ATTN: DOYLE MILLER, City Administrator. RE: CODE AMENDMENT NO. 66-3, an amendment to Division 9 of the Huntington Beach Ordinance Code. Gentlemen: Transmitted herewith is a proposed amendment to Division 9 of the Huntington Beach Ordinance Code. Said amendment proposes to include the following changes : A. Changes common to all residential zones: 1. Requires architectural features to maintain a 30 inch setback from any property line. 2. Unenclosed stairways or balconies will no longer encroach into the required rear yard. 3. Accessory buildings : (a) Allows detached garages in the front yard (b) Requires the side yard setback to be the same as the main building (c) Requires a five foot rear yard setback except when abutting an alley (d) Establishes a maximum height limit of 15 feet 4. Repeals existing provisions for reduction of rear yard areas. 5. Renumbers certain sections. B. Changes applicable to specific zones : R1 and R2 Zones 1. Reduces the rear yard to 10 feet with a minimum open space of 900 sq. ft. or two 450 sq. ft. areas. Huntington Beach Flammng Comma o on O P. 0. The exterior side yard in the area bounded by Ocean and Palm Avenues, First and Twenty-Third Streets may not be encroached into by balconies or stairways. The Planning Commission unanimously approved this matter March 15, 1966, and recommends adoption by your Honorable Body. The Code provides that a public hearing shall be held on the matter after which an ordinance may be adopted effecting the change. Respectfully submitted, K. A. Reynol s Planning Director and Secretary KAR/j Encl : Code Amendment No. 66-3 Section 1. the following Sections of Division 9 of the Huntington Beach Ordinance Code are hereby repealed: Repeal S. 9103.4.2.4 S. 9103.4. 3.1 S. 9103.4.3.2 S. 9103.4. 3. 3 S. 9103.4.5 Repeal S. 9163.4.2.4 S. 9163.4.3.1 S. 9163.4. 3.2 S. 9163.4. 3. 3 S. 9163.4.5 Repeal S. 9203.4.4.1 S. 9203.4.4.2 S. 9203.4.4. 3 S. 9203.4.6 Repeal S. 9233.4.4.1 S. 9233.4.4.2 S. 9233.4.4.3 S. 9233.4.6 Section 2. the following Sections are hereby added to Division 9 of the Huntington Beach Ordinance Code and shall read in words and figures as follows : Add S. 9103.3.1 Minimum Open Space : A total open space of 900 sq. it. shall be provided within the rear yard. Said open space may be divided into two areas, each having a minimum area of 450 sq. ft. and minimum dimensions of twenty (20) feet. Said open yard or areas shall not include any type of roofed or enclosed structure. For the purpose of this Section, driveways, driveway easements or open parking areas shall not be considered open space. Add S. 9105.4 Maximum Height of Accessory Buildings : The maximum height of accessory buildings shall not exceed fifteen (15) feet. Add S. 9163.3.1 Minimum Open Space : A total open space of 900 sq. ft. shall be provided within the rear yard. Said open space may be divided into two areas, each having a minimum area of 450 sq. ft. and minimum dimensions of twenty (20) feet. Said open yard areas, shall not include any type of roofed or enclosed structure. For the purpose of this Section driveways, driveway easements or open parking areas shall not be considered open space. Add S. 9165.4 Maximum Height of Accessory Buildings : The maximum heights of accessory buildings shall not exceed fifteen (15) feet. Section 3. the following sections of the Huntington Beach Ordinance Code are hereby amended, and as amended, shall read in words and figures as follows : Amend S. 9103.3 Rear Yard: The minimum rear yard shall be ten (10)feet , except as provided in Sections 9103.4 and 9106.2. Said rear yard shall be subject to all provisions of Section 9103. 3®1, Amend S. 9103.4. 2.2 Architectural Features : Architecutral features, including eaves and fireplaces, may project to within thirty (30) inches of the side lot line and four (4) feet into the required front and rear yard, provided such features maintain a minimum distance of five (5) feet from any portion of any other building on the same lot. In no case shall this provision allow architectural features to encroach closer than thirty (30) inches to any property line. Amend S. 9103.4.2.3 Open Unenclosed Stairways or Balconies : Open unenclosed stairways or balconies, not covered by a roof or canopy, may extend four (4) feet into the required front yard and may extend into the required side yard to within three (3) feet of the property line. However, such stairways or balconies shall maintain a minimum distance of five (5) feet from any portion of any other building on the same lot. Amend S. 9105 Accessory Buildings : The 'total aggregate floor area of all accessory and main buildings shall not exceed the maximum percentage of lot coverage as provided in S. 9102.4. Amend S. 9105. 3 Setback of Accessory Buildings : (a) Front Yard: No detached accessory building shall be located closer to the front lot line than a distance of fifty (50) feet. This regulation shall not prohibit accessory buildings in the rear one- half of such lot, nor shall it prohibit detached garages from locating in the front one-half of a lot, provided said lot does not exceed 150 feet in length. (b) Side Yard: The minimum side yard for detached accessory buildings shall not be less than that required by -this Ordinance for the main building. (c ) Rear Yard: The minimum rear yard for detached accessory buildings shall be five (5) feet. Said rear yard need not be provided when an accessory building abuts an alley. Amend S. 9163. 3 Rear Yard: The minimum rear yard shall be ten (10) feet except as provided in Sections 9163.4 and 9166.5. Said rear yard shall be subject to all provisions of Section 9163.3.1. Amend S. 9163.4.2.2 Architectural Features : Architectural features, including eaves and fireplaces, may project to within thirty (30) inches of the side lot line and four (4) feet into the required front and rear yard, provided such features maintain a minimum distance of five (5) feet from any portion of any other building , on the same lot. In no case shall this provision allow arch- itectural features to encroach closer than thirty (30) inches to any property line. Amend S. 9163.4.2.3 Open Unenclosed Stairways or Balconies : Open unenclosed stairways or balconies, not covered by a roof or canopy, may extend four� (4) feet into the required front yard and may extend into the required side yard to within three (3) feet of the property line. Amend S. 9203.4.1 Within the area bounded by Ocean Avenue on the southwest, Twenty Third Street on the northwest, Palm Avenue on the north and northeast and Lake and First Streets on the east and southeast, the minimum exterior side yard of a corner lot that is 55 feet wide or less shall be five (5) feet® Said five (5) feet shall remain free and clear of all ob- structions except architectural features, fences, walls or hedges. Amend S. 9203.4. 3.2 Architectural Features : Architectural features, including eaves and fireplaces, may project to within thirty (30) inches of the side lot line and four (4) feet into the required front and rear yard, provided such features maintain a minimum distance of five (5) feet from any portion of any other building on the same lot. Amend S. 9233.4.1 (c) Exterior Side Yard: The minimum exterior side yard of a corner lot that is 55 feet wide or less shall be five (5) feet. Said five (5) feet shall remain free and clear of obstruc- tions excepting architectural features, fences, walls or hedges. (d) Rear Yard: The minimum rear yard shall be four (4) feet. Said four (4) feet shall remain free and clear of obstructions as described in Section 9233.4. 3. 3. Amend S. 9233.4.3.2 Architectural Features : Architectural features, including eaves and fireplaces, may project to within thirty (30) inches of the side lot line and four (4) feet into the required front and rear yard, provided such features maintain a minimum distance of five (5) feet from any portion of any other building on the same lot.
