Zone Case 83-14 and ND 83-43 as presented to the Huntington Beach Planning Commission on October 18. 1983 and subsequently denied by that body ,seeks the crnatien of a C4 (Highway Commercial District) zone which Mould then abut a tract of single family homes. Most of these original owner homes have been established for almost twenty years. A period in which ge.ie..- atinns of children and their families have lived in complete harmony with the neighboring profp -:�A-onal and commercial enterprises. We now fear an abrupt end to this peaceful coexiatanre if this retail. business should be allowed to be establiahed its proposed. We therefor, in the .strongeat language posEible, voice our opposition to an change to the now existing zone as it pertains to the property ' jested at 15881 GolCenwest Street, for the following reasons: 1. Negative invironmental impact to residential neighborhood. a. Increased vehicular traffic, overflow parking and increased pedestrian load to quiet residential streets. b. Disruptive noise levels and visual activities necessary to the establishment and maintajnence of retail business. . c. Increased and pruienged night lighting as required during business hours as well as security lighting for after hours. 2. Residential security and safety of inhabitants. a. Increased dangers of forced entries, vandalism and lcitc:ring. b. Increased accident potential for the younger residents from vehicular traffic as well as damage to reeident vehicles. 3. Residential property values:. a. In that even the most adjacent prpperties to the property in ouistion. cannot be construed ac potentially valuable from a comneraal standpoint, the and all other homes 4n our tract y c-1)uld suffer negative tesale problems. The Commission also denied Negative Declaration No. 83-43 on the basis that the negative declaration was incomplete._ In its discussion of,.Zone , Change No. 83-14 , the Commission voiced: th6ir concerns regarding additional. traffic that may be generated by commercial uses on the subject property., The Commission also expressed their concerns re- garding the promotion of strip-development along Goldenwest Street and felt that approval of Zone Change No. 83-14 would add to this problem. The October 18 , 1983 , Planning Commission minutes are attached for the Council ' s review. In its analysis of Zone. Change No. 83-14-, the Planning staff felt that the applicant' s intended development plan which included a retail/ . office complex would be appropriate for the site. The proposed develop-- meet plan would include expansion of the existing office building and i Appeal - Z .C. No . 83r-14 and N. D. No . 83-43 Page Three the construction of a new retail building on the subject property. Review and approval of the development plan would require the submittal of a use permit application to the Board of Z�Ana Adjustments .also recommend- recommending approval of Zone Change No. 83y 1 , the ed that the Planning Commission approve the addition of a fifty (50) foot setback from the ultimate right-of-way on Goldenwest Street . The addition of the setback would be in keeping with current policy of requiring the additional building setback adjacent to major arterial streets within the City. The setback is also necessary so that any future development on the subject property will not block visibility of existing commercial development located to the south. The staff report dated October 18 , 1983 is attached for the Council ' s review. Three homeowners spoke in opposition to Zone Change No. 83-14 during the public hearing portion of the meeting. The homeowners opposed the change of zone for a number of reasons including possible traffic problems , noise generated by the future use and parking problems . residents were also concerned that the C-4 zoning may permit the estab- lishment of a fast food restaurant on the subject property . Other concerns expressed by the homeowners included the possibility of destroying mature trees and the possible danger of added traffic that may endanger children in the area . Many of the concerns expressed by the homeowners can be mitigated through the addition of a qualified classification (Q) to the proposed C4 , Highway Commercial, district . Traffic congestion on Breeland s Avenue can be eliminated by prohibiting all access to this residential street from the subject site. All access to the development could be from Goldenwest Street. Elimination of all driveways on Breeland would also create a safer situation for children walking or riding bicycles in the residential area . The qualified classification should also include a raquirement that I would retain the existing architectural integrity for the development, as well as limiting the types of uses within the proposed development. These uses should be limited to office/professional uses within the existing colonial style building and general retail uses within the. proposed commercial building. Restaurants, medical and dental offices should be prohibited on the site due to excessive traffic generation . Box 190 Huntington Beach, CA 92648 RE : ZONE CHANGE 4r8 3- 14 NEGATIVE DECLARATION #83-43 Zone Change #83r-14 was denied with a commanding vote of 6-1 and Negative Declaration #83-43 vas declared incomplete by the Huntington Beach Planning Commission on October 18, 1983 . This letter is to request an appeal of the above actions to the Huntington Beach City Council. The property in question is currently zoned R-5, Office Professional , occupied by z colonial mansion office