STATEMENT OF ISSUE:
The City Council continued this item at their May 4 , 1987 meeting to
allow time -for a report back from the Planning Commission regarding
an addition proposed by staff to the ordinance.
Code Amendment No. 87-2 is a request by the applicant to modify
standards in the RA District such that temporary contractor ' s
storage yards would be allowed subject to conditional use permit
approval . The additional language indicates that only contractor ' s
storage yards that have current contracts within the City of
Huntington Beach be permitted.
The Planning Commission supported this addition to the proposed
ordinance, as reflected in their vote on May 19, 1987 .

ANALYSIS:
The proposed addition to the ordinance, which limits contractor ' s

unrelated to projects within Huntington Beach.

Code Amendment No. 87-2 is a request by the app-1-1-cant to modify

yards could be allowed. Staff has analyzed the proposal and
supports the amendment, recommending that specific standards be
adopted to regulate such uses and that conditional use permit
approval by the Planning Commission be required.

ANALYSIS•
The RA District, as provided for in the zoning code, is intended "to
serve as a transition or holding zone for property with current
agricultural activities and as a zone where restricted residential
development is permitted. " Currently, the types of limited uses
permitted include horticulture, wholesale nurseries, certain
unclassified uses (listed in Article 963) , and single family
dwellings at a maximum density of one unit per acre.
The Planning Commission recommends that storage yards be allowed on
a temporary basis subject to a conditional use permit . The
appropriate standards for screening and landscaping can be
referenced which currently appear in Section 9530 . 15(b) (Outside
Storage Requirements for the Light Industrial (Ml) District) . Chain
link fencing with wood slats could be allowed to serve as a
screening wall, however, rather than the concrete block wall .
required for the M1 District . These provisions (attached to the
Planning Commission staff report) require a minimum setback of
fifteen (15) feet to any streetside property line. The slatted
chain link fence would be located at this fifteen foot setback, with
the area in front fully landscaped.
Specific concerns raised by the Planning Commission have been
incorporated in the ordinance. A special setback requirement of
twenty (20) feet for sites adjacent to major arterials is
specified. Such setback area shall be fully landscaped. A location
criteria specifies a minimum distance of 1, 000 feet to any
residential development and requires the cessation of the use when
development occurs within that buffer zone.
ENVIRONMENTAL STATUS:
The proposed project is categorically exempt from the provisions of
the California Environmental Quality Act.

The above code amendment addresses a new provision to allow temporary contractor's
storage yards in the Residential Agriculture (RA) District subject to conditional use
permit. It is set for public hearing before the City Council on May 4, 1987. After further
analysis, I think that staff should recommend that only those contractor's storage yards be
permitted that have current contracts within the City of Huntington Beach. Adding such a
provision to the ordinance when it is introduced by the Council, will ensure the true intent
of the provision. It is intended to allow a temporary yard for a firm that is working within
the city limits, but which has a main office located out of the local area. The storage yard
would be for convenience and would only be in existence for the time period during which
the contract runs.

Staff recommends that the Planning Commission approve the revised
ordinance for Code Amendment No. 87-2 and prepare a report
recommending adoption by the City Council .
2. 0 GENERAL INFORMATION:
On May 4, 1987, the City Council continued this item to their
meeting of June 1, 1987, to allow the Planning Commission an
opportunity to review and comment on a further addition to the
proposed regulations .
After careful consideration, staff is recommending that only
contractor ' s storage yards that have current contracts within the
City of Huntington Beach be permitted. Adding such a provision to
the ordinance will ensure the true intent of the new provisions .
They are intended to allow a temporary yard for a firm that is
working within the city limits, but which has a main office located
out of the local area. The storage yard would be for, convenience
and would only be in existence for the time period during which the
contract runs . Augmenting the ordinance in this way offers protec-
tion for the City; we do not want to encourage such storage yards if
they are not related to work being conducted on projects within our
city.

1. 0 SUGGESTED ACTION:
Staff recommends that the Planning Commission approve Code Amendment
No. 87-2 to allow temporary storage yards subject to conditional use
permit approval and specific locational criteria in the RA District.
2 . 0 GENERAL INFORMATION:
The Planning Commission continued this item at their meeting of
March 17, 1987 . Code Amendment No. 87-2 is a request by the
applicant to modify standards in the RA District. The applicant
wants to utilize a .33 acre site on Garfield Avenue, east of
Goldenwest Street, as a storage yard for her roofing business.
Items that would be stored include three trucks, two roof kettles
(used for hot tar applications) , one metal storage bin leased from
Orange County Disposal, some outside materials such as concrete tile
left over from jobs, and employee' s cars or trucks .
The applicant has indicated that she would be willing to use chain
link fence with wood slats for screening purposes and would submit
the appropriate entitlement for the desired use.
3 . 0 ENVIRONMENTAL STATUS:
The proposed project is categorically exe-tipt from the provisions of
the California Environmental Quality Act .
4 . 0 ANALYSIS:
At the Planning Commission meeting of March 17, 1987, the Planning
Commission discussed several concerns with the code amendment as
prepared and requested that staff review . a number of alternatives .
Tn reviewing the request, there are two options available. -One

