Thus in complyingwith this consistency . � Y : . requirement, a change of zoning has been proposed for the areas identi- fied on the area maps and which are discussed in the following sections. 2. 1 :. .'1nJECT ZONE CHANGE AREAS Approximately 1.50 acres of existing zoning have been identified as being inconsistent with the Land Use Element. For the purpose of clarity each area is discussed separately. 20 . 0 'ZONE CHANGE 76-26 "A" Area "A" is located rear the northwest corner of Beach Boulevard and Warner Avenue. It is bounded by Starner on the south and on the north by the Orange County Flood Control Channel with an existing apartment complex to the west. T.ie property is presently subdivided into encyclopedia lots (251 x 491 ) . The property is vacant except for an older single family home that fronts on Warner Avenue. Approximately 27 acres of retail commercial property exists at the intersection of Warner and Beach. The General Plan indicated that this amount of commercially designated land is adequate to service the needs of the population within the general area, and therefore the General Plan designated the: property medium density residential . A change in zoning to residential will be compatible with the property lc'+ the west. The Flood Control Channel. provides a separation from the commercial de-velopment north of the subject- property. '`ZONE: CHANGES. 76-26 A - J Page. r ' :5ib ZONE CHANGE 76-26 C Area ."C" is located on the north side of Taylor Avenue approximately 600 :ft.. west of Beach Boulevard. This 7 . 5 acre site is presently zoned Ml-A, restricted manufacturing, and consists of five different -Parcels. The subject property is currently vacant except for four single family homes. An industrial land use survey condu:.-ted by the Planning Department indicates that Area "C" is only marginally suited for industrial development. P1, !ow density residential development, will be compatible with the existing low density residential uses south of Taylor Street and will not over burden the .ieneral area with vehicular traffic. 6. 0 ZONE CHA14GE 76--26 "D" Area "D" is located on the north side of Slaver Avenue approximately 500 ft. west of Gothard Street. This 5 . 36 acre site is bounded on the north by the Huntington Beach City Yard and single family resi•- denees on the west. This site is now vacant and the existing zoning is 191, light industrial. The General Plan designated the subject property as low density residential because of the surplus of _. ndustrial properties in the area and because the soil problems are such °s to preclude high intensity industrial uses . 7 . 0 ZONE CHANGE 7 6-2 6 "E" Area " E" is located on the south aide of Edinger Avenue approximately 500 ft. west of Got:har.d Street . This 1. 46 acre site is pro?iently zoned 141, light industrial . ZONE CHANGE 76-26 "G" Area "G". is bounded on the northwest by Seventeenth Street, on the south by Utica Avenue, and on the east by rake Street. This 12 . 78 acre site is located south of the civic center. R2 zoning on the subject property would provide for the highest &-.)ree of compatibility with the recently adopted G"ensrul Plan land use designation. However, the staff in analyzing this proposed zoning designation has concluded that the present land use characteristics I of the surrounding areas dedicates that the property is more suited to remain as presently zoned. This 1(1-0-CD zoning is consistent with the anticipated zoning/General Plan consistency matrix, in that density categories allow for overlapping zoning potentials when other factors such as land use characteristics Are the determining factor. The staff therefore feels that the existing zoning is the most suitable and would provide for the highest degree of compatibility at the present time. The staff recommends that Zone Change 76-26 "G" be withdrawn. 10. 0 7024E CHANGE 76-26 "H" F.r;• "t " is located on the northeast- corner of Hamilton Avenue and Pr )Kbirst Street. This 9 . 90 acre site abuts the Santa Ana River on Lhe east and the Southern California Edison Substation on the north. The site is -recently vacant of development. R2, medium density residential zoning and development, would allow 148 unites on this site. Adequate schools, recreational facilities and commercial establishments exist within one mile or less of the subject property. The stuff is recommending that a PG, planned development suffix , be added to the proposed R2 zoning . A planned development on this site would help eliminate many of the 43cce s problems that exist. The change of zoning from " commercial to medium density residential is appropriate in light of the .`.large amount of existing commercially designated land use within the j , general area. 12 . 0 ZONE CHANGE 7(-26 "J" Area "J" is located on the south side of Aldrich Avenue and east of Parkside Lane. This 2 . 61 acre area consists of vacant parcels and older single-family units. The properties to the north, west, and east are zoned for retail commercial . The area to the south is shown as medium high density. Aldrich Strret, a local street, provides only fair to poor vehicular access for commercial uses and the property' s location provides fcr extremely poor commercial visual orientation. Medium high density residential, R3, would be compatible with existing residential, units south of the subject property. 13. 0 CONCLUSION Each of these proposed zone changes have been discussed in General Plan Amendment 76-2 . The changes considered in this Amendment 76-2 derive from two source: , requests f,:om property owners and those generated by the Planning Department. 14 . 0 RECOMMENDATION AND P114DI14GS The staff recommends that Zone Change tlo . 