ANSWER: NO Ordinance No. 2581 providing for a rezoning of various eistricts ( Zone Case No. 82--8) was clearly intended to be introduced by the action taken at the October 25 , 1982 City Council meeting on a 4-3 vote (conclusion of listening to tape recording of meet-ing. ) An ordinance Fussed in pursuance of authority is not necessarily invalid becausa it omits some of the details of method or procedure mentioned in the Charter , unless the details are made prerequisite to its validity, as where it is declared that the ordinance shall be void if the method or procedure prescribed is not followed . Although a literal reading of Charter §500 (a) states that 11066upon introduction and second reading, an ordinance shall 5e read by title only. . . . since the intention of the Council was clearly to introduce Ordinance No. 2581 and they in f rict: enunciated the ntunber of the ordinance previously before them, and there is no prerequisite to validity contained in City Charter 5500 (a) requiring reading by title , the ordinance was properly introduced. The Planning Commission reviewed the City Council initiated zone change and recommended denial on Jule 20, 1982. Since Zone Change 82-8 was initiated by the City Council, an appeal to the Planning Commission's recommendation was not required for the City Council to hear the proposed zone change. r RECOMMENDATION: 1. 15 lenning Camenission recommends that the City Council deny Zone Change No. 82-8. 2. The plimning staff recommends that the City Council overturn the Planning Commission's denial and adopt a zone change to MH for Huntington Mobile Estates (62-8A) and Rancho Del Rey (82-813). One of the realizations which has come from the study Is that seven mobile home parks in the City do ,-ot have permanent mobile home 0AH) zon;ng and therefore are operating as non-conforming uses. Since closure of mobile dome parka results in displecement of significant numbers of low-income and elderly tenants, and because non-conforming mobile home parks were de-erred to be at greater risk of closure and conversion to other uses, the City Councl! directed staff to rezone the non-conforming parks to MR Of the seven non-conforming parks, one (8eachview) will clearly require a General Plan Amendment before g zoning can be changed to MHO The other six non-conforming parks are tie subjssct of Zone o r e Hu-1 1 ton Mobile Change 82-8. Each park has been assigned a- a subarea .f the zone change ( g Estates 82-8A, Rancho Del Rey 82-BB, Pacific Trailer Park 82-8C, Cabrillo 82-8D, Huntington Shores 62-8E, and Driftvr-nd 82-8F) and will be examined separately in the following analysis. Huntington Mobile Estates (82-BA) Huntington Mobile Estates is a 9.2 acre, 105 unit (11.41 units per acre), 22 year-old park located on the south side at Garfield Avenue between Huntington and Delaware Streets. The zoning ^n the property Is R3 and the general plan designation is Medium Density Residential MH zoning would be consistent with the general plan designation. Since thr: proposed zone change h ;ntnnded to establish long-term land uses for each sVe, the existing and future compatibility of each site should be considered. Huntington Mobile Estates exists in a largely residential area with apartments directly adjacent to the south, condominiums and single family homes across Delawere Street to the east and apartments across Garfield to the north. The City water v,_.echouse is located across Huntington Street on the west side of the park. Since the area is largel-, built out, the mobile home park: should remain n compatible, use for the foreseeable future. Because of the scope of the za;se change request, a fiscal impact analyals of each area was prepared using the computeril :rd fiscal impact methodology developed by Ultrasysteins, Inc. In the case of Huntington Mobile Estates, the existing mobile home park was analyzed versus 128 medium density condominiums with a value of $120,000 Far unit which would be perriitted by the Genera'. Plan. The existing mobile home park contains 105 mobile homes. if the park recycled to a condominium or apartment use, the me lium density general plan designation would permit a maximum of 128 units. The difference+ of 23 units Indicates that rezoning of the park for permanent mobile flame use would not result in a significantly jeopa^sized additional housing opportunities. More general housing impacts are discussed in a later section of this report. Rancho 00 Rey (B2-813) Rancho Del Rey Is a 54 acre, 379 unit, 17 year-old park which has MH zoning on most of the property. The subject of th,: zone change proposal Is an 13.90 acre, 84 unit (7.06 units per acre) section of the park wi;=ch Is located at the southeast corner of Edinger Avenue and Saybrook. The zoning on the property is R2 and the General Plan designation is Medium Density Residential. MF-; zoning would be consistent with the General Plan designation. I j AccEss to the Nark, including the subject pertinn, is taken from Edinger Avenue via a private street, Monterey Lane. The subject property is surrounded on three sides by residLiitial uses; medium density condominiums to the east and west and the rest of the mobile home park to the south. The City and Ocean View School (district own a total of 17.5 acres of vacant property designated low density to the southwest. Across Edinger Avenue to the north Is the U.S. Naval