The subject property is located on the northwest corner of Goldenwest Street and Ellis Avenue. RECOMMENDATION: The Planning Commission and staff recommend that the City Council approve Zone change No. 82--3 to reflect a ch,.nge of zone on the subject property from RA-O-CD to C2-0- (Q) . ANALYSIS: APPLICANT: A. C. Marion P. O. Box 108 Huntington Beach, California LOCATION: Northwest corner cf Gulderwe-,t Street and Ellis Avenue . REQUEST: To permit a charge of zone from RA-0-CD, residential agricultural district combined with oil production and within Civic District, to C2--4- (Q) , community business district combined with oil production and qualified classification. A change of zone on the subject pr. opert; , from RA-0-CD to C2-0- f (q) is consistent with the General Plait ,designation which is cteneral commercial . 2 . The proposed zone change is compatible with surrounding uses which are generally recreation and egue.stziar, related. DISCUSSION: Or. December 21, 1981 , the City Council approved Land Use Element .Amendment '.,o. 81-3 which changed the General Plan designation from open space to general, commercial . At that time, the City Council also directed staff tc. prepare a list of criteria for the commercial centor to achieve an appealing visual appearance and directed staff to compile a list of uses c-)mpatihle with adjacent ipen space uses (Hurtington Central Park) by attaching a qualified prefix to the j zone change. The Planning Commission approved the zone change with a "Q'• prefix and also added five conditions. The conditions include the requirement that a conditional use permit be submitted on any development on the site, limitation on building height and materials, additional landscaping, type and style. of perimeter walls and a list of permitted uses (sec: attached ordinance) . All of tht land uses listed by staff are equ,-�strian or recreational oriented . It is suggested that the City Council retain the 110" suffix on the subject property because there is currently one producing oil well on the site. It is also recommended that the Planning Commission delete the Civic District suffix from the zone change because the qualified prefix requires Lubmittal of a conditional use permit application for all development on the subject property. The con- ditional use permit process will allow review of the prcject by the Planning Commission, to insure that all development meets the intent of the equestrian and recreation theme. Approval of Zone Change No. 32-3 will bring the zoning into conformance with the General Plan designation which is presently general commercial . ENVIRONMENTAL STATUS : The subject property was previously assessed for environmental ef- fects as part of Environmental Impact Report No. 81-6 . in conjunc- tion with Land Use Element Amendment No. 81-3 . If Zone Change No. 82-3 is approved by the City Council the zoning will be brought 14- to conformance with the General Plan designation which is general commercial . Any future development on the site is subject to ad- ditional environmental review. ALTERNATIVE ACT;OH: The City Council may consider denying Zane Change No. 82-3 which I ZONE CHANGE NO. 82-3 April S, 1982 Page 3 would retain the existing RA-O-CD zoning on the subject property. The applicant did not indicate which commercial zoning dir,trict he preferred . On December 21 , 1981, the City Council granted the applicant' s re- quest for a change in the land use designation on the General Plan from Open Space to General Commercia ;. . The staff has now completed its review of the applicant ' s zone change request and finds that a change of &.:ane on the subject property from RA-0-CD to C2-0-110" besi meets the direction set forth by the City Council and the needs of the applicant . 0 SUMMARY OF ISSUES: 1 . A change of zone from RA-0-CD to C2-0--"Q" , will result in the conformance of thg zone change with the new General Plan desig- nation which is General Commercial . 2. At that time, the City Council also dir- ected staff to prepare a list of criteria for the commercial center to achieve an appealing visual appearance and directed staff to compile a list of uses compatible with adjacent open space uses (Eiuntington Central Park) by attaching a qualified prefix to the zone change. The staff has added a "Q" prefix to the zone change request and has included five conditions. The conditions include the requirement that a conditional use permit be submitted on any development on the site, limitations on building height and materials, additional landscaping, type and style of perimeter walls and a list of permitted uses (see attached ordinance) . All of the land uses listed by staff are eques- trian or recreational-oriented. The list is intended to prohibit amusement arcades, fun centers, amusement entororises or other simi- lar land uses. it .is suggested that the Planning Commission retain the "O" suffix on the subject property because there is currently one producing oil well on the site. However, the staft favors deleting the "Civic District" suffix from the zone change because the qualified prefix requires submittal of a conditional use permit for all development on the subject property. The conditional use permit process will allow review of the project by the Planning Commission to insure • that all development meets the intent of the equestrian and recreatian theme. As an alternative , the Commission may retain the Civic Distrirt: Suffix . FINDINGS : 1 . A change of zone on the subject: property from RA-0-CD to C2-O-"Q" is consistent with the General Plan designation , which is General jCommercial . 2 . The proposed zone change is compatible with surrounding uses which are generally recreation-- and equestrian-related . _CONDITIONS OF APPROVAL: � ]. . Any development on the site shall be subject to the approv al of a conditional use permit as provided in Article 984 of the Iiuntington Beach Ordinance Code. 2 . All development on the site shall be limited to one-story in height , with exceptions for architectural features . The theme for the devel- opment equestrian-related, with major opmezi i shall b7 emphasis on the use of wood siding and earthtone colors . 3 . In addition to the standard 6 percent landscaping on the site, the developer shall also provide landscaping within the parking area .. This landscaping shall be subject to the approval of the Director of Development Services . { 4 . The type and style of perimeter walls shall be subject to the approval of the D:.rector of Development Services . Access to the project shall be provided on the north and west for pedestrians and horses . • 5 . The following uses shall be permitted within the development: Feed and grain stores, saddle and tack stores , veterinarian clinics (without overnight facilities) , restaurant, sporting goods store , and other similar uses related to equestrian and recreational type commercial outlets , subject to the approval of the Planning Commission.
