STATEMENT OF ISSUE:.
Transmitted for your consideration is Code Amendment No. 87-9'which adds provisions to
the Huntington Beach Ordinance Code to regulate retaining walls,'industrial fencing and .
screening walls, .and amends the definition of rear yard. The Code Amendment was
reviewed and approved by the Planning Commission on November 3, 1987. At the City
Council meeting of April 18, 1988, staff was"requested to clarify and make minor changes
to the proposed ordinance. Minor_revisions include sentence structure and clarification
and have been incorporated into Ordinance No. 2941.
RECOMMENDATION:

FINDINGS FOR APPROVAL:
1. Reorganization of Article 977 creates a more systematic format for implementation.
2. Revisions to Article 977 create more aesthetically pleasing fences which will have
less detrimental effect on surrounding properties.
3. Revisions to Article 977 are in conformance with the General Plan; in particular,
the Land Use and Open Space Elements.
Staff recommendation is identical to that of the Planning Commission.

ANALYSIS:
Minor revisions to the proposed ordinance were requested by the City Council at the
April 18 meeting. The changes include addition of "setback" to 5.9771(c) and restructure
of sentences in 5.9771(g) for uniformity. The terms "natural grade", "hedge" and
"retaining wall' are defined below and are proposed to be included in Article 908 at a
later date.
Included in Code Amendment No. 87-9 are six changes and additions as follows: (1)
reorganization of Article 977 format into four sections; (2) maximum fence height within
the 15 foot rear setback on through lots; (3) change in method of determining fence
height; (4) separating wall requirements for residential abutting open or public property
and residential abutting commercial, office, or industrial; (5) adding industrial fencing
regulations; and (6) definition of rear yard. Each of these amendments is discussed below
for your review and comment.
Format
Article 977, Yards and Fences, is proposed to contain four sections outlining provisions,
permitted fencing, required fencing, and street intersection visibility. Within the
permitted fencing section are the regulations pertaining to retaining walls.
Rear Yard Abutting a Street
Currently, the Huntington Beach Ordinance Code requires that a rear yard abutting a
street be subject to the same setback requirements of a front yard. Staff proposes that
this restriction not be applied to lots abutting arterials, Section 9771(c). Planning
Commission recommends a maximum of 42 inch fence or retaining wall be permitted
within the rear setback area on through lots. Also proposed is a provision to allow a
maximum of 2 feet of fill and a retaining wall with 6 feet decorative masonry wall,
Section 9771(g)(2), on the rear yard property line abutting an arterial. Staff proposes this
be further amended to include exterior side yards abutting arterials.
Fence Height Measurement
Currently S.9770(i) allows the fence height to be measured from either side of the wall
and does not include the retaining portion. Staff proposes the retaining portion should be
included into the overall height when a property owner proposes to create an artificial
grade. Deviations to the maximum height may be permitted subject to approval of a use
permit and findings of compatibility with the neighborhood would be necessary. This
approach would preclude construction of any fence over 6 feet in height on artificially
created sites (i.e. Huntington Harbour, Pacific Ranch).
Residential Adjacent to Open/Public Land or Office, Commercial, Industrial
Presently, S.9770(g) requires a block wall when adjacent to open/public land. The
definition of open or public land includes the harbor channels, golf courses, schools, etc.
and, therefore, block walls are required. It was obviously not intended to "require" solid
fencing adjacent to these areas when desired. An open fence is sometimes more desirable
and should be an option. This section is also coupled with a requirement for residential
property to be separated from office, commercial, or industrial by a block wall.

Industrial Fencing
Staff proposes to include the fencing and screening requirements of Article 951, 953, and
955 (Industrial Districts) in Article 977. During the future code consolidation of the three
industrial regulations, the fencing sections will be omitted to eliminate repetition.
Rear Yard Definition
Staff recommends that the rear yard definition(S.9080.137) be amended to require front
yard setback requirement for rear yards when abutting a street with front yards on
opposite side. This would allow walls along rear yards of residences abutting arterial
highways. Presently this section precludes lots adjacent to arterials to have any fencing
on the rear yard property line.
Other Definitions
This proposed ordinance includes terms "natural,grade", "hedge", and "retaining wall',
which are proposed to have the following definitions and be included into Article 908,
Definitions, at a later date.
Grade, natural is the surface of the ground or pavement at a stated location as it exists
prior to disturbance in preparation for a project regulated by this code.
Hedge is a plant or series of plants, shrubs or other landscape material so arranged as to
form a physical barrier or enclosure.
Retaining wall is a structure designed to protect grade cuts or retain the fill of dirt, sand
or other grading material.
ENVIRONMENTAL STATUS:.
Code Amendment No. 87-9 is categorically exempt from the provisions of the California
Environmental Quality Act.

AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY
AMENDING ARTICLE 977 RELATING TO YARDS AND
FENCING AND SECTION 9080 . 137 REAR YARD DEFINITION
(CODE AMENDMENT NO. 87-9 )
The City Council of the City of Huntington Beach does ordain
as follows :
SECTION 1 . The Huntington Beach Ordinance Code is hereby
amended by amending Chapter 977 to read as follows:
ARTICLE 977
YARDS AND FENCING
Section:
9770 General Provisions
9771 Permitted Fences "Walls, and Hedges
9772 Required Walls
9773 Street Intersection Visibility
9770 General Provisions . No portion of a required yard area
provided for a structure on a lot shall be considered as part of
the yard area for any other structure on the same or an adjacent
lot . In all districts, minimum setback lines shall be measured
from the ultimate right-of-way line. Diagrams A and B are hereby
adopted to illustrate the provisions of this article . Where any
discrepancy occurs between the diagrams and the printed text , the
text shall prevail . Yards and fencing shall comply- with the
following criteria in all districts or as specified:
9771 Permitted Fences, Walls and Hedges .
( a ) Fences, walls or hedges a maximum of forty-two (42 )
inches in height may be located in any portion of a lot, including
the required front yard, except as required elsewhere in this
Article.
(b) Fences, walls or hedges a maximum of six (6 ) feet in
height may be located on the property line in required side and
rear yards , except as further excluded in this article . Fences ,
walls or hedges exceeding six ( 6 ) feet in height shall observe the
same yard requirements as the main structure except as provided
for herein or in the regulations of the district in which they are
located.
(c) Fences or walls in the rear yard setback area of a
through-lot shall not exceed 42 inches in height . This

sub-section shall not apply to lots abutting arterial highways . .

' (d )In the R1 district., garden or wing walls or fences equal
;•.: in height to the first floor double plate, but not exceeding nine
(9 ) feet , which are perpendicular to and entirely within a side
yard may be constructed .to the interior side property line and to
within five (5 ) feet of the exterior side property line provided
they are equipped with a three ( 3 ) foot gate or accessway.
( e ) When residential property abuts open or public land or
property zoned or used for office, commercial , or industrial
purposes, an eight foot high solid masonry or block wall may be
constructed on the common side or rear property line.
( f ) In order to allow variations in the street scene in R1 ,
R2 , R3 and R4 districts, fences, walls or hedges exceeding
forty-two (42 ) inches in height may be permitted at a reduced
front setback of six ( 6 ) feet subject to plan review approval by
the director in conformance with the following criteria:
( 1 ) The reduced setback shall be only permitted for
five (5 ) or more contiguous lots under the same ownership and only
at the time of initial construction of the dwellings .
(2 ) Such walls shall conform to all other provisions of
this article, including site angle requirements , and shall not
3 encroach into the triangular area formed by measuring seven and
a one-half ( 7 .5 ) feet along the driveway and ten ( 10 ) feet along the
front property line at their point of intersection .
(g ) Retaining Walls shall comply with the following :
( 1 ) Where a retaining wall is located on the property
line separating lots or parcels and protects a cut below the
natural grade, such retaining wall may be topped by a fence, wall
or hedge of the same height that would otherwise be permitted at
the location if no retaining wall existed .
( 2 ) Where a retaining wall is on the property line of a
rear yard abutting an arterial or exterior side yard and contains
a fill of 2 ft . or less or protects a cut below the natural grade,
such retaining wall may be topped with a six (6 ) ft . decorative
masonry wall .
( 3 ) Where a retaining wall is on the property line of a
rear yard abutting a local street , the maximum retaining wall
height shall be 24 inches as measured from the adjacent curb and
may be topped with a maximum 18 inch decorative wall or fence for
a total height of 42 inches .
,• ( 4 ) When the retaining wall is on the front property
line and contains a fill of two ( 2 ) feet or less , a protective
`.` fence not more than forty-two (42 ) inches in height may be erected
at the top of the retaining wall , and any portion of such
protective fence shall be fifty (50 ) percent open or transparent .

