Mayor Coen called the adjourned regular meeting of the City Council of the City of
Huntington Beach to order at 5:30 P.M.
ROLL CALL
Present: Shipley, Bartlett, Gibbs, Hatney, Wieder, Duke, Coen
Absent: None
EMERGENCY ORDINANCE NO 1921 - ADOPTED AS AMENDED - SUNSET HEIGHTS MORATORIUM
The City Clerk was directed to give Emergency Ordinance No. 1921 a reading in full -
"AN EMERGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH IMPOSING
A MORATORIUM ON THE ISSUANCE OF BUILDING PERMITS BY THE DEPARTMENT OF BUILDING AND
COIr4UNITY DEVELOPMENT WITH RESPECT TO CERTAIN REAL PROPERTY WITHIN THE CITY."
Councilman Duke spoke regarding the reasons for his contention that a two month, rather
than three month moratorium would be more feasible.
On motion by Wieder; Council adopted Emergency Ordinance No. 1921, as amended to read
60 day moratorium rather than 90 day moratorium. The motion was passed by the follow-
ing roll call vote:
AYES: Shipley, Bartlett, Gibbs, Wieder, Duke, Coen
NOES: Matney
ABSENT: None
EXECUTIVE SESSION CALLED
Mayor Coen called an Executive Session of Council to discuss pending litigation and
personnel matters.
RECESS
The Mayor called a recess of Council at 7:10 P.M.
RECONVENE
The meeting was reconvened at 8:45 P.M. by Mayor Coen.

MOTION TO RECONSIDER EMERGENCY ORD NO 1921 - APPROVED - SUNSET HEIGHTS MORATORIUM,
Mrs. Korleen Bogdanovich, 4192 Branford Drive, City, addressed Council regarding
conditions in the Sunset Heights area relative to parks and school sites and stated
that she"believed a building moratorium should be established which would encompass
more area than that which is covered by the moratorium which is to be established
in that area pursuant to direction at the adjourned meeting held earlier in the
evening.
Following discussion, a motion was made by Councilman Bartlett to reconsider
Emergency Ordinance No. 1921, imposing a moratorium on the issuance of building
permits in the Sunset Heights area, which had failed to pass at the June 10, 1974
adjourned meeting. The motion was passed by the following vote:
AYES: Shipley, Bartlett, Gibbs, Wieder, Duke
NOES: Matney
ABSENT: Coen
On motion by Gibbs, Council continued action on the adoption of Emergency Ordinance
No. 1921, for vote only, to the adjourned regular Council meeting to be called for
Tuesday, June 18, 1974 at 6:30 P.M. The motion was passed by the following vote:
AYES: Shipley, Bartlett, Gibbs, Wieder, Duke
NOES: Matney
ABSENT: Coen
Mr. Frank Buccella, 1866 Rhodes Drive, Costa Mesa, developer of land within the
assessment district area, addressed Council and presented suggestions which he
believed would encourage better development in this area.
PEDESTRIAN SAFETY - GOLDENWEST STREET - RIO VISTA DRIVE - TALBERT AVENUE
The City Administrator addressed Council regarding his recommendation that an over-
cross be established at Rio Vista Drive and Goldenwest Street to provide safe access
in Central City Park. He stated that, in the meantime, he would recommend that a
pedestrian crosswalk and a flasing caution light be installed at this location and
that 3 way stop signs be erected at the intersection of Talbert Avenue and Golden-
west Street.
Following discussion, on motion by Matney, Council approved the possible expendi-
ture of revenue sharing funds for the construction of an overpass at Rio Vista Drive
and Goldenwest to provide safe access to the Central City Park and library. The
motion was passed by the following vote:
AYES: Shipley, Bartlett, Gibbs, Matney, Wieder, Duke
NOES: None
ABSENT: Coen
On motion by Shipley, Council directed that a pedestrian crosswalk and a flashing

