I . :.The staitf has also readvertised this zone change and has included a "Q'' suffix which wi11 allow the Planning Commission to condition the zone . change in order to assure a specific development on this site. The.'staff. has reviewed the conceptual plan that was submitted with the proposed zone change for a five unit development and has identified several deficiencies that would occur if the subject property were developed as a planned residential development under Article 931 or 936. These deficiencies include minimum open space requirement of 10,,000 square feet, recreational amenities , private access widths of: less than 24 feet minimum, and all structures being a minimum of three stories. If the Planning Commission elects to approve Zone Change No. 78-19, it should keep in mind that a special permit will have to be granted in order to allow residential development of this nature on subject site. Attached is a schematic site plan and statistical background prepared by the developer for the Commission ' s review and consideration . Also included in this memo are findings that the Planning Commission can use if it so desires to approve Zone Change No. 78-19 . FINDINGS: 1 . A 0 ENVIRONMENTAL STATUS : hitisuant to the environmental regulations in effect at this time, the Planning Department posted tentative Negative Declaration No. 78-109 for 10 days in the office of the City Clerk. The posting period ran between October 12 , 1978 and October 23 , 1978 . It was also published in the Huntington Beach News at the same time. All comments received either in writing or oral have been attached to this report in addition to the applicant' s response to these comments , also attached. In addition, the Planning Department has drafted Negative Declaration No. 78-109 which is also attached f�:r the Planning Commission ' s review as requiredby Se►:tion 15083 (e) (4 ) of the State Guidelines of the California Environmental Quality Act. The initial study information is attached to the Negative Declaration as documentation in support of the findings . Prior to action on this zone change , it is necessary for the Planning Com- mission to receive and review comments on and adopt Negative Declaration, '. The , applicant has indicated to. the staff that, should the rezoning efforts be .successful, a planned residential. development would be pur sued. oh � he property. The staff has analyzed such a concept on this site and has determined that compliance. with the PRD .standards will be difficult, to. accomplish. This is based on the. fact that open space and recreational facilities would be impossible to achieve on a site of this size. Both the staff and " Planning Commision have on numerous occasions expressed. concern on the viability of small planned residential developments. The staff on . previous occasions has considered the .possibility. of an apartment complex based on the R2 or R3 zoning and determined that similar problems encountered in small planned residential developments would also be present. lhe *property is presently zoned C4 which allows virtually all tYpes .of commercial development including General Retail and Office Professional. The "surrounding properties to the south, southwest, and southeast are developed as commercial uses . The subject site, because Df its water orientation, could provide incentive for either an upgrading and/or expansion of the adjacent commercial restaurant facility. The proposed development is gene:.-ally compatible with the General Plan for either residential or commercial development. However, because the project site lies entirely within the Coastal Zone, it will be affected by the local coastal planning efforts underway at the direction of the Coastal Act of 1976 . Upon certification by the Coastal Commission, the Local Coastal. Plan will supersede all previous plans for this area. Though ,,-work on the Local Coastal Plan is underway, a Coastal Element to the General Plan is not anticipated prior to April, 1979 . The issue of consistency with th? General Plan is one the staff feels can be determined in a positive manner because of the relatively small .size of. the parcel and the fact that the Land Use Element designates the potential of either residential or commercial land uses. Therefore, since either land uses can be- considered - consistent, a precise. zoning determination must be made based c:ii the more technical issues as dis- cussed above. The staff' s conclusions are that the requested change of zone, while consistent with the General Flan, is not a desirable change because of the street access issue, the size and shape of. the parcel is not suitable for a planned residential develonment and would be extremely difficult to design in compliance with standards . The existing C4 zoning would allow for ;?dter oriented commercial uses which would provide incentives for incorfl�ration of the site into the surrounding commercial uses through reconstruction or upgrading efforts. 7.0 RECO, MENDATION: The staff is recommending denial of Zone Chancre No. 78-•19 based on the ' following• findings : : zC 7s-19 December 5, 1978 Page `4 ' 1: The ,. site; is -not adequate for development of 'uses as would -be permitted under the proposed C2 zoning. 2.