Any fence located on the front property line shall be approved by
the Department of Public Works .
( 5 ) All retaining walls abutting a street shall be
waterproofed to the satisfaction of the Department of Community
Development .
( 6 ) Retaining wall and fence combinations over eight (8 )
feet in height shall be constructed with . a variation in design or
materials to show the distinction . Retaining wall and fence
combinations over six ( 6 ) feet in height shall be designed without
decorative block or cap block , except if equal in strength to the
main portion of the fence.
(h) The height of a fence shall be measured from natural
grade except as provided herein.
( i ) In the industrial districts, nine ( 9 ) foot high fences
may be permitted in the side and rear setbacks up to the front
building .line subject to plan review approval by the director .
( j ) Deviations from the maximum height requirements for
walls as prescribed by this Article may be permitted subject to an
approval of Use Permit .
s 9772 Required Walls .

n ( a) When office, commercial or industrial uses abut property
zoned or used -for residential , a six (6 ) foot high solid six ( 6 )
inch concrete block or masonry wall shall be required. If a wall
meeting these standards already exists on the abutting residential
property, protection from vehicle damage shall be provided by a
method approved by the director . The maximum fence height shall
be eight (8 ) feet at the common property line, subject to the same
design standards and setback requirements as specified for six ( 6 )
foot high fences .
(b) Industrial screening walls abutting arterial highways
shall be architecturally compatible with surrounding properties,
constructed of a minimum six (6 ) inch wide decorative masonry
block , and designed with landscape pockets at thirty-five foot
intervals along the street side sufficient in size to accommodate
at least one ( 1) 15-gallon tree . Approval of a Use Permit shall
be required prior to construction. of such walls .
9773 Street Intersection Visibility .
(a) On reverse corner lots and corner lots abutting an
alley, no fence, wall or hedge greater than forty-two (42 ) inches
in height may be located within the triangular area formed by
measuring ten (10 ) feet from the intersection of the rear and
exterior side property lines.

(b) If vehicular access to a lot is obtained from an alley,
the triangular area formed by measuring seven an one-half (7 .5 )

feet from the intersection of the alley and . driveway shall be
limited to fences , walls or hedges no greater than forty-two
; .3 . inches in height.
( c) On corner lots, no fence, wall, landscaping, berming,
sign, or other visual obstruction between forty-two (42 ) inches
and seven (7 ) feet in height as measured from the adjacent curb
elevation may .be located within the triangular area formed by
measuring twenty-five (.25 ) feet from the intersection of the front
.and exterior side property lines or their prolongation . trees
trimmed. free of branches 'and foliage so as to maintain visual
clearance below seven (7 ) feet shall be permitted .

SECTION 2 . The Huntington Beach Ordinance Code is hereby
amended by amending Section 9080 . 137 to read as follows:
9080 . 137 Yard, rear. A yard extending across the full width
of the lot between the side lot lines and measured between the
rear lot line and the nearest rear line of the main building or
the nearest line of any enclosed or covered porch . . Where a rear
yard abuts a street or is adjacent to or facing a front yard of
residentially zoned property, it shall meet front yard
. requirements of the district; excepting walls and fences and R1
zoned property abutting arterial highways .

apply to lots abutting arterial highways.
ff4 (d) In the R1 district, garden or wing walls or
fences equal in height to the first floor double plate, but not
exceeding nine (9 ) feet, which are perpendicular to and entirely
within a side yard may be constructed to the interior side
property line and to within five (5 ) feet of the exterior side
property line provided they are equipped with a three (3 ) foot
gate or accessway.
(e) When residential property abuts open or public land or
property zoned or used for office, commercial, or industrial
purposes, an eight foot high solid masonry or block wall may be
constructed on the common side or rear property line.
U1 (f ) In order to allow variations in the street
scene in R1, R2, R3 and R4 districts, fences, walls or hedges
exceeding forty-two (42 ) inches in height may be permitted at a
reduced front setback of six (6 ) feet subject to plan review
approval by the director in conformance with the following
criteria:
( 1 ) The reduced setback shall be only permitted for
five (5 ) or more contiguous lots under the same ownership and only
at the time of initial construction of the dwellings .
(2 ) Such walls shall conform to all other provisions of
this article, including site angle requirements, and shall not
encroach into the triangular area formed by measuring seven and
one-half (7 .5 ) feet along the driveway and ten (10 ) feet along the
front property line at their point of intersection.
(g) Retaining Walls shall comply with the following:
(1) Where a retaining wall protects a cut below the
natural grade, and is located on the line separating lots or
parcels, such retaining wall may be topped by a fence, wall or
hedge of the same height that would otherwise be permitted at the
location if no retaining wall existed.
(2 ) Where a retaining wall is on the property line of a
rear yard or exterior side yard abutting an arterial and contains
a fill of 2 ft. or less or protects a cut below the natural grade,
such retaining wall may be topped with a six (6 ) ft . decorative
masonry wall .
(3 ) Where a retaining wall is on the property line of a
rear yard abutting a local street, the maximum wall height shall
be 24 inches as measured from the adjacent curb.

