NOTICE• 15 HEREBY GIVEN that a public hearing will be held by the City Council
of the City of Huntington Beach, in the Council Chamber of the Civic Center,
Huntington Beach, at the hour of 7:30 _ P.M. , or as soon thereafter as
possible on Monday the 21st _ day of December �, 19 81 ,
for the purpose of considering Zone Case 81-11 , a request to change the zoning on
approximately 5 acres of property located on the south side of Ellis Avenue, approximately
800 ft. west of Goldenwest• Street from RA-0-CO (Residential Agricultural District
Combined with Oil Production Civic District) tc Rl-•O-CD, 15,0.M (low Density

STATEMENT OF ISSUE:
Transmitted for your consideration is Zone Change No. 81-11, a
request to rezone approximately 5 acres of property from RA--O-CD
( "Residential Agricultural/Civic District" , combined with oil
production) to 'IQ" R1-0--CD-15, 000, (Low Density -Residential/Civic
District combined with oil production) , with each lot having a
minimum area of 15, 000 square feet. The subject property is
located on the south side of Ellis Avenue, approximately 800 feet
west of Goldenwest Street.
RECOMMENDATION : (PLANNING COWISSION)
The Planning Commission recommends that the City Council approve
Zone Change No. 81--11 as amended by the Commission to "Q" R1-0-
CD-15, 000 with the following conditions :
CONDITIONS OF THE 011 ZONING:
1 . Any future project approved for this parcel of land shall make
provisions for equestrian uses within the dr•-►elopment .
2. Development of this parcel shall, to as greet a degree as
practical, be compatible a-.th the proposed specific plan
being prepared for the area.
3. Development of this parcel shall allow for innovation in types
and placement of the housing in tha project.
4 . Any future project proposed for this property shall be sub-

RECOMMENDATION: (STAFF)
The staff recommended that the City Council reject Negative De-
claration No. 8I--41 and require that an environmental impact
report be prepared for the project . The staff further recommends
that the City Council deny Zone Change No. 81-•11 or table until
completion of the required EIR 07 the specific plan in conjunction
with which the staff is preparing an EIR .
Discussion:
Zone Change No. 81-11 is a request by the applicant to change the
zoning on the subject property from RA-O-CD (Residential Agri--
cultural District combined with 1il productL-on/Civic District) to
RI--0-CD-15, 000 (Low Density Residential combined with oil produc-
tion/Civic District with each lot having a minimum area of 15, 000
square feet) .
If zone Change No. 81-11 is approved by the Council, it is the
applicant ' s intention to construct one dwelling on each 15, 000
square foot lot including equestrian facilities, narrower streets
and less intensive public improvements.
The "qualified classification" was added by the Commission to
j insure that equestrian, uses will be included in the project, to
allow for innovative types of housing, and that the project will
be compatible as possible with the specific plan now being pre-
pared by the Department of Development Services.
The staff ' s recommendation is outlined in the attached staff
report .
EnvIL9nmental Status:
The Planning Commission recommends that the City Council adopt
Negative Declaraticn No. 81-41 .
FUNDING SOURCE:
Not applicable.
ALTERNAU VE ACTION:
The Council may consider denying or tabling Zone Change No. 81--11,
until completion of an EIR or the specific plan currently being
prepared by the Department of Development Services.

findings outlined in Section 7 ,0 of ,this staff report.
2 .0 GENERAL INFORMATION:
Zone Change No . 81-»11 is a .request to change the current zoning
designation on the property from RA-0-CD, Residential/Agricul-
tural District combined with oil Production and Civic District
Suffix, to Rl-O-CD-1.5, 000 . The intent of the requested zone
change is to allow subdivision of the subject property into ten
individual lots having a minimum net area of 15 , 000 square feet.

