Belsito, City Administrator DATE: November 15, 1977 RE: REQUEST FOR EXPANSION OF TOWNLOT SPECIFIC PLAN At their November 1, 1977 regular meeting, the Planning Commission considered a request by two property owners to expand the Townlot Specific Plan boundaries southerly to the alleyway which is parallel and between Pacific Coast Highway and Walnut Avenue. Insofar as the subject area under consideration is within the Redevelop- ment Plan Area and the Coastal Zone, thus subject to further planning through the Local Coastal Program, the Planning Commission concurred with the Staff' s recommendation to oppose a southerly expansion of the Town- lot Specific Plan at this time. The Planning Commission will consider the zoning boundaries of the Walnut/Pacific Coast Highway area upon resolution of these broader planning issues. Respectfully submitted, Edward D. X' / (a) Architectural features and general appearance of the proposed development shall not impair the orderly and harmoni- ous development of the area, the occupancy thereof, or the community as a whole . (b) Architectural features, including materials, colors, and variations in setback shall be included in the design of all vertical exterior surfaces of the buildings in order to create an interesting, aesthetically pleasing project when viewed from outside the project as well as within. All uses in the Townlot Specific Plan Area One shall be subject to an administrative review application before the Board of Zoning Adjustments unless a use permit or a conditional use permit application is required. The following criteria shall serve as guidelines for the Board in approving, conditionally approving, or denying such applications : (a) Relationship of the structures to the site, including setbacks and site planning. (b) Compatibility of structures with surroundings . (c ) Relationships of the 14!vaig#-1-14yopen space to the dwellings . 5• ( L (d) Landscaping. (e) Relationship of parking and vehicular and pedestrian circulation areas . 9385. 3 DEVELOPMENT INTENSITY. All required recreation areas shall be located behind the required front yard setback. �.� 6 . 4 9385. 8 SIDE YARD SETBACK FOR TWENTY-FIVE (25) FOOT LOTS . (a) The side yard set back for a twenty-five (25) foot frontage lot shall be a minimum of three (3 ) feet, provided further, that a zero setback is permitted if the following con- ditions are complied with: (1 ) the abutting site is held under the same owner- ship at the time of initial construction or the owners of abut- ting properties record an agreement or deed restriction and consent in writing to such zero setback; and (2 �e-eei -a€-eee �eee1-it}�e - ie-ee�e-sebae e€- ie-a e- a-&-xi} i eFx-e€-€eel-444-€eetvA minimum front yard setback of twelve (Z2) feet shall be provided for all structures; and (3) where a common zero setback line is used between two abutting structures, a minimum offset of six (6) feet shall be provided in the front setback of the abutting structures; and (4) the opposite side yard of the site shall be not less than four (4) feet; and (5) adjacent structures on abutting lots shall maintain a minimum separation of five (5) .feet, provided further, this requirement `haZZ not apply where the same interior property line is utilized for zero side yard setback construction on both lots. (b) Any side yard setback on a twenty-five (25 ) foot lot with frontage abutting an arterial or local street shall be a minimum of five (5) feet . 9386 .3 DEVELOPMENT INTENSITY. Any recreation space provided in accordance with Section 9386 . 3 shall -twe1q4y-4284--feet:have a minimum dimension of six (6) feet and shall be provided with each dwelling unit in accordance with the following space require- ments: four bedrooms 300 sq. ft. three bedroom units 250 sq. ft. two bedroom units 200 sq. ft. one bedroom unit Z50 sq. ft. single Z00 sq. ft. Balconies that serve as entrances or exits for more than one dwelling unit shall not be considered as private open space. All required recreation areas shall be located behind the required front yard setback. SECTION 3 . The Huntington Beach Ordinance Code is hereby amended by adding Sections 9384. 17 and 9384 .18 to read as follows : 9384. Z7 LANDSCAPING. In order to provide and insure a more pleasant Ziving environment through the use of plants, vegetation and decorative Zandscape/architecturaZ design elements, the following are required: (a) All front and side yard setback areas visible from streets shall be permanently Landscaped with ground cover, ferns, trees, shrubs and other living plants. (b) A minimum of one (Z) twenty-four (24) inch box size tree shall be provided in the front yard area .for each fifty (50) feet of site frontage. As an alternative, three (3) or more small trees may be Located and grouped in any desired way on the site. (c) A permanent irrigation system shall be provided in aZZ landscaped areas. (d) A landscape and irrigation plan shall be submitted to the Department of Building and Community Development prior to the issuance of building permits. EXCEPTION. Single family homes are excluded from landscaping requirements as set forth in this section. 