76- 26 A, H, C, D, E, F, Ito It J be approved based on the .following findings. 1 . ADDITIONAL INFORMATION: The: Planning Commission held a public clearing on the proposed change of zone on December 7 , 1976. During the public hearing on the matter, Mr. Jim, Foxx one of the property owners involved in the subject area, re-- quested the Planning Commission to place the PD suffix (Planned Resi- dential Development) on all of the properties. The Commission therefore directed tiie staff to notify all property owners of the notential R2 or R2-PD zoni.nq. The matter was continued to January 4 , 1977 , at which time representatives of all affected property owners addressed the Commission. fir. Foxx again requested R2-PD on all properties. Ms . Dora Odom and Mr. David Dahl spoke in opposition to th,? Planned Development Suffix because of the hardchip this type of zoning would impose on the smaller parcels . The Commission concurred that R2 wa., the most appropriate desi-nation and doe- in fact allow a "Planned Development" (Townhouses) to be 'developed if a particular property owner so desires . Therefore , the Commission approved ;:he R2 zoning designation . ENVYRONMENTAL STATUS : Negative Declaration No . 76 -78 was approved by the Council. on Ncvember 15 , 1976 as a part of the General Plan Amendment: process . Plan Amendment 76-2 , Miscellaneous Items, by the Planning Department 'v- with a finding that the project will not have a substantial adverse effect upon the physical envj.ronment. 2..0 GENERAL INFORMATION On November 15, 1976, the City Council adopted General Plan Amend- ment 76--2, Miscellaneous Items, which constituted the fourth amendment ,,. . • to the Phase 1 Land Ilse Element that was adopted December, 1973. This j amendment implemented charges in the land use desigi,ations for numerous sections of the City. Many of, these areas contain present zoning classifications that are ;:icotisi.stent with the. n,�wly ,adopted Land UseMOM i UNK Or `ZONE 'CHANGE 76-26 A• -- J page 2 State Planning Law mandates under AB. 1301 that zoning must be con- sis' :ent with the General Plan. 'Thus, i,n complying with this consistency requirement, a change of zoning has been proposed for the areas identa.-- ;. .` fied on. the area maps and which are discussed in the following sections. 2. 1 SUBJECT ZONE CHANGE AREAS Approximately 150 acres of existing zoning have been identified as being inconsistent with the Land Use Element. For the purpose of 'clarity each area is discussed separately. 3: 0 ZONE CHANGE 76--26 "A" Area "A". is located near the northwest corner of Beach Boulevard and Warner rwenue. It is bounded by ttilarner on the south and s on the north by the Orange County Flood Control Channel with an existing apartment Complex to the west property. The ry era is presently subdivided into P encyclopedia lots (25 ' x 49 ' ) . The property is vacant except L an older single family home that fronts on Warner Avenue. Approximately 27 acres of retail commercial property exists at the intersection of Warner and Beach. The General Plain indicated that this amount of commercially designated land is adequate to service the needs of the population within the general area, and therefore a diem density residential. The Flood Control Channel provides a separation From the commercia' development north of the subject property. Building setbacks, landscaping and wall separation can be used to separate commercial land uses to the east and south from the proposed resi- dential land use within the proposed area . A - 0 ZONE CHANGE 76-26 "B" Area "B" is generally located north of Clay Avenue , east of Goldenwest, Street, south of Garfield Avenue, and west of the Southern Pacific Railroad right-of-way: It also extends north of Garfield Avenue for �. approximately 145 ft. between Stewart Street and Crystal Street. i This area is zoned primarily RA, residential agricultural, with resi- 'dential zoning prevailing along Main Street (R3 , medium high density residential) and the railroad tracks (R2, medlum density residential) .. oil extraction, vacant land , and marginal indut--trial uses and zoning .. The change of zoning from commercial to medium density residential is appropriute ' in light of the > . ; large amount of existing commercially designated land use within the general.'area. 12 . 0 ZONE CHANGE 76-26 "J" Area "J" is located on the south side of Aldrich Avenue and east of 'Parkside Lane. This 2 . 61 acre area consists of vacant parcels and older single-family units. The properties to the north , west, and east are zoned for retail conr,ercial. The area to the south is shown as medium high density. Aldrich Street, a local street, provides only fair to poor vehicular access for commercial uses and the property' s Location provides for extremely poor commercial visual orientation. Medium high density residential, R3, would be compatible with existing residential units south of the subject property. 13 . 0 CONCLUSION Each of these proposed zone changes have been discussed in General j Plan Amendment 76-2 . . The changes considered in this Amendment. 76-2 derive from two sources , requests from property owners and those generated by the Planning Department. 14 . 0 RECOMMENDATION AND FINDINGS The staff recommends that Zone Change No. 76--26 A, B, C, D, E, £, H; I, J be approved based on the following findings. 1. Staff Planning Law mandates that zoning shall be consistent with the City' s General 'Plan. 2 . The subject properties axe no longer suited for development cinder their present zonings. 3 . The proposed changes of zoning will provide for more compatible land uses for each of the surrounding areas.