SUNSET HEIGHTS MORATORIUM
A motion was made by Councilwoman Wieder that the City Council adopted an immediate
building moratorium on the designated Sunset Heights area bounded by Warmer, Hell,
Bolsa Chica and Algonquin, for a four month period until all the information needed
to pursue with any more building in that area or before any more building permits
are issued, to give the City more information on density, schools, parka, and seismic
safety.
Discussion was held regarding aspects of the matter including the disposition of
current application. for permits as well as the construction which is to commence
shortly in the Sunset Heights Assessment District.
The City Attorney addressed Council regarding legal aspects of the matter.
Councilman Duke moved to amend Councilwoman Wieder's motion to include that the
moratorium be enacted for reasons of studying density in the area, street patterns
and zoning, public facilities and any such immediate things which would be required;
rather than seismic concerns, to instruct the Planning Department and.Planning Com-
mission to study the development of an ordinance concerning these elements with a
view toward possibly rezoning the area and that the Director of Building and Com-
munity Development be directed to use his discretion as to the intent of the ordiname,
and further requested that the emergency moratorium ordinance be presented for Council
consideration at the adjourned meeting to be called for June 10, 1974. The motion
was passed by the following vote
AYES: Wieder, Duke, Coen
NOES: Shipley, Bartlett
ABSENT: Gibbs, Matney
Mayor Coen requested that the City's Assessment District Attorney, John T. Ganahl,
provide Council with a written opinion as to the potential legal implications to
the City relative to such a moratorium on the assessment district in the Sunset
Heights area, for presentation at the June LO, 1974 meeting.
BIDS REJECTED - BULKHEAD - BOAT RAMP & RELATED CHANNEL EXCAVATION - CC-240
The City Clerk presented Project CC-240 - construction of a bulkhead and boat ramp
and related channel excavation for the Fire and Harbor Departments facility to be
located at Huntington Harbour. The bids on said project had been opened at 10:00 A.M. ,
on Monday, May 20, 1974, in the Council Chamber by the City Clerk, City Attorney .and
and the Director of Public Works with G. A. MacDonald Construction Company being the
low bidder with a bid of $368,533. The Director of Public Works recommended that
action be deferred to the June 3, 1974 meeting pending review and recommendation by
his office. Environmental Impact Report No. 73-13 was adopted by Council on Septem-
ber 17, 1973. The Coastal Commission permit was issued February 11, 1974 and the
permit from the Corps of Engineers is expected momentarily.
The Director of Public Works informed Council of the reasons for his recommendation
that Council reject all bids and authorize the staff to investigate methods for con-
struction of the project by means of a joint venture, which would be contingent upon
approval by the City Attorneys office.
On motion by D4W,- Council rejected all bids on Project CC-240 - construction of a
bulkhead and boat ramp and related channel excavation for the Fire and Harbor Depart-

BEACH IMPOSING A MORATORIUM ON THE ISSUANCE OF

WHEREAS, the City Council ,of the City of Hunt' gton Beach
desires to establish a i ) day moratoriu : upon all new
construction in a designated area of the city o enable the
Planning Department and Planning Commission , 'o study said area
for contemplated zoning proposals; and
The Planning Department and the P1 ning Commission of the
city are hereby instructed to study s d designated area for
contemplated zoning proposals; and
The City Council of the City of Huntington Beach finds it
necessary that this ordinance b adopted as an emergency measure
to protect the public health, afety and welfare by adopting
an interim ordinance on the roperty described in Exhibit A and
shown on District Map 20- 11, attached hereto and by reference
made a part hereof; and

(d) Plans submitted to the city Department of Building

ordinance subsequently approved without substantial change; or
(e) Building permits issued prior to the effective date
of this ordinance .
SECTION 2 . The real property to be located within the
interim zone is the area located in the city of Huntington
Beach, County of Orange, State of California as described in
Exhibit A and as shown on District Map 20-5-11, attached hereto
and by reference made a part hereof.
SECTION 3 . This is an emergency ordinance necessary for
the immediate preservation of the public health, safety and
welfare, and shall take effect upon adoption. This ordinance
shall be of no further force and effect after ninety (90) days
from its adoption unless extended pursuant to Section 9051. 3
of the Huntington Beach Ordinance Code. The City Clerk shall
certify to the passage of this ordinance and shall cause same
to be published within fifteen days of its passage in the
Huntington Beach News , a newspaper of general circulation,
printed and published in Huntington Beach, California.

The City Council of the City of Huntington Beach finds it
necessary that this ordinance be adopted as an emergency measure
to protect the public health, safety and welfare by adopting
an interim ordinance on the property described in Exhibit A and
shown on District Map 20-5-11, attached hereto and by reference
made a part hereof; and
Huntington Beach Ordinance Code Section 9051 and California
