NI yes [ ) Now Policy or Exception Statement of Issue, Recommendation, Analysis, Funding Source, Alternative Actions, Attachments: STATEKENT OF :S SUE: The applicant requests she addition of the 01 oil production suffix on a 1 . 92 acre R2 site at the nort%- east corner of Clay Avenue and Holly Street.. The applicant wis',;es to redrill an abandoned oil well on the site, which currently contains two producing wells, and storage buildings , tanks and a compressor plant . The 01 suffix is a prerequisite for obtaining use permit approval from the Board of Zoning Adjustments in order to redrill. PLANNING COMMISSION ACTION AND RECOMMENDATION: The Planning Commission held a public hearing on the zone change request on December 18, 1984. ON MOTION BY LIVENGOOD AND SECOND nY MIRJAN'HANGIR ZONE CASE NO. 84-19/NEGATIVE DECLARATION NO. 84-44 WAS APPROVED WITH THE ADDITION � OF A "Q" (QUALIVIED DESIGNATIOAX) AS LISTED BELOW AND BASED ON THE FINDINGS OUTLINED IN THE REPORT: Qualifications : 1 . Additional landscaping beyond that meeting minimum requirements and set out in a landscape plan, approved oy the Director of Development Services, shall be provided. 2. The proposed redrilled well shall be soundproofed during and after the redriliing to reduce the impact on the surrounding residents. A licensed acoustical engineer shall submit a study to the Director of Development Services certifying that the operation meets city noise standards. 3. 1 Six months after .the approval of a use permit for the red_rilling, the . City shall initiate a zone change to remove the O1 designatior. from the property. aid V84 4 . This zone change shall be subject to annual review by the Planning Commission until removal of the 01 designation . 5 . The new oil drilling shall be limited to one well . FINDINGS : 1 . A change of Zone from R2 (Medium Density Residential) to (Q) R2-01 (Medium Density Residential combined with oil district qualified) will be compatible with surrounding land uses with the additional "Q" qualifications for oil production on the site. 2 . The Lard Use Element of the General Plan designates the property as Medium Density Residential , which is consistent with the zone designation of (Q) 1.12-01. 3 . compliance with Title 15 of the Huntington Beach Municipal Code will ensure that the proposed oil operation will not be detrimental to the general health , welfare and saf - ty of the community. AYES : Higgins , Winchell , Livengood , Porter , Erskine, Schumacher, Mirjahangir NOES: None ABSENT: None ABSTAIN: None STAFF RECOMMENDATION : Staff recommends the City Council approve the zone change and negative declaration subject to the qualification and findings of the Planning Commission . ISSUES AND ANALYSIS : The site, is located in a residential setting adjacent to a 160 unit condomihium complex which may cause some compatibility problems. The abandoned oil will itself is located to the interi..)r of the site, approximately 50 feet from the north property. line . It s approximately 200 feet from this property line to the so�.thern boundary of the condominium site. Due to the site 's locution , staff is recommending that a "{)" (qualified) classification be made a part of the zone district. The intent of the qualified classification is to require mitigation measures four the site, in order to make the oiI 'and residential uses more compatible . The suggested "Q" conditions call for additional landscaping, exceeding the 'minimum ,standards to be pFovided to better screen ' t;:e site; ' that sound attenuation be provided for the tedr'illed wells that six .months following the completion of. the drih.ling , the City shall initiate ,.a change of zone to remove the 01 suffix ; that the zone change shall be subject to annual review by the Planning Commission until such time as the 01 designation is removed from the property; and that new oil drilling be limited to one well . The applicant will need to file a use permit application to begin the re-drilling . At that time, provisions for dedication, improvements and landscaping will be made. Staff feels that the additions of the "0" conditions will help mitigate any negative impacts that the oil operations site may have on the surrounding properties and will also remove the possibility of continued or new oil drilling within a reasonable length of time. ENVIRONMENTAL STATUS : Purauant to the environmental regulations in effect at this time , the Department of Development Services posted draft Negative Declaration No . 84-44 for ten days, and no comments, either verbal or written were received . Staff, in its initial study of the project, . has recommended that a negative declaration be issued for Zone Change No. 84-19. Prior to any action on the project , it is necessary for the City Council to review and act on Negative Declaration No. 84-44 . FUNDING SOURCE: Not applicable. The applicant requested the 0 oil production suffix as part of zone Change No. 81�-1 , which was all that was needed at that time to re-drill. an abandoned well . ( Current code requires the 01 suffix . ) on March 17, 1981, the Planning Commission failed to approve either a motion to approve or deny the request. The commission had concerns about the appearance of the site with respect to the location of accessory buildings, storage sheds , and truck storage . Staff. recommended restricting the 0 suffix to small areas surrounding each well . The Commission briefly discussed this as a. method to further limit the types of uses which would be permitted on the remainder of the site . Since the Commission failed to pass a motion, it was treated as a denial The City Council heard the request on June 1.5, 1981, and approved the zone change pursuant to the staff recommendation of restricting the O suffix around each well and oil tank on the site. The ordinance was scheduled to be on the July 6, 1981 meeting date subject to the applicant ' s providing a legal description of each well/tank for the ordinance . ribe applicant did not comply with this request; thus the ordinance was never prepared or transmitted to the city Council . Due to the site ' s location , staff is recommending that a "Q" (qualified) classification be made a part of the zone district .