9384. Z8 DISTANCE BETWEEN THE MAIN STRUCTURE AND ACCESSORY BUILDING. The minimum distance between the exterior waZZs of a main structure and accessory building on the same Lot shall be ten (ZO) feet. 8 . SECTION 4 . This ordinance shall take effect thirty days after its adoption. The City Clerk shall certify to the passage of this ordinance and cause same to be published within fifteen days after adoption in the Huntington Beach News, a weekly news- paper of general circulation, printed and published in Huntington Beach, California. The ordinance delineates the requirements necessary for a low density residential environment of 0-8 units per gross acre. These requirements include development intensity standards , recreational space provisions , setback require- ments , landscaping standards, etc. , and will also include the removal of the existing zoning designations. The entire area will then be redesignated as Townlot Specific Plan Area I. The proposed ordinance was approved by the Planning Commission at its meeting of May 20, 1975 by a unanimous vote. Environmental Status: The Environmental Review Board at its meeting of May 20, 1975 granted the proposed ordinance Negative Declaration No. 75-32 , having found that the proposed project will not have a significant adverse effect on the environment. Article 935, Townlot Specific Plan Area One Support for the ordinance A number of us prefer allowing homes on 50-foot lots (about 50% of the resident owners who gave definitive responses) . Another 23% favor allowing homes on 25-foot lots for a total of 73% favoring homes only. Another 22% favor allowing duplexes bringing the total thus far to 95.5%. An objective, observer from outside might say that this ordinance is well-ballanccc_•. between the desires of residents and developers and practical reality. The ordinance seems to be in line with what is acceptable to a significant number of residents. It may balance out to be about as fair to the various interests as you can get. Benefits of the proposed ordinance . This satisfies what is acceptable to a significant number of residents. • enhances having a livable area (good quality-of-life) • encourag7as resident-ownership and less trend towards transients, absentee ownership and related problems (especially if homes are built on 25-foot lots instead of duplexes on 50-foot lots) . . enhances a better development of the area. • domes on 25-foot lots: * provide for more resident owners and a greater feeling of community and stability. * provide a more saleable, profitable, product for the developer. * possibly give more people a chance to own a home near the ocean --- might put the cost of homes here within the reach of more people. maintains the character of the area to a certain extent. I expect that new homes will be of a different nature than the older ones. But the density and quality of the occupants should be good. a certain uniqueuness will remain since many lots will' ,be individaully developed. Specific comments of the ordinance Because of spending time on other things, I took little time at the PC hearing on these items. Weld appreciate having the spokesman for the H.B. Landowner's Assn address these points. If HBLA has no objections, we'd like them removed: 1. Under 9352.3 USES PERMITTED: Although it's unl1kely that triplexes, other multiple dwelling structures or multiple dwelling structures would be built, it would give us a warmer feeling if these were delete.. 2. Under 9352.7 FRONT YARD SETBACK: We 've received complaints about structures projecting 6 feet closer to the sidewalk when the "front yard setback is averaged." This gives those on neighboring lots a hemmed-in feeling. On wider lots this might provide flexibility of alignment etc. But it provides no more landscaped area or livability space. Now that the Land Use Element is created and approved, our current survey is intended. to determine in detail the maximum zoning that resident owners would feel comfortable with. Nine people surveyed the .residen t-owners using the Fig. 2 questionnaire. Only the responses of resident owners (3 exceptions) were tabulated in the summaries (Table 1 and Fig. 3) . The heirarchy of responses was: • house on 50-foot lot • house on 25-foot lot • house with detached unit • duplex on 50-foot lot • triplex on 50-foot lot • multiple units A response for a specific building-type generally implied that all building-types listed. above it also were acceptable. Exception: Several who checked duplex on a 50-foot lot were not in favor of a home on a 25-foot lot (but most were in favor) . Subsequently I learned that renters ' opinions also count in this matter; that renters sometimes have a greater concern for the betterment of an area than many absentee owners. The preferences of renters may or may not be considered.. Although we appreciate their support, I feel that fairness requires that much more weight be given to the views of property-owners. Renter support is detailed in "Petition of renters in support of homes In the Town Lot area; Leonard Wright to Planning Dept/PC, 10-27-74. The petition read "We renters prefer this area to be zoned for homes." The signatures collected on Oct. 2, 1974, are from 3 street intervals& • 6th Street: blocks 200, 300, 400, 500 (only the west side) • 9th Street: blocks 200, 300, 400. 