STATEMENT OF ISSUE:
Transmitted for your consideration is Zone Change No. 82-7 , a request
to rezone .47 acre of property from C2 , Community Business District,
to C2-SS Community Business District combined with service station
suffix.. The property is located on the southwest corner of Bolsa
Chica Street and Edinger Avenue.
RECOMMENDATION :
The Planning Commission and staff recommend that the City Council ap--
rrove 'Lone Change No. 82--7 changing the zoning from C2 , Community
Business District, to C2--SS, Community Business District combined with
service station suffix.

FINDINGS FOR APPROVAL:
1. A change of zone from C2 , Conuaunity Business District to C2-SS ,
Community Business District combined with service station suffix,
is consistent with the General Plan designation which is general
commercial.
2 . The proposed zone change is compatible with the surrounding land
uses which are generally commercial.
DISCUSSION :
The request for a change of zone on the subject property was fi14d
by the applicant based on the requirements outlined in Section 9481. 3 ,
Permitted Uses , of the Ordinance Code. This code section permits
service stations and related uses (i.e. car washes) within a com-
mercial zone only if the service station suffix has been attached
to the base district. If Zone Change No, 8?-7 is approved by the
City Council, the applicant, intends to demolish the existing svr,rice j
station and construct a new self-serve gasoline station and car wash
wash, which ' s
on the subject property . The car sh, w h i permitted within the
"service sta::ion suffix" is an additional use to the subject property
which is also subject to review and approval by the Board of Zoning
Adjustments. Therefore, prior to construction of a new :service sta-
tion and car wash facility , the "SS" s,.iffix must be attached by the
City Council to the subject property.

In reviewing Zone Change No. 82-7, the staff identified the surround-
ing land uses. These uses are primarily commercial with the naval j
weapoas storp.ge facility located across Edinger Avenge to the north.
The existing service station was originally constructed in July of
1964 and since that time, no appreciable land use problems have arisen
because of the existing service station. The Commission and staff
concur that if the future site plan for a new service station and car
wash is approved by the BZA, having adequate circulation and setbacks
from the existing commercial buildings, the service station will be
compatible with surrounding land uses,
In reviewing the requirements of Article 948 , the Planning Commission

other service stations, residences, schools, hospitals and other land

ENVIRONMENTAL STATUS:
Negative Declaration No. 82-18 was approved by the Planning Commission
on August 3, 1982 . Before fhe City Council takes action on Zone
Change No. 82--7 , it i-- necessary for the Council to act on Negative
Declarat.i.r.n No . 82-18 .
ALTERNATIVE ACTION :
The City Council may consider denying Zone Change No. 82-7 retaining
the existing C2 zoning on the subject property.

3 .0 ENVIRONMENTAL STATUS :
Pursuant to the _-nvirormental regulations in effect a.;. this time ,
the Department of Development Services posted draft N_--gative De-
claration No. 82-.19 for ten days and no comments , either verbal. or
written, were received. The staff in its initial study of the pro-
ject, has recommended that a negative declaration be issued for
Zone Change No. 82-7 . Prior to any ection on Zone Change No. 82-7 ,
it is necessary for the Planning Commission to act on Negative
Declaration No. P2-18 .

The major issues of ,:oncern r.-?garding Zone Change No. 82-7 are as
follows:
1. The requirement of adding the "service station suffix" to the

existing C2 zoning as dic;•ated by Article 948 of the Ordinance
Code.
2. The compatibiii.ty of the proposed future self-serge gas station
with surrounding land uses .
3. Whether or not the " service station suffix" should be eliminated
from the Ordinance Code.
The request for Zone Change No. 82-7 was filed by the appli-
cant based on the requirements outlined in Section 9481.3 Permitted
Uses of the Ordinance Code. This code section perr-tits service sta-
tions and related uses within a commercial zone only if the "vervice
station suffix" has been attached to the base district. Therefore,
prior to construction of a new service station, the "SS" suffix is
required . In addition to the zone change requirement, the applicant
must also submit an administrative review application to the Board
of. Zoning Adjustments for review and approval .