Weapons Reserve. With the exception of the vacant land to the southvest, the surrounding area is completely developed with uses with which the mobile home park should candnue to function compatibility. For the fiscal Impact analysis, the existing mobile home park was analyzed versus 166 medium density condominiums valued at $140,000 per unit which would be permitted by the general plan, the table blow indicates that over a ten-year period the existing mobile home park would rmult in Q deficit of $114,890 on a cash flow basis while the alternative allowable use would produce a surplus of $534,280. Since the existing site contains only 84 mobile home% rezoning of the site to MH cc--!d Jeopardize additional housing opportunity of 82 wilts. Pacific Trailer Park (82-8C) Pacific Trailer Park is an 18.65 acre, 266 unit (14.26 ,,,its pet- L,..;e), 29 yet r-old park located on the southeast corner of Atlanta and Huntington. The zoning on 'tie property is R5 and the Coastr,l Element land use designation is Medium 17tsnsity Residential. Tile Co�.stal Element also placed -3 mobile home land use overlay on the park. The MH zoning district would be consistent with both the general plan and the land use overlay. Pacific Trailer Par; Is surrounded on three sides by residential uses; Driftwood Mobile Home Park to the south, medium density condominiums to the east and medlurn density apartments to the north. Across Huntington Str`:t to the west is oil encumbered vacant land designated High Or':rsity Residential by the Coastal Element. It is likely that Pacific Trailer Park will remain relatively compatible with the existing and future development in the area, particularly if Driftwood Mobile Home Park is not replaced by high density residential. If Driftwood and Huntington Shores both recycle, Pacific Trailer Park will be affected more dramatically by noise and traffic. For the fiscal Impact analysis, the existing mobile home park was analyzed versus 261 medium density covidominiums valued at $140,000 per unit which would be permitted by the Coastal Element. The table before indicates that over a ten-year period, the existing mobile home park would result In a $161,700 deficit while the alternative allowable use would produce an $040,530 surplus. Cabrillo Trailer Park (82-OD) Cabrillo Trailer Park is a 6.00 acre, 45 unit (7.5 units per iacre), 23 year old par% located on State-owned prop,er.y on Pacific Coas' Highway northwest of Newland Street.. The zoning on the property Is RA-0 and. the Coastal Element land use designation to Visitor Serving Comr�nerc,el. Eventual widening of Pacific Coast Highway to a 120 foot rsght-';f-way, however, may significantly Impact the resiients of Cabrillo park. For the fiscal impact. analysis, both the existing park and the most likely v:sltor serving usr: for the area were analyzed. The coastal plannin,7 .staff Indicated that berause of limited access and location, a privately awned and cpersted recreational vehicle park was the ;n Est probable use for the site; therefore, a 146 space RV park was analyzed. Since the Coastal Element contains a policy requirin) the 20 percent of new units be affordable, the 140 new units could Include 28 affordubla units. In those inst.-ances, the mobile home parks will not conform with the regulations of tihe tAH dirFrict. In the long term, this will enuse an inconsistent pattern of development within the parks. The Commission believes there are compelling reasons why the proposed zone changes should be denier at this time . First, the rezoning of the six parks would create massive non-conformance problems requiring further changes to the M11 zoning district ordinance . Many of the parks do not conform to density standards and many of the existing mobile homes in these parks do not comply with the setback and open space provisions in the ME1 district . Chancres to the M11 district to establish conformity would significantly lower. the !411 standards and the quality of any new mobile home parks which may develop in the City, as well as any high quality existing parks which may r.hcose to remodel to the lower standards to gain density . Adoption of a mobile home overlay ordinance would accomplish the intended Purpose of the zone change without the non-conformance problems described above. The current draft of the mobile home park conversion ordinance establishes temporary mobile home overlay zoning which could he applied to non-conforming parks which are considered to be at risk of converting . Before the overlay could be removed and the parks converted to other uses, the tenant assistance provisions of the ordinance woulL: have to be met. A final consideration is that the mobile home zoning issue has not been approached from a proper planning perspective. Rather than analyzi.nq the areas in terms of highest and best use, zoning has been made to merely conform to the existing land use. This would probably be 4.1lega1 and challengeable in court if i4 is the only reason for initiating the zone change on the mobile home parks. Since the mobile home conversion ord- inance process addresses the tenant protection issue and is just as capable of activation through a zoning overlay , any consideration to rezone the parks should be approached from, the standpoint of a comprehen- sive analysis of all planning issues to determine the highest and best use of each site.