would be to deny the code amendment, preventing storage businesses
from operating as temporary uses in the Residential Agriculture
District. Second would be permitting such businesses on a temporary
basis subject to appropriate entitlement. Specific code
requirements could be adopted in order to ensure proper screening,
compatibility with surrounding uses, and cessation of the use when
development occurs in close proximity.
The RA District, as provided for in the zoning code, is intended "to

yards be allowed on a temporary basis subject to a conditional use

be referenced which currently appear in Section 9530. 15(b) (Outside

link fencing with wood slats could be allowed to serve as a

Exhibit 2) require a minimum setback of fifteen (15) feet to any

prohibiting temporary storage yards on any property with a Civic
District suffix, special setback considerations for sites adjacent

cessation of the use when development occurs within that buffer
zone. All of these concerns have been incorporated in the revised
ordinance. Twenty (20) feet is recommended as the minimum setback
to major arterials; and one thousand (1, 000) feet as the minimum
distance to a residential development . A final discussion item,
that of including temporary storage yards in the Unclassified
section of the code, thus allowing them in any district subject to
conditional use permit, is net recommended by staff . It would
open up too many areas as potential locations for temporary storage
yards, including undeveloped residential and commercial property.
In the Unclassified section, temporary storage yards are permitted,
except in residential districts. The reason it is desirable to
separate the RA District is because of the specific locational
criteria and cessation requirements .
5 . 0 RECOMMENDATION:
Staff recommends that the Planning Commission approve Code Amendme:it
No. 87-2 to allow temporary storage yards subject to conditional use
permit approval and specific locational criteria in the RA District.,

Section 9530 .15 (b)
(b) Outside Storage Special Requirements:
(1) The minimum setback for the front yard and exterior side yard of
an outside storage site shall be fifteen (15) feet, all of which
shall be fully landscaped pursuant to the Department of Public
Works standard plans.
(2) Outside storage areas shall be paved or graveled and all
circulation areas shall be paved.
(3) All construction materials for fences, walls and gates shall be
approved by the Director.
(4) All outside storage including, but not limited to, trucks; --.---
equipment, materials, lumber or other products shall be screened
from view of public streets by a solid six (6.) inch concrete
block or masonry Mall-a-ma-ximum of ni e g measured
om t e top of the adjacent street curbline. Any openings in
the wall shall be equipped with solid gates equal in height.
Screening from adjacent properties shall be provided by a slatted
fence, wall or combination thereof, nine (9) feet high as
measured from the highest ground surface within twenty (20) feet
of the common property line.
(5) Storage of outside materials shall be limited to the height of
the nine (9) foot screening wall except that lumber may be
stacked a maximum of sixteen (16) feet (eight units) high unless
;.he parcel abuts property zoned or general planned residential,
then a fifteen (15) foot landscaped buffer shall be provided
adjacent to a thirty (30) foot wide storage area on which
stacking shall be limited to nine (9) feet in height.
(6) Screening walls abutting arterial highways shall be
architecturally compatible with surrounding properties,
constructed of a minimum six (6) inch wide decorative masonry
block, and designed with landscape pockets at thirty-five (35)
foot intervals along the exterior side sufficient in size to
accommodate at least one (1) 15-gallon tree. This landscaping
shall be in addition to that which is required in Section 9792.2,
Percentage of Landscaping. Approval of a use permit .by the Board
of Zoning Adjustments shall be required prior to construction of
such walls. Tree specie and irrigation plans shall be subject to
the approval of the Departments of Development Services and

9100 General Provisions. The residential agriculture
district RA is intended to serve as a transition or holding
zone for property with current agricultural activities and as a
zone where restricted residential development is permitted.

9101 Permitted uses. The following shall be permitted
within the RA district.
(a) Unregulated. Agricultural and horticultural uses such
as orchards, field or bush crops, vegetable and flower
gardening.
(b) Building permit. Single family dwellings and
accessory buildings which are permanently located on a parcel
and greenhouses, barns, tool sheds, and buildings accessory to
farming uses shall be permitted subject to the approval of a
building permit. Tents, trailers, vehicles, or temporary
structures shall not be used for dwelling purposes.
(c ) Use permit. The following uses shall be permitted
subject to the approval of a use permit by the board of zoning
adjustments . The board shall consider in its decision traffic
circulation, the provision of off-street parking, required
dedications and improvements, and the buffering and
compatibility of the site with surrounding uses .

9108 , Parking. Parking shall comply with the standards
outlined in Article 960. The parking of inoperable motor
vehicles; trucks and machinery; trailers, campers and boats
shall be prohibited in front of the main dwelling. (Ord.

9109 Miscellaneous requirements .
(a) Accessory buildings. Accessory buildings may be
permitted on a lot with a permitted main building. Setback
requirements are as specified for the main dwelling, except
accessory buildings other than detached garages shall set back
fifty ( 50) feet from the front property line. The minimum
distance from any building to any other building on the same
lot shall be twenty ( 20) feet.
(b) Architectural features . Architectural features;
including eaves, fireplaces, and open unroofed stairways and
balconies shall maintain a minimum distance of five ( 5) feet
from any portion of any other building on the same lot. Such
features shall set back thirty ( 30) inches from the side
property lines and sixteen (16) feet from the front and rear
property lines .
(c) Fencing. Fencing shall comply with the standards
