Surrounding residential development patterns obviated a medium density
residential designation in that it would be the best transitional
zoning between the industrial uses to the south and the. single family
homes . to the north. Therefore , the requested R2 zoning is consistent
with the City ' s General Plan.
As the General Plan noted, the property possesses topographic
constraints in that a natural Swale runs through a significant portion
of the property . Development of the property should be of a type
which would utilize these constraints and minimize the potentially
significant grading operations. This can be accomplished through an
apartment complex type development as would be mandatory under the R2
zone and the present configuration of the parcel . The Planning Commission
concurred on this stipulation and therefore , recommended that second
reading of the ordinance be withheld by the Council until such time as
an apartment complex development has been approved by the appropriate
board or commission.
ADDITIONAL INFORMATION:
The Planning Commission held a public hearing on the re(luest:ed change
of zone at its meeting of October 4 , 1977 . Mr. Morrie Nickle, repre-
senting Classic Development, addressed the Commission and spoke in
favor of the proposal. Mr . Dennis Graham, a homeowner to the north
of the subject site, addressed the "ommission and questioned the im-
pact the future residential development would have on the area ' s
schools . There was no one else present who addressed the Commission
on the matter.

SOUTH SIDE OF ELLIS AVENUZ WEST OF DELAWARE STREET
STATEMENT OF PROBLEM:
Second reading end adoption of Zone Change 77--17 was tabled until
such time as plans for residential development on the subject,
property had been reviewed by the Planning Commission to insure
that a comprehensive apartment complex would be built.
RECOMMENDED ACTION :
Proceed with the second reading of Ordinance No. 2238 enacting
a change of zone from Ml-A (restricted manufacturing district)
to R2 (medium density residential district) .
ANALYSIS :
Classic Development Corporation submitted Use Permit No . 77-98
for the construction of a 104 unit apartment complex . On
January 17 , 1978 , the Planning Commission reviewed plans for
the project and 'unanimously concurred that the subject development
was in line with the objectives of insuring that a complex would
be built at this location.
On January 18 , 1978 , the Board of Zoning Adjustments approved
the apartment complex with the condition that building permits
could not be issued until the effective date of the zone- change
ordinance.
ALTERNATIVES :
Second reading and adoption of Ordinance No. 2238 cotil.d be
tabled further if the Council wishes to review any portion of
the, plan in further detail.
