My initial advice give-n at the City Council meeting was to consider the abstention as voting with the majority, equaling the requisite number of four votes to adept an ordinance pur- suant to the Huntington Beach City Charter. On fall consideration of the issue, it is my fivm. opinion that the ordinance was not adopted. The Specific requ4.:_ment of ►he H ut`ington Beach Charter is that all ordinances must be adopted by a vote: of four affirmative votes. Since the rule contained in Robert's Rules of Order adopted by the City Council provides for counting an abstaining vote as coinciding witli the maiority (see Robert's Rules of Order No. 46) and is a procedural rule, it is my firm opinion that substantive vote of four affirmative votes contained in the City Charter overrides the procedural rule established by Robert's Rules of Order. Therefore, Ordinance No. 2501 was not adopted. Tf the Council wishes to reconsider this ordInnixe, it will bc: necessary to rodu e t _e ordinance and vote upon it five. days or longer thereafter.