500 • 12th Street: blocks 300, 400 • 15th Street: blocks 500, 600 64 of the 71 contacted signed. Of the 7 who declined to sign: . one felt unqualified to sign. . one requested a call-back later. . three were concerned with the repercussions of signing a petition. . one was angry over actions by some trw sients and planned to move. They've expressed strong desires for low-density protection. These desires should be considered (possibly when Are 5 is planned). Some of their responses were included with the Area statistics, If the maximum allowed were a house on a 50-foot lot, I understand that those having only a 25-foot lot,or its equivalent, could develop or redevelop their property. This would be a necessary condition. Statistical summary Fig. 3 shows a block-by-block summary of survey responses. Table A-1 summarizes the Fig. 3 responses for the Low Density area (Area 1 ) . Of� hose giving definite responses: * 95.5% feel that no more than 2 units should be allowed per 50-foot lot. * 73.3% favored homes only. Pros and cons 1. Homes on 50-foot lots (favored by about 50%) Pro . This would provide for an attractive area. It would limit density and help to make this a desireable and enjoyable place to live. Con . Property in some parts of Area 1 would require expensive homes, This would slow down development and redevelopment. 2 . Homes on 25-foot lots (favored by about 20%. Additionally, -most of the 22 who favored duplexes on 50-foot lot also favor homes on 25-foot lot) . Pro More resident owners. This may put the cost of homes within the reach of more people. This provides a balance between resident and developer. Con Some areas will evolve towards greater density as homes on 50-foot lots are replaced with homes on 25-foot lots. Of those giving definitive responses: * 95.%feel that no more than 3 units._should be allowed onc_a 50-foot lot,. * 77.3% favored a maximum of 2 units per 50-foot lot. What was meant by medium density? At the time the Land Use Element was approved, our feeling was that medium density meant 2 units per 50-foot lot. These .beliefs were based on: . .Fig. 4.4, "Existing Zoning, " of Ref. 2 defines medium density as R2. • Fig. 4.12, "Alternative 1, " of Ref. 2 defines low density as Rl and medium density as R2. • Area 3U includes some of what is now zoned R2. Based on these assumptions, we suppprtod medium density for certain areas. I believe that others also may not have had a complete, distinct feeling of what medium density meant during different phases of the Land Use Element development and hearing processes. Pros and. cons of a 2-unit limit in areas dominated by multiple units Also I believe that a case was made (possibly subsequent to the development of the Land Use Element) that the intensive multiple-unit development of certain areas make a 2-unit limit impractical in these areas because: multiple units so engulf these areas that 2 units per 50-foot lot would be out-of-place. In fairness, these areas should be left for multiple units only. having recently paid_ high prices for the property, it's economically impractical to have a 2-unit limit. These preceding points have merit. On the other hand: people with a house on a 25-foot lot or a duplex on a 50-foot lot don 't like to see multiple units going-up nearby. The supposition is that if triplexes are allowed, what areas should they be limited to? Based on this supposition, 3 general categories are considered: 1 . Definitely should have a 2-unit limit Currently the area: • is largely homes or 2 units per 50-foot lot and/or • has expressed preferences for low-density protection and/or • the area is currently zoned R2 . These areas deserve protection to preQent a process that has previously happened in the Town Lot: • A developer buys a vacant lot or developed property, clears it, . then builds a multiple unit. • Eventually it becomes too disagreeable to nearby resident-owners, so some sell. • The attrition process continues until multiple units replace homes, most of the homeowners are. forced out and those remainng (who feel it's impractical to move) are burdened with a bad situation. 2 . He, like others in the area, has been paying taxes for many years based upon the zoning which would permit multiple family dwelling units under which at one time he could have gotten 6 dwellings for 2 adjoining lots and currently 4. Under subject plan it is proposed to provide that there be one dwelling unit per lot. This is notwithstanding the fact that in the same block on the same side of the street as his..lots are located on there is a duplex, and in the block immediately across the street on 8th Street are 2 four-plexes, each four-plex being on two lots. Under the circumstances, it is inequitable for you to down zone and reduce the number of units which he may place on his lots. For years the value used by the assessor has been based upon sales in which the parties recognized that larger density was proper and permissible. I have advised Mr. Kirschner that the down zoning under the circumstances of this case probably constitute an inverse condemnation. We hope that you do not adopt subject plan.
