RECOMMENDATION: The Planning Commission and Planning Staff recommend that the City Council approve Code Amendment No. 83-14 and adopt the attached ordinance. ANALYSIS: Applicant: . City of Huntington Beach .Location: City-wide, with the exception of the Al, SP-1 and Sl Districts. Rectuest: Code Amendment No. 83-14 is a request to permit the establishment of Development Standards and Restrictions for wind energy conver- sion systems subject to the approval of Conditional Use Permit before the Planning Commission. PLANNING COMMISSION ACTION ON JUNE 7, 1983 : ON MOTION BY LIVENGOOD AND SECOND BY HIGGINS CODE AMENDMENT NO. 83-14 WAS APPROVED FOR RECOMMENDATION TO THE CITY COUNCIL FOR ADOPTION BY THE FOLLOWING VOTE: AYES: Livengood, Higgins, Porter, Schumacher, Mirjahangir NOES: None ABSENT: Erskine, Winchell ABSTAIN: None PIO 4/81 , WIND ENERGY CONVERSION SYSTEMS June 15, 1983 Page 2 DISCUSSION: Attached for the Council ' s review is Code Amendment No. 83-14 which .will add Development Standards and Restrictions for wind energy .conversion systems to Article 933, Unclassified Uses of the Ordinance Code. This ordinance was prepared at the request of the City Council . as a result of recent problems relating to wind energy conversion systems within the City. These problems included concerns from citizens regarding the height of wind turbines, possible noise generated by wind turbines, and the overall safety of wind energy conversion systems. If approved by the City Council, this ordinance will regulate wind energy conversion systems in all zoning districts sub.j.ect:..to the_-.ap proval-:,of'..a�.Cond tiotal--,Use .Permit Application before the Plan- ning Commission except Al, SP-1, and Sl where they are not per- mitted. Development Standards for wind energy conversion- systems will include regulations, . governing setbacks, height, rotational control of blades, abatement of hazardous systems, and defini- tions. Major points contained within the ordinance include a sixty (60) foot maximum height restriction for wind turbines and a requirement that states: "Where a wind energy conversion system is proposed to be located within a residential district, the system shall be engineered to eliminate guide wires and shall not have a base larger than four '(4) square feet. " In addition to this regulation, placement of a wind energy conver- sion structure shall be required to comply with the open space requirements for the residential districts. The proposed or- dinance would also require the owner or operator of a wind tur- bine to submit a statement from a registered engineer stating that the system is in sound working condition and does not pose a hazard to those residents living in the area . This statement shall be submitted to the Department of Development Services on a yearly basis. ENVIRONMENTAL STATUS : Pursuant to the provisions of the California Environmental Quality Act, Code .Amendment No. 83-14 is categorically exempt and no en- vironmental review is necessary at this time. FUNDING SOURCE: Not applicable. ALTERNATIVE ACTIONS: The Council may consider denying Code Amendment No. 83-14 which would prohibit the construction of a wind energy conversion WIND ENERGY CONVERSION SYSTEMS June 15, 1983 Page 3 systems within the City, or the Council may consider altering the Development Standards and Restrictions as outlined by staff it the attached ordinance. CODE AMENDMENT NO. 83-14 - WIND ENERGY CONVERSION SYSTEMS 1. 0 GENERAL INFORMATION; Attached for the Commission' s review is Code Amendment No. 83-14 which will add development standards and restrictions for wind energy conversion systems to the ordinance code. This ordinance was prepared at the request of the City Council as a result of recent problems relating to wind energy conversion systems within the City. These problems included concerns from citizens regarding the height of wind turbines, possible noise generated by wind tur- bines, and the overall safety of wind energy conversion systems. If approved by the Planning Commission and the City Council, ,this ordinance .will regulate wind energy conversion systems in all zoning districts except Al, SP-1, and Sl, where they are not permitted. Wind energy conversion systems are subject to the approval of a conditional use permit application. Development standards for wind energy conversion systems will in- clude regulations governing setbacks, height, rotational control of blades, abatement of hazardous systems, annual inspection require- ments, and definitions. Commis oner Mirjahangir stated he had registered. DEVELOPMENT SERVIC ITEMS : - A study session on the D town Specific Plan was scheduled for 6 : 00 PM on June 21, 1983 . Also , Se etary Palin informed the Commissioners that they are invited to atten a City Council study session on June 20 , regarding the same topic . He the reviewed the actions taken at the June 6 , 1983 City Council meeting, ating that the Council did find the mud dump as a public nuisance. PLANNING COMMISSION ITEMS : Commissioner Livengood stated that staff did a g od job on the parking and landscaping code amendment. He expressed a de ' re to take some action, even if it meant denying it so it would move n to the City Council , on the conditional use permit request from W & Builders. He also requested .that staff investigate the .Weiser Lock cility re- garding landscaping and possible violation of the sign code t the shopping center located at the northeast corner of Springdale nd Edinger.