(4 ) When the retaining wall is on the front property
line and contains a fill of two (2 ) feet or less, a protective
fence or wall not more than forty-two (42 ) inches in height may be
erected at the top of the retaining wall, and any portion of such
fence above the maximum height as measured from the adjacent curb
shall be fifty (50 ) percent open or transparent. Any fence
located on the front property line shall be approved by the
Department of Public Works.
(5 ) All retaining walls abutting a street shall be
waterproofed to the satisfaction of the Department of Community
Development .
W (h) The height of a fence AAA shall be

Retaining wall and
fence combinations over eight (8 ) feet in height shall be
constructed with a variation in design or materials to show the
distinction. Retaining wall and fence combinations over six (6 )
feet in height shall be designed without decorative block or cap
block, except if equal in strength to the main portion of the
fence.
( i ) In the industrial districts, nine (9) foot high fences
may be permitted in the side and rear setbacks up to the front
building line subject to plan review approval by the director .
( j ) Deviations from the maximum height requirements for
walls as prescribed by this Article may be permitted subject to an
approval of Use Permit.
9772 Required Walls .

uses abut property zoned or used for residential, a six (6 ) foot
high solid six (6 ) inch concrete block or masonry wall shall be
required . If a wall meeting these standards already exists on the
abutting residential property, protection from vehicle damage
shall be provided by a method approved by the director. The
maximum fence height shall be eight (8 ) feet at the common
property line, subject to the same design standards and setback
requirements as specified for six (6 ) foot high fences .
(b) Industrial screening walls abutting arterial highways
shall be architecturally compatible with surrounding properties,
constructed of a minimum six (6 ) inch wide decorative masonry
block, and designed with landscape pockets at thirty-five foot
intervals along the street side sufficient in size to accommodate
at least one (1) 15-gallon tree. Approval of a Use Permit shall
be required prior to construction of such walls.

9773 Street Intersection Visibility.
X¢X (a) On reverse corner lots and corner lots abutting an
alley, no fence, wall or hedge greater than forty-two (42 ) inches
in height may be located within the triangular area formed by
measuring ten (10 ) feet from the intersection .of the rear and
exterior side property lines .
X01 (b) If vehicular access to a lot is obtained from an
alley, the triangular area formed by measuring seven an one-half
(7 .5 ) feet from the intersection of the alley and driveway shall
be limited to fences, walls or hedges no greater than forty-two
inches in height .
X¢X (c) On corner lots, no fence, wall , landscaping,
berming, sign, or other visual obstruction between forty-two (42 )
inches and seven (7 ) feet in height as measured from the adjacent
curb elevation may be located within the triangular area formed by
measuring twenty-five (25 ) feet from the intersection of the front
and exterior side property lines or their prolongation. trees
trimmed free of branches and foliage so as to maintain visual
clearance below seven (7 ) feet shall be permitted .

SECTION 2 . The Huntington Beach Ordinance Code is hereby
amended by amending Section 9080 . 137 to read as follows :
9080 . 137 Yard, rear . A yard extending across the full width
of the lot between the side lot lines and measured between the
rear lot line and the nearest rear line of the main building or
the nearest line of any enclosed or covered porch. Where a rear
yard abuts a street or is adjacent to or facing a front yard of
residentially zoned property,. it shall meet front yard
requirements of the district; excepting walls and fences and R1
zoned property abutting arterial highways .
SECTION 2 . This ordinance take effect thirty days after its
passage.