3 . 0 SUMMARY OF ISSUES %
The major issues of concern regarding Zone Change No . 81-11 are:
1 . The property in question is part of a larger area for which
a specific plan is currently being prepared to implement the
General Plan estate residential designation. Rezoning of
properties in this area is considered premature until said
specific plan has been completed .
2. The current zoning designation is intended as a transitional
zone to prohibit subdivision until permanent zoning which tray also
to cc-.rlsistent with the General Plan has been adopted. The pro-
posed zoning is one of several alternatives that could be con-
sidered consistent with the General Plan.
3. The subject property and surrounding properties are currently
unserved by City sewer and drainage facilities. The general
area also lacks a coordinated internal street system. Because
of the number of property owners in the general area , a plan to
coordinate the financing and construction of major capital
improvements needs to be established prior to approving zone
changes that would allow subdivision or development of indivi-
dual properties in this area.
4_ 0 ENVIRONMENTAL STATUS :
� y The applicant submitted a request for a negative declaration along
with the zone change application. The subject site is locates] with-
in an overall area considered to be environmentally sensitive by
the staff. . The staff is present:?.y in the process of preparing a
specific plan which will serve as implementing zoning for the entire
- area generally bounded by Ellis Avenue, Garfield Avenue, Crystal
Street, and the Huntington Reach City limits. An environmental im-
pact report is being prepared for this specific plan area which will
identify mitigation measures necessary for environmental protection
of the entire estate residential area . * The EIR being prepared to
assess the estate residential area is not yet complete and, therefore,
to adequately assess the environmental effects of the proposed project,
it is recommended that an EIR be required .
5 . 0 SURROUNDING LAND USE, ZONING, AND GENERAL PLAN DESIGNATION.
The subject property contains a temporm.ry cormnercial horse stable
with boarding capacity, exercise and training area for 74 horses.
One producing oil well and several storage tanks are also located
on the site. Unimproved service roads provide access onto the site .
Surrounding properties south of Ellis Avenue are designated estate
residential with allowable densities of two or less units to Z:he
cast and went and four or less units per acre to the south . Praperr

Property to the: west of the site is zoned ril-O-CO and supports a
commercial horse stable and one active oil well . Property to the
east is zoned RA-O-CD ( to the north) and LU--O--CD (to the south) .
This property supports a corramercial horse stable and three oil
wells . Property to the so�,.t.h is zoned RA.-O-CD and contains an
unauthorized composting an : topsoil facility . Property to the
north, across. Ell iE• Avenue , .is zoned LU-0--CD and contains tempo--
nary commercial horse stables .
6. 0 ANALYSIS:
The subject property is part of a 102-•arre. estate residential area
generally located between Ellis and Garfield Avenue: and between
C,ot.hard Street and the City boundary west of Edwards Street . There
are a number of potential constraints to development in this estate
residential "rea including tomography , oil uses , ownerships , com-
munity facilities , and access problems . At the request of City
Council , staff prepared a conceptual study of the area (Ellis-
:,oldenwest Area Conceptual Study, May , 3.981) which addressed these
potential constraints and outlined a number of development objec-
tives necessary to ensure cocr.dinated residential development that
maximizes the area ' s potential to provide ::nique open space and
recreation opportunities . Ater review of the conceptual study ,
the Planning Commission directed staff to prepare a specific plan
for the area to implement the estate residential designation .
Staff is currently working on the specific plan and anticipates
completion of a final draft by "January, 1982 . Any rezoning of
property in the Ellis-Goldenwest area is premature at this time and
may detract from the specific p!an ' s ability to meat the objectives
contained in the conceptual study .
The proposed zone :-hange would enable subdivision of the subject
property into unif:-)rm lots of 1.5 , 000 square feet in size . This
is only one, of several zones that could be used to implement the
estate - sidential designation for this area : The Ellis-Goldenwest
Specifi ,_ Dlan will contain several types of zoning or development
standards which could be used to implement the designation . The
L:Lrst of these may be similar to that proposed by the applicant,
which provides for subdivision into large, fairly uniform lots upon
which single- family homes can be built . A second approach may in-
volve reducing the average lot size, clustering these lots , and
providing common open space or recreation.i1 area on 20 to 30 percent
of the site . F. third approach may be to apply the City ' s planned
residential development standards . The specific plan will identify
areas in which one of more of these development types are most
appropriate based on an areawide analysis of desired open space
corridors , equestrian areas, and uniq•ac topographical features .
The subject property and surrounding properties are currently
unnerved by Citsr sewor , drainage: , and, in some cases , water facili-
ties . Of f.nite imprc-emc:nts may be required to connect the subject
property to existing facili.tier, outside the Ellis-Goldenwest area .

