STATEMENT OF ISSUE:
Code Amendment No. 82-9 amends the definitions and miscellaneous pro-
visions articles of. Division 9 of the Huntington Beach Ordinance Code
to bring them into conformance with a previous revision of Article 973,
Miscellaneous Provisions, and correct an omission.
RECOMMENDATION:
Following'a public_ hearing; approve Code Amendment 82=9and accampariying,resolution.
ANALYSIS:
The Planning Commission, at its meeting of October 19, 1982, approved
Code Amendment 82-9 and recommended it to the City Council for adoption.
Code Amendment No. 82-9 was initiated' by the Planning Division to cor-
rect two deficiencies. of Code Amendment No. 82-2, which revised
Article 973 regulating miscellaneous land uses. These are as follows:
1. The title of a "special event" was changed by Code Amendment
No. 82-2 to "temporary outdoor event". to avoid confusion with
a similar type of .special event permit in the municipal code. No
definition of "temporary outdoor event" was placed in Section
9700 .18 at that time. This am_ end_ ment deletes the definition of
"special. event" from Section 9700. 17 (subsection (d) ) and adds
. _subsection (6)) , temporary outdoor event, to Section 9700. 18 to
define a temporary outdoor event. ' A-temporary outdoor event is -
defined as a specialized outdoor event which does not exceed
twenty-one calendar days a year. Community service events such
as bloodmobile, chest X-ray or rabies shot clinics are specifi-
cally excluded from this definition. In addition, a part of
subsection (b) , travel trailers, which refers to a special chauf-
feur' s license (a license that is no longer required) has been
deleted. Also; reference to a special permit for moving
oversized vehicles has been removed from this subsection, since a
special permit is not required to move a vehicle which does not
exceed the length and width specified in the Article (8 feet
wide by 40 feet long) .
2. When Section 9730.14, which provides for deferring street improve-
ments in certain instances, was revised in June, 1982, a paragraph '

was omitted which authorizes the Director of Public Works to accept
applications from persons desiring waivers of street improvements.:
which are accompanied by a fee set by resolution of the City
Council. This amendment re-inserts this authority into Section
9730 .14 as paragraph (e) .
FUNDING SOURCE:
None needed.
ALTERNATIVE ACTIONS:
Do not adopt Code Amendment No. 82-9 . This would mean that the
Director of Public Works would not have the authority to accept appli-
cations for waiver of street improvements.