2. 0 GENERAL INFORMATION:
Code Amendment No. 87-9 reorganizes Article 977, Yards and Fences ,
adds provisions to regulate retaining walls, industrial fencing and
screening walls, and ,amends the definition of rear yard
(S. 9080 . 137) . This code amendment was generated by two recent
conditional exception applications approved on July 20, 1987, by the
City Council on appeal. Review and comment by the Planning
Commission of the recommended changes is requested. Based upon this
input, staff will proceed preparing an ordinance..
3 . 0 ENVIRONMENTAL STATUS:
Code Amendment No. 87-9 is categorically exempt from the provisions
of the California Environmental Quality Act.
4 . 0 ISSUES AND ANALYSIS:
The City Council upheld the Planning Commission' s approval of two
variance requests before them on July 20, 1987, regarding the
construction of a retaining wall over six. feet in height along the
rear yard property line which are subject to the 15 foot front yard
setback. The approvals allowed a maximum eight foot high retaining
wall along the rear yard property line and any .additional fencing
may be. constructed in accordance with Resolution. No. 1381,

Alternative A or B (attached) . After further analysis, staff has
prepared a code amendment to allow a maximum 42 inch high retaining
wall on the rear yard property line and any additional fencing be
setback fifteen feet (new .S. 9771(g) (4) .
Included in Code Amendment No. 87-9 are other changes and additions
as follows : (1) reorganization of Article 977 format into four
sections; (2) change in method of determining fence height; (3)
separating wall requirements for residential abutting .open or public
property and residential abutting commercial, office or industrial ;
(4) adding industrial fencing regulations,; and (5) definition of
rear yard. Each of these amendments are discussed below for your
review and comment .
Format
Article 977, Yards and Fences, is proposed to contain four sections
outlining provisions, permitted fencing, required fencing, and
street intersection visibility. Within the permitted fencing
section are the regulations pertaining to retaining walls .
Fence Height
Currently 5. 9770(i) allows the fence height to be measured from
either side of the wall and does not include the retaining portion.
Staff recommends that any retaining wall proposed to contain
imported fill dirt be included in maximum height measurements except
as. provided. Deviations to the maximum height may be permitted
subject to approval of a use permit and findings of compatibility
with the neighborhood would be necessary.
Residential Adjacent to Open/Public Land or Office. Commercial.
Industrial
Presently, 5. 9770(g) requires a block wall when adjacent to
open/public land. The definition of open or public land includes
the harbor channels, golf courses, schools, etc. and, therefore,
block walls are required. It was obviously not intended to
"require" solid fencing but rather "allow" solid fencing adjacent to
these areas when desired. An open fence is sometimes more desirable
and should be an option. This section is also coupled with a
requirement for residential property to be separated from office,
commercial, or industrial by a block wall .
Industrial Fencing
Staff proposes to include the fencing and screening requirements of
Article 951, 953, and 955 (Industrial Districts) in Article 977.
During the future code consolidation of the three industrial
regulations, the fencing sections will be omitted to eliminate
repetition.

Staff recommends that the rear yard definition (S.9080 . 137) be
amended to require front yard setback requirement for rear yards
when abutting a street with front yards on opposite side. This
would allow walls along rear yards of residences abutting arterial
highways . Presently this section precludes lots adjacent to
arterials to have any ,fencing on the r•ear' yard property line.
5 . 0 RECOMMENDATION:
Staff recommends that the Planning Commission continue Code
Amendment No. 87-9 and direct staff to prepare an ordinance based on
Planning Commission comments .

A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF HUNTINGTON BEACH ESTABLISHING
THE DESIGN -CRITERIA FOR REAR BLOCK WALLS ON
DOUBLE FRONTAGE LOTS .IN HUNTINGTON HARBOUR
WHEREAS, there are double frontage lots within the Huntington
Harbour area of the City where a significant grade differential
necessitates construction of retaining wall and fence combinations
over six feet in height, within the rear yard setback adjoining a
public street, and
WHEREAS, the Planning Commission has found that currently
permitted retaining wall and fence combinations over six feet in
height are aesthetically undesirable, and
WHEREAS, the purpose for which the retaining walls are intended
can be attained in a manner that is compatible and harmonious with
surrounding land uses,
NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission
states that Staff Alternative A and B per attachment shall be the
standard for construction of retaining wall and fence combinations
over six feet in height in the rear yard setback adjoining a public
street.