building previously used by a real estate fir-. The original intention of the developer in purchasing the property was to remodel and expand the existing office building only. An extensive market survey ,study of the area indicated a strong need for retail space . We re-designed the site to incorporate 25% of our proposed total building space as retail . Planning Staff informed us that the retail use required a zone change of the property from R-5, Office Professional to C-41 Higr;:ny Commercial. As this use is consistent with the General Plan and C--4 zoned property presently exists immediately to the south, we felt our risks were minimal. Following Planning Staff procedure, guidance , and direction we submitted our request to re-zone the property from R-5 to C-4. Planning Staff told us not to submit plar- for. the new proposed structure as they were not necessary for the zone change process. They suggested that we only siibmit the existing building plans and existing parking and site layouts. Staff stressed we need nbt sukxnit the new proposed buildiny plans or site plan layouts. The Environmental Information Form, required for gone change stibmi ttal, repeatedly asked questions pertaining to the new proposed project Use, type and description. We sought assistance from Planning Staff in filling out the form and again we were told to leave blank all questions, pertaining to the new proposed project. To not show the new project plans or fill out the Environmental Information Form complete with the new project information proved to be an erroneous recommendation by Planning Staff . During the Planning ^ommission Public Hearing many concerns were raised froth property owne%*.4 -living in the single family residential track of homes immediately, adjacmant to the R-5 property in question. Th6se concerns had to do with the lack of available information pertaining to the project to be built under the proposed C--4 zone. With no information available in the - staff report, they felt a poss,:ble ",Fast fond" business or retail "ptrip center" might be forthcoming. The Pl":nning Commiyyiamaaked Planning Staff for, information on theas matters of concern by the homeowners. The Planning Comm ssion did not ask for project information assistance from the applicant• but rather closed the Public Hearing. Further Planning Commission discussion followed regarding the incompleteness of the Environmental Information Form as submitted. A move to declare the Environmental Inform- ation Form invalid was cast and supported by a similar ✓ate of 6-1 . Although a zolie change of property does not technically require the complete plans of the new proposed project be presented, we feel based on the concerrss of the. homeowners,, it. would be appropriate to do so. Wr, are confident that our proposed project is a beneficial asset to the City of Huntington Beach and the immediate community. We request an appeal to the Huntington Beach Citv Council in order that we may have an opportunity to present our new proposed project and fully describe its size, type and scope. The preliminary plan indicates about a 23 foot pro- posed setback; the applicant could encroach 25 feet into the setback, if a conditional exception were approved by the Board of Zoning Adjustments with the required extra foot.-for-foot land- scL-ping . This would preclude parking in front of the buildings . The public hearing was opened . Craig Hampton of Pacific Building Concepts was present at the meeting to represent the applicant. He said that the present structure on the property is at 39 foot setback, but they have no problem with the 50 foot requirement sc, Long as they can take advantage of the encroachment prevision as outlined above . lie also discussed the required sight angle, and staff concurred that the sight angle to the south is required to avoid blocking other commercial sites, but the sight angle to the north is not necessary. Vida McCray, 15852 Rollins Lane , spoke to the Commission to strongly oppose the zone change on the basis of parking, noise, and traffic problems . There were no other persons to speak for or against the proposal., and the public hearing was closed . Commissioners [fig-gins and Li.vengood questioned the traffic which could be expected to be ctenerated by commercial. uses , the possibil- ity of increase in square footage on the site , and the need to know exactly what uses are to go onto the property . Staff responded that it is hard to calculate traffic generation without a specific site plan to review, that the existing building will remain office while the proposed new construr.-t.ion to the south will be retail , and that the Commission can impose the "Q" zoning prefix under which the permitted uses on the property ran be limited . Mr . Higgins said that under C4 zoning the property could be built to its maximum for retail use , and with the street configuration and "he existing parking problems in the area he would be very reluctant to approve I the zone change . Chairman Porter concurred that probably there would be significant traffic impacts, adding that the residents in the area would have f reason to exnecr, that this problem would be addressed in the nega- tive declaration by some reference tc, the vehicle trips per day to be added by the project . lie also discussed the fact that approval of the zone change would in effect be promoting strip zoning , whereas the existing zoning on this property sloes provide sonic buffer between the commercial to the south and the residential area .
