to that zone change. He indicated that a letter will be forthcoming

It has come to m; attention that Steverson 13rothers , the V of record
of the Steverson Mud Curnp, was inadvertently not nitifie o the City-
initiated zone charge of their property from MP -A-0 (Rest ted Manu-
facturing Di.striet combined with Oil Production) to LUD-O lLintited Use
District combined with Oil Production) . We are required .o notify the
sul;ject property owner of each pub'.ic hear4.ng, as well as the property
owners within a 300-foot radius of the subject property . In preparing the
mailing li_:t, the subject property owner ' s name was inadvertently not in-
cluded; therefore, he d1d not receive a notice of either the Planning
Commission ' s or the City C''ouncil ' s public hearings on the proposed Zone
change. In addition, a letter was sent to Mayor `Iandic from Carl Steverson
on May 3 stating that the pr:)per. ty owner opposes the proposeu zone change
from MI-A-O to i'JUD-0 and considers it an attempt to downzone the property.
The City Attorney ' s office has indicated that in order to rectify this
matter the zone change process will have to begin again . This would re-
quire another public hearincl before the Planning Commission and a subsequent
public hearing before the City Council .

Dear Mayer Mandic:
It has cone to my attention within the past two days that the
City Council 4.s considering changing the zone of certain pro-
perty in Huntington Bea,:h owned by Steverson Bros,. Corporation,
of which I am president . ,his property consists of approxi-
mately 38 acres at Magnolia Street and Hamilton Avenue in
Hunt.4.ngton Beach . The property is presently zoned MI -A--0 , and
we underctand it is proposed to change the zoning to LUD.
Although Ste:►prson Bros . Corporation has owned the surfa-e
rights of this property for over 20 years, its ownership is
subject to certain oil and gas leases . The mineral rights
have ,ieire; been owned by this corporation.
There has been much publicity recently in the local papers
concerning the development of this site by Ryan Energy Corpora-
tion which development would include a wzite disposal plant
being located on the property . It appears the proposed zone
change has been generated by this pr-oposal . Any action by Mr .
Ryan or Ryan Energy Corporation in proposing the development
of this property has been done without the authority or con--
sent of Steverson Bros. Corporation. It is our understanding
that Mr. Ryan' s corporation does slain, an inte est in the
mineral rights with respect to this property.
This corporation has always worked with the City of Huntington
Beach in an attempt to be good neighbors. We ask you to recog-
nize, however, that this site has been used for the present,
purposes for many, many years, well prior to the rapid develop-
ment of our city that took place in the 1960 ' s and 19701s. It
is further brought to your attention that in 3.971, in coopera-
tion with the City of Huntington Beach, the disposal of all field
rotary mud was halted and has not taken place since that time.
Additionally, this corporation has cooperated with the City,
whenever any complaints have been raised concerning the subject
property. It is the intention of these owners to continue to
cooperate with the City a3 it has in the past.

In view of the fact that this cc--poration has no present in--
tentior, of developing this property, that it has continually
cooperated with the City and its officials, it objects to the
proposed action by the City in down-zoning the property to the
LUD zone . We respectfully and urgently request that you reject
this proposal of the above-mentioned cone change as being un-
neuessary and inappropriate .

STATEMENT OF ISSUE:
Transmitted for your consideration is Zone Change No. 82-4, a re-
quest to rezone 38± acres of property from MI-A-0 (Restricted Manu-
facturing District combined with oil production) to LUD (Limited
Use District combined with oil production) . The subjoct property
is located at the southwest corner of Hamilton Avenue and Magnolia
Street.
RECOMMENDATION:
The Pianning Comic-ission and staff recommend that the City Council
uphold the decision of the Planning Commission and approve Zone
Change No . 82--4 by the adoption of the attached ordinance .

FINDINGS :
1 . A change of zone from 141-A-0, Restricted Manufacturing District
combined with oil production, to LUDO, Limited Use District
combined with oAl production, is consistent with the current
General Plan designation which is Public, Quasi--public, Insti-
tutional.
2 . The proposed zone change to LUD-O will be compatible with sur-
rounding land uses which include a community park, single family
homes, oil storage tanks and vacant land.
DISCUSSION:
At the Marc}i. 1, 1982 City Council meeting, the Council voted to
direct the Planning Commission to consider a change of zone from
M1--A-0 to LUD-O on the subject property. At that time, it was the
concern of the Council that the City should have full control over
all land uses on the Steverson mud dump property in the future.
Therefore, it was recommended by the City Council that the Plan-
ning Commission consider a change of zone on the subject property
from M1-A-0 to LUD-O, Limited Use District combined with oil pro-
duction.
The subject property is currently being used as a (:lass III land-
fill operation. The site is licensed by the Orange County Solid
Waste Management Board for disposal of inert material such as
cement and asphalt. The surrounding land uses include Edison
Community Park to the north, single family dwellings to the east,
Edison Company oil storage tanks to the south and vacant land to
the west. A change of zone on the subject property from Ml-A-O
to LUD-O will be consistent with these surrounding land uses be-
cause: the permitted uses within the LUDO zoning are highly re-
stricted.
The purpose of the "Limited Use District" is to apply this zoning
to an area of the City for a temporary period of time for the pur-
pose of further planning of zoning, or environmental issues. Land
within the Limited Use District shall not be subdivided for resi-
dential, commercial or industrial purposes until the property is
rezoned to an appropriate zoning designation.
Permitted uses within the Limited Use District include farming or j
grazing, picnic grounds, bird sanctuaries, field crops, riding or
hiking trails and other similar uses , if the zoning designation
is changed from M1-A--0 to LUD-O on the subject property, all future
land uses would be subject to a change of zone and review by the
City.

ENVIRONMENTAL STATUS:
I
Pursuant to the environmental regulations in effect at this time,
the Department of Development Service-7 posted draft Negative De-
claration No. 82-10 for 10 days, and no comments either verbal or
written were received. The staff, in its iuitial study of the pro-
ject, has recommended that a negative declaration be issued. Prior
to action on the zone change application, it is necessary for the
City Council to review and adopt Negative Declaration No. 82-10 .
.ALTERNATIV CTION:
The City Council may consider denying Zone Change No. 82-9 and re-
tain the Ml-A-O zoning on the subject property.

carried by the following vote :

It was the concern of the Council that the City have full

the Auture. Therefore, it was recommended by the Casty Council
that the Planning Commission, consider a change of zone on the
subject property from 1-11-A-0 to I.UD-D, Limited Use District com-
bined with oil production.

NOTICE IS HEREBY GIVEN that a publiz hearing will be held by the City Council
of the City of Huntington Beach, in the Council Chamber of the Civic Center,
Huntington Beach, at the hour of 7: 30 P.M. , or as soon thereafter as
possible on Monday the 3rd day of May 1982
for the purpose of considering Zone Casa No. 82-4 , a request by the City of
Huntington Beach to change the zoning designation on 38± acres of property located
s corner of Hamilton Avenue and Magnolia Street from MI-A-O,
at the southwest 9
(Restricted Manufacturing District combined with oil production) to LUD (Limited
Use District combined with oil production).
