Palin, Director, Development Services o Subject: ZONE CHANGE NO. 82.-20 Ra�O 4) k5 i Statement of Issue, Recommendation, Analysis, Funding Source, Alternative Actions, Attachments: i STATEMENT OF ISSUE: Transmitted for your consideration is Zone Change No. 82-20, a request to rezone approximately 20 acres of property from R4--0, High Density Residential District combined with oil production to R4-29-0, High Density Residential District combined with oil production allowing 29 units per acre and R3-17-0, Medium High Density Residential Dis- trict combined with oil production and allowing 17 units per acre on property generally located southwesterly of the proposed extension of Palm Avenue and the proposed future alignment of 38th Street. RECOMMENDATION: The Planning Commission and staff recommend that the City Council approve Zone Change No,, 82-20 `hanging the zoning on the subject property from S4-0 to R4--29-0 and R3-17-0 and adopt the attached ordinance . ANALYSIS: APPLICANT: City of Huntington Beach LOCATION: Generally located southwesterly of the proposed exten- sion of Palm Avenue and the proposed future alignment: of 38th Street:. REQUEST: To permit a change of zone from R4-0, High Density Re- sidential District combined with oil production to R4--29-0, Nigh Density Residential District combined with oil production allowing 29 units per acre on approxi- mately 10 ages and R3-17-0, Medium High Density Re- sidential District combined with oil production and allow- ing 17 units per acre on approximately 9 acres of property. A change of zone from R4-0 to R4-29-0 and R3-17-0 on the subject property is consistent with the General Plan Land Use desig.iation which is high density residential. 2. The zone change from R4-0 to R4-29-0 and R3-17-0 will be proposed 9 compatible with surrounding land uses which include oil production and. vacant land. DISCUSSION: In December, 1979 , the California State Coastal Conunission reviewed Seacliff Phase IV, a planned residential development located adja- cent to the subject property. At that time,. the Commission condi- tionally approved the project and, among the conditions imposed by the Planning Commission, was the requirement that affordable housing for low and moderate income persons be provided as part of the Sea- cliff Phase IV development. The developer agreed to this condition but also requested the Coastal Commission to permit development of the adjacent 20-acre site. The Coastal Commission agreed to this, but limited the total number of units on the site to 450 . On April 20 , 1981, the City Council approved Zone Change No. 80-6, changing the zoning on the subject property to R4-0, High Density Residential District combined with oil production. me City Coun- cil also adopted Resolv%'-ion No. 4985 which certified Environmental impact Report No. 80-1 and directed the Department of Development � Servic-s to initiate a further zone change on the subject property limiting the total number of units to 450 for the gross site area. Based on the Counci.: s action taken on April 20, 1981, the sta-`f has initiated Zone Change No. 32-20 , a request to change the zoning on the subject property from R4-0 to R4-29-0 and R3• 17-0. Zone Change No. 8272O : would permit 29 units per gross acre te: be constructed .on the northerly portion of the subject property (10. 439 acres) and 17 units per acre on the southerly portion of the subject property (9.24.9 acres) . This proposed density would comply with the p.telimi- nary development plan previously submitted by the property owner of �.t,-e subject property. If approved by the City Council, Zone Change No. 82-20''will comply with Resolution No. 4985 limiting the total number of units that it be constructed on the subject property to 450. ENVIRONMENTAL STATOS : The subject: property was previously assessed for environmental effect:: ZC 82-20 January 25, 1983 Page 3 as part of EIR N 80-1 in conjunction with Zone Change No. 80-6. EIR 80-1 was approved by the City Council by Resolution No. 4985 on April 20, 1981; therefore, no additional environmental review is necessary at this time. ALTERNATIVE ACTION: ':he City Council may consider denying Zone CI:u,.ge No. 82-20 which would retain the e�: .-,tiny R4-0 High Density Residential District com- bined with owl production, on the subject property.
