that the City
Council approve Code Amendment No. 83-10 and adopt the attached
ordinance.

DISCUSSION:
Attached is Code Amendment No. 83-10, a request to amend Article 984,
Conditional Use Permits and Section 9811. 4 , Plot Plan Amendments.
This will allow for alterations of developments prior to, or after
construction has - commenced on a project. Through the .use of a site
plan amendment application, each decision making body (Planning Com-
mission and Board. of Zoning Adjustments) will have a mechanism to con-
sider revisions to previously approved site plans. The amendment will
be applicable City-wide. Currently, the Board .of Zoning Adjustments
acts on revisions to plans which were approved by the Planning Commission
by use of a plot plan amendment application. This code amendment will
allow the Planning Commission to consider proposed alterations to plans
which they previously approved. It will also .provide a formal mechanism
for the Board of Zoning Adjustments to consider revisions to plans they
had previously approved.
ENVIRONMENTAL STATUS:
Pursuant to Section 15101 of the California Environmental Quality
Act, the subject request is categorically exempt from environmental
review.
FUNDING SOURCE:
Not applicable.
ALTERNATIVE ACTION:
The City Council may consider denying Code Amendment 83-10 choosing
to retain the current process- for reviewing previously approved plans.
Currently, the Planning Commission does not review revisions to- plans
which they originally approved. The Board of Zoning Adjustments acts
on these revisions through the use of a plot plan amendment application
while the Board of Zoning Adjustments has no formal mechanism to consider
revisions to plans they had previously approved.

1. 0 SUGGESTED ACTION:
Staff recommends that the Planning Commission approve Code Amendment
No. 83-10 and recommend it to the City Council for adoption.
2 . 0 ENVIRONMENTAL STATUS :
Pursuant to the California Environmental Quality Act, this code
amendment is categorically exempt from environmental assessment.
3. 0 ANALYSIS :
On May 17 , 1983 ,, the Planning Commission reviewed the proposed Code
Amendment No. 83-10 , a revision to Article 984 , Conditional Use Permits ,
and Section 9811. 4 , Plot Plan Amendments . As previously discussed,
this code amendment will allow for alterations of development prior
to, or after construction has commenced on a project. Through the use
of a site plan amendment application, each decision-making body (Plan-
ning Commission, Board of Zoning Adjustments) will have a mechanism
to consider revisions to previously. approved site plans .
4 . 0 RECOMMENDATION:
.Staff recommends that the Planning Commission approve Code Amendment
No. 83-10 and recommend to the City Council for adoption.

Secretary Palin explained that when the parcel .map is before the City
Council, staff will recommend a narrow pier headline be provided to
afford space for at least two boat slips. If the Commissioners are
opposed to this recommendation, the Planning Commission recommendation
could also be proposed to the City Council at that time. Commission
consensus was in agreement with Mr. Palin' s statement.
CODE AMENDMENT No. 83-10
Iinitiated by City of Huntington Beach
A request to amend Article 984, Conditional Use Permits, and Section
9811. 4 , Plot Plan Amendments. This will allow for alterations of de-
velopments prior to, or after construction has commenced on a project.
The amendment,' which will apply City-wide, will have a mechanism to
allow the BZA and the Planning Commission to each consider revisions
to previously approved site plans through the use of a site plan amend-
ment application. The ordinance was distributed at tonight' s meeting.
The public hearing was opened. Seeing, no one came forward to speak
either for or against the item, the public hearing was closed.

CODE AMENDMENT NO. 83-13
Initiated by City of Huntington Beach
An amendment which would repeal Article 979 of the Ordinance Code,
entitled Off-Street Parking, and adopt. a new Article 979 entitled
Off-Street Parking and Landscaping. The ordinance was distributed
to the Commissioners .
Jim Barnes gave a presentation on the proposed ordinance explaining
the rationale for a new restaurant parking ratio, both freestanding
and those within shopping centers) , etc . The Chairman opened the
public hearing. No one came forward to address this issue. The public
hearing was closed.
Under Section 9792 . 2 , Percentage of Landscaping, a show of hands on
the Commission revealed that there was a lsplit in opinion on just what
percentage should be required. . A second show of hands revealed a con-
sensus of 8% , rather than the 10% proposed by staff. (Commissioner
.Erskine was no longer present. )
Chairman Porter asked staff about the mechanism to enforce the landscape

of the City of Huntington Beach, in the Council Chamber of the Civic Center,
Huntington Beach, at the hour of 7:30 P.M. , or as soon thereafter as
possible on Tuesday the 5th day of July 19 83.