1. 0 ANALYSIS•
Code Amendment No. 87-9 was continued from the October 6, 1987
Planning Commission meeting with direction to forward copies of the
proposed ordinance to several interest groups and homeowner ' s
associations as well as those persons who spoke during the public
hearings relating to variances for block walls on through lots in
the Harbor area. Any comments received will be forwarded to the
Planning Commission.
At the October 6, 1987 Planning Commission meeting, comments from
the Commission were received as follows:
a . Include definition for Retaining Walls . The Uniform Building
Code (UBC) which has been adopted by the City in the Municipal
Code defines a retaining wall as "a wall designed to resist the
lateral displacement of soil or other materials" (see attached) .
b. Retaining Wall Height . Currently the Huntington Beach
Ordinance Code allows retaining wall height to be excluded in
the measurement of wall height . Staff proposes the retaining
portion should be included into the overall height when a
property owner proposes to create an artificial grade. This
approach would preclude construction of any fence over 6 feet
in height on artificially created sites (i .e. Huntington
Harbour, Pacific Ranch) without approval of a use permit and
findings of necessity and lack of detriment to surrounding
properties . (Slides of these areas may be viewed at the public
hearing. )

C. Rear Yard Abutting a Street. Currently, the Huntington Beach
Ordinance Code requires that a rear yard abutting a street be
subject to the same setback requirements of a front yard.
Staff proposes that this restriction not be applied to lots
abutting arterials, Section 9771(c) . Also proposed is a
provision to allow a maximum of 2 feet of fill and a retaining
wall with 6 feet decorative masonry wall, Section 9771(g) (2) ,
on the rear yard property line abutting an arterial . Staff
proposes this be further amended to include exterior side yards
abutting arterials .
2 . 0 RECOMMENDATION:
Staff recommends that the Planning Commission approve Code Amendment
No. 87-9 with the following findings and recommend adoption by the
City Council.
FINDINGS FOR APPROVAL:
1. Reorganization of Article 977 creates a more systematic format
for implementation.
2 . Revisions to Article 977 create more aesthetically pleasing
fences which will have less detrimental effect on surrounding
properties .
3 . Revisions to Article 977 are in conformance with the General
Plan; in particular, the Land use and Open Space Elements.

Continue Code Amendment No. 87-9 to incorporate Planning Commission

9770 General Provisions. No portion of a required yard
area provided for a structure on a lot shall be considered as part
of the yard area for any other structure on the same or an adjacent
lot. In all districts, minimum setback lines shall be measured from
the ultimate right-of-way line. Diagrams A and B are hereby adopted
to illustrate the provisions of this article. Where any discrepancy
occurs between the diagrams and the printed text, the text shall
�,.. prevail . Yards and fencing shall comply .with the following criteria
in all .districts or as specified:
9771 Permitted Fences, Walls and Hedges.
(a) Fences, walls or hedges a maximum of forty-two (42)
inches in height may be located in any portion of a lot, including
the required front yard.

9770 Provisions . No portion of a required yard area
provi3ed for a structure on a lot shall be considered as part
of the yard area for any other structure on the same or an
adjacent lot . In all districts, minimum setback lines shall
be measured from the ultimate right-of-way line. Diagrams A
and B are hereby adopted to illustrate the provisions of this
article. Where any discrepancy occurs between the diagrams and
the printed text, the text shall prevail. Yards and fencing
shall comply with the, following criteria in all districts or as
specified:
(a) Fences, walls or hedges a maximum of forty-two (42)
inches in height may be located in any portion of a lot;

(b) Fences, walls, or hedges a maximum of six ( 6) feet
in height may be located on the property line in required side
and rear yards, except as further excluded in this article.
Fences, walls or hedges exceeding six (6) feet in height shall

uses, a six ( 6) foot high solid six (6) inch concrete block or
masonry wall shall be required . If a wall meeting these
standards already exists on the abutting residential property,

by the director in conformance with the following criteria :
( 1 ) The reduced setback shall be only permitted for
five ( 5) or more contiguous lots under the same ownership and
only at the time of initial construction of the dwellings .
( 2 ) Such walls shall conform to all other provisions
of this article, including site angle requirements, and shall
not encroach into the triangular area formed by measuring seven
and one-half ( 7 . 5) feet along the driveway and ten (10) feet