The cost o constructing these facilities to their ultimate
capacities may be prohibitively expensive for any one developer .
I If individual properties are allowed to install temporary, under-
sized facilities, however, inefficiencies and repeated disruption
of property and streets may occur. Similarly, the Ellis-Goldenwest
area lacks an internal system of collector streets . if individual
parcels are allowed to take access off the nearest arterial, a
large number of access points -will be created rusulting in traffic
disruption and safety hazards , also, inner parcels may be difficult
to access . The specific plan currently being prepared will deline-
ate the appropriate alignment and necessary capGci'.ies of all major
public works facilities and collector streets needed to serve the
F1 !is-Goldenwest area . The plan will also propose a method to
coordinate the financing and construction of these facilities that
is equitable to all property owners.
j Staff recommends that the exisitng zoning on the subject property
be retrained for the following reasons: 1 ) The requested zoning
would limit options available to the City in t1ie estate residential
area regarding the provision of open space , community facilities,
access , and circulation; 2) Staff is currently preparing a specific
plan for the area which will implement the objectives contained in
the Ellis-•Goldenwest Conceptual Study; and 3 ) The existing RA-0
zoning , by prohibiting further land Subdivision , is the most appro-
priate designation for the subject property until sucn tine as the
specific plan is completed ; 4) Current woning on subject propccz:1-
consistent with the General. Plan .
7. 0 RECOMMENDATION:
The staff recommends that the Planning Commnission reject Negative
Declaration 81- 41 and require that an Environmental impact_ Report
be prepared for the project . Staff further recommends that the
Planning Commission deny :'oile ( hange No, 8 1 -. 1 1 or table until
completion of the required EIR or thci s;.grcific Plan, based on the
following findings :

Applicant: Lindborg/Dahl Investors , Inc.
ZONE CHANGE NO. 81--3 : To permit a change of zone from RA-0 to
Q-R1-0-8 , 000 on property located on the east side of Edwards
S�:reet approximately 3.000 feet south of Ellis Avenue .
ZONE CHANGE NO. 81-1.1 : To permit: a change of zone from
RA-O-CD to Q-R1-0•-CD--15, 000 can property located on the south
side of Ellis Avenue approximately 800 feet west of Goldenwest
Street .
Carol Inge briefly reviewed the applications . She pointed out
thc.t they are located within an area for which staff is prepar-
ing a specific plan which is .anticipated to be finished in
January of next year. In staff ' s opinion approval of these zone
changes would prejudice that plan and might encourage ether
ro erty onwers in the area to apply for similar changes in zon-

in a vicinity which staff feels is not ready for subdivision
at this time . Commissioner Porter requested to know how many
staff hours are estimated to be put into the plan and what per-
centage of the plan is presently completed . Ms . Inge replied
that no tally of hours is available at *his time, but the plan
is approximately 50 percent complete.

The public hearing was opened on both requests .
David Dahl , applicant , addressed the Commission to ur.le approval
of his requests saying that the delay has already been very
costly and further delay could preclude him from being able to
meet his planned maximum density of four units to the acre or
from including equestrian uestrian facilities within his developments,

which he now plan3 to do . He informed the Commission that if
his zone changes are approved he will plan a project consistent
with the General Plan concept of estate zoning , with clustered
housing, low density, narrower streets, less intensive public
improvements , etc.
In response to Commissioner Porter ' s request for his reaction
to the IV' prefix on his zoning , Mr . Dahl replied that he wel-
comed th,: nualified zoning designation.
Dave Allbright, representing the Environmental Board, spoke
to the Commission to say that the Board opposes any changes to
the General Plan in this ' area, which it feels has been adequately
c•ovexed through other studies. tie urged the Planning Commission
to approve the zone changes and allow the property to develop
according to its existing General Plan designation.
Linda Moon, 17161 Goldenwest Street, an attorney representing
Equestrian Trails, Inc . , spoke in support of the requests and
urged their approval .
