the Ca1 . Trans surplus freeway properties and other affected properties to
interim zoning designations that would allow time for a comprehensive
analysis of the properties that in turn would lead to long range planning
decisions.
: 3. 0 SURROUNDING LAND USES AND ZONING:
Area A is primarily surrounded by medium density resi,denti.al uses coi.-
sisting of 4-piex type developments .
Area B fronts onto Pacific Coast Highway and exter..ds northerly to the
Orange County Flood Control Channel . To the west of this site is the
Edison Plant:, to the north are developed R1 properties and the Orange
County Sanitat:ioit District , and the Santa Ana River is to the east.
Area C is surrounded to the cast by developed commercial property and to
the north by vacant commercial. property. To the west is property zoned
for a medium density planned residential development and a developed
mobilehome park. South of the site is va,:ant property zoned RA•-0 .
Area D is surrounded to the 4-rest by an OXiStil)(1 Illobile.hotne park , to the
north is vacant: R2-rPD prop,.rr. ty , to the south is tho Beach , and to rile

A previous background report on these state owned properties provided
the following information:
I .
.. Area A is located approximately 350 feet south of Yorktown Avenue on
the west side of Delaware Street and is comprised of approximately 1. 8
acres . The property is presently general planned as medium density
" residential and is zoned 112--0 . The City has been actively negotiating
with the State Department of Transportation in an effort to acquire
the property as a parr- of the permanent Old 'Town park site. These
negotiations have recently resulted in price comrtti.tments from both
the Stare and the City. Therefore , the site should ultimately be
developed as a community facility and will be designated as such on
the zoning maps.
Area 8 is located on the north side of. Pacific Coast: Highway between
Magnolia Street and the Santa Ana River . The property is general
planned as a planning reserve but is presont:ly zoned fly (office profes-
sional) . The California Coastal Commission' s plan for these properties
has indicated a restoration potential as a wetlands area and therefore
have been identified as a possible r)cqui.siti.on site by the State .
Additionally, the City ' s Public Works Department has indicated a need
for additional right-of-way for various street projects within the
subject area .
Area C is located at the southeast corner of 13r each 13oulevar.d and Atlanta]

FINDINGS :
1. The proposed interim zoning will .insure comprehensive planning on
the propert.iesywhich is necessary as a result in the change of their
development status .
2 . The proposed interim zoning will allow an opportunity to analyze
the sites for the most appropriate loncl range zoning based on the
unusual size, shaiie , and r,rienu;tion of the sites which resultec.
from the deletion of the freeway rights-of---way .

Gentlemen:
., As the. owner of 46 plus acres in Zone 111311 , plus the fact~ that I
am presently exercising my right to repurchase the 38 . 5 acres
heretofore condemned for state highway purposes , ray prevent
schedule is in conflict with the scheduled public hearing date
of ,May 3 , 1977 . Therefore, I will not be able to attend to
r; voice my objection to the proposed "down zoning" as is more fully
set out in the application of April 5 , 1977 .

7 . That the acts of the planning staff as expressed in the
application of April 5 , 1977 , is nothing short of out-
rageous conduct and :�ureaucratic abuse .
I readily acknowledge that it has long been the rule that zoning
is a proper exercise of the police power of the state and that
the power to zone can be exercised by the legislature or by the
municipalities to which the power may be delegated .
Furi:her , I am aware that governmental restrictions on the use of
private
__ property can be imposed, however, only if they bear a
su5stantial relationship to the preservation of the public health,
safety, morals or general welfare . As such, I respectfully suggest
that perhaps this Commission and its individual members are over-
looking the serious question of Constitutional Limitations assuming
that you follow the staff reeommcn at onn and pass t+E application
,with certainty.
I strongly urge: that consideration along these lines be given as
to the new "down zoning" called LUD, Zone Case No. 77-3 , Area "n" .

The Planning Commission recommends approval of Negative Declaration
No . 77--54 and Zone Change No. 77--3 "A -- D" .
SUMMARY ANA%tYSIS :
Zone Change No. 77-3 "A - D" was initiated by the Planning Department
at the direction of the Planning Commission. This direction was given
with the intent being to rezone the remaining State surplus freeway
properties and other affected properties to interim zoning desigrations

such properties exist within the City and will be offered for sale in
the near future . An inventors and analysis of these properties has
resulted in a number of concerns on the part of the Planning staff .

Area B is located on the north side of Pacific Coast Highway between
Magnolia Street and the Santa Ana River. The property is. general
planned as a planning reserve but is presently zoned R5 (office pro--
fessional) . The California Coastal Commission ' s plan for these properties
, has indicatedA restoration potential as a wetlands area .and therefore
have bean identified as a possible acquisition site by the State.
Additionally , the City ' s Public Works Department has indicated a need
for additional right--of-way for various street projects within the
subject area.
Area C is located at the southeast corner of Beach Boulevard and Atlanta
Avenue, extending southerly fur approximately 1934 feet. The site
presently is general planned and zoned for commercial and retail uses .
jt However, the unusual size and shape of the property will raise several
i development issues both relating to land usage as well as vehicular
access.
Area D is located at the northwest corner of Beach Boulevard and Pacific
Coast Highway. It is general planned as mixed commercial developmer.::.
i' and zoned C3 . Development of the property as it presently ex .sts could
eliminate future land use alternativ s since it would impact access to
the adjacent properties and could result in an undesirable type of de-
velopment because: of the size and shape of the property.
The Planning Commission, as a result of considering the development problems
that could result from the present zoning Ion these surplus properties ,
' approved. the interim zoning designations and recoatmends approval by the
City Council so as to allow further long range planning analysis .
ADDITI01iAL INFORMATION:
The. Planning Commission held public hearings on all four areas of the
' re::one . An attorney for a Ms . Daisy E . Hurley Thorpe , who is the owner
of approximately 46 acres within Area B, addressed the. Commission and
referred to a letter submitted in May of 1977 . This letter (which is
' attached) stated opposition to the proposed rezoning. The Planning
Commission reviewed this letter and requested a legal opinion on its
contents (see attached) . A Mr. Mike Hannah, State :)epartment of Trans-r
poration, also addressed the Commission on Area B, and stated that he
felt changing the zoning at this time would be inappropriate.
Subsequent to the Planning Commission 's action, the planning staff has been
compiling the necessary information for preparation . of the c,:rdinances of
fectuating the change of zone. This process has been time crwnsuming in
that 'legal descriptions had to be derived from irforma -ion contained b}►
the State Department of Transportat.i.on. - This accounts . for the. delay
kron the Planning 'Commission public hearing process and t-„i hearing to be
held by the City Council on December 12 , 1977.

ENVIRONMENTAL STATUS :
The .Planning Commission at its meeting of May 3 , 1977 , granted Negative
Declarati'on . N6. . 37-54 , having. found that the proposed project will . not
I have. a significant adverse effect upon the environment. The Commission,
recommends approval by the City Council of Negative Declaration No. 77--54 .
