of initial development. The applicant is attempting to legitimize the
existing use through the proper M1 zoning.
The subject property is designated on the General Plan as a Planning
Reserve. However, on several occasions, the Planning Staff has
recommended a residential designat-.ion for the general area and the
Planning Commission has concurred with this recommended land use.
The implications of the request are thus many and varied .

discontinued. Alternatives to the discontinuation have been explored
by the staff with the conclusions being that the zone change procedure

not provide for any additional industr. i.al development in an area recom-
mended for residential land uses.

Property owners within a 300 foot radius of the subject property were
notified of the requested change of zone . There were no zormnunications
of opposition , either written or oral , at the Planning C►nunission
public hearing. The applicant , Martin F. Kordi.ck , was the only speaker
before the Planning Coromissi.on.

anticipation of long term developments . Howe;-er, it should be
noted by the Planning Commissionthat the Planning Staff has
m recomended a residential designation for the general area and the
Planning Commission has on several occasions concurred with this
recommendation.
As indicated earlier, the site is presently used in conjunction with
an industrially zoned and approved trucking and storage operation.
This M1 zoning was approved by the Planning Commission on October 5 , _
1971 as the General Plan for this area was an industrial designation .
Subsequently, an Administrative Review application was submitted and
approved by the City allowing the development of the storage yard .
Through a combination of developer and city staff oversights, the
storage yard use was expanded onto the adjacent M-0 parcel at the
tim.-- of initial development. The existing RA-0 zoning does not
allow such a use and , therefore , the applicant is attempting to
legitimize the existing use through the proper MI zoning.
The implications of the request are many and varied . A granting of
'he request would provide a legal status for the previously approved
and sanctioned industrial use. If the request is not: granted , that
portion of the industrial use on the RA--0 site would have to be
discontinued . Alternatives to this discontinuation have been explored
by the Planning Staff with the conclusions being that the zone change
procedure is the only solution to the situation . Under the broad
terms of the Planning Reserve designation, the change of zone would
be permitted sinre it is not the intent of this designation to pre-
clide development . Very simply , the implementation of: the M1 zoning
would merely reflect the existing land use and would not~ provide

3. The change .of zone could be considered precedent setting
thereby constraining future planning options in the general
area.
However, the staff feels that there is a logical and viable solution
to. -the 'disadvantages of the rezoning by incorporating these planning
concerns into a "resolution of intent" which would provide that
should the General Plan designate the area for residential use that
the appropriate zoning would be implemented in due course. This
process would allow a rezoning of the: property as requested so that
the industrial use may continue and yet not restrict the City in
the comp7chensive General Plan process for the Area.
5 . 0 Recommendation:
Based on the above analysis, the Staff recommends approval of
Zone Case No. 76-7 with the accompanying resolution of intent
that specifies that should it become necessary because of
€ General Plan land use inconsistencies, the property will further
rezoned to reflect the appropriate zoning.
Should the Planning Commission not concur with this recommended
procedure, the Staff recommends th�� t the ;er�ucsted Lone Case
76-7 be tabled indefinitely pending resolution of the Land Use
Element .
