STATEMENT OF ISSUE:
Transmitted for your consideration is Zone Change No. 84-2, a
request to rezone approximately .26 acres of property generally
located at the northwest corner of 17Lh Street and Olive Avenue
from (Q) C31 General Business District combined with a qualified
classification, to Townlot Specific Plan Area 1, Section B .
RECOMMENDATION :
The Planning Commission and staff recommend that the City Council
uphold the decision of the Planning Commission and approve Zone
Change No. 84-2 by the adoption of the attached ordinance.

FINDINGS FOR APPROVAL :
1. The proposed rezoning of the property ir, question would
conform to the General Plan and is consistent with the intent
of the Townlot Specific Plan.
2 . The change of zoning eliminates the present spat zoning of
some of the properties along 17th Street as commercial.
3 . The properties along 17th Street have failed to meet the
provision of Resolution No. 1078 for consolidation of an
entire half-block for consideration for commercial zoning .
DISCUSSION :
Zone Change No. 84-2 is a request to change the zoning on .2G acres
of property located on the northwest Corner cf Olive Avenue and
17th Street, from (Q)C31 General Business District combined with a
qualified classification, to Townlot Specific Plan, Area 11 Section
B. If approved by the City Council , Zone Change No. 84-2 would
rezone all of the (Q)C3 property within this area of. the Townlot
Specific Plan.
Staff analysis indicates that residential zoning on the prcperties
would be more consistent with the intent of the General Plan for
this area. Properties across 17th Street are currently developed
residential . The vacant land north of the subject property is also
zoned for residential. The tavern: across Olive Avenue is a legal
nonconforming use which would have to be developed as residential
should it recycle. Ample space for office uses is available in the
downtown area closer to Main Street and there is no need for
scattered small office buildings in the Townlot area . The existing
office building located on Lots S and 7 would he allowed to remain
as a legal nonconforming use . In the event that the use on this
site was recycled it would have to be rebuilt as residential in
keeping with the character of the Townlot Specific Plan area. It
is the intent of the property owner of Lots 1 and 3 to construct
two single family dwellings in the near future. Attached for your
nevi-w is the staff report sent to the Planning Commission on
March 61 1984 .
0'n July 6 , 1983 ; the Planning Commission approved Zone Change No.
83-7 , a request to change the zoning on the subject property from
Q-C3 to Townlot Specific Plan, Area One, Section B. In its
approval of Zone Change Ito. 83-71 the Planning Commission also
changed the zoning on the adjoining two lots from Q-C3 to Townlot
Specific Plan, Area One, Section B .
On September 6 , 1983, Zone Change No. 83-7 was heard by the City
Liuncil. At this m3eti.ng , a motion was made by MacAllister and
seconded by Finley to adopt Ordinance No. 2637 , after reading by
title . The motion failed by the following roll call vote :

Because the motion failed to adopt Ordinance No. 2637, the Q-C3

zoning, from Q-C3 to To;anlot Srecific Plan, Area One, Section B.

September 6 , 1983 .
ENVIRONMENTAL STATUS :

On Hugust 1, 1983 , the C ,.ty Council approved Negative Declaration
No. 83-181 therefore , no additional environmental assessment is
required. at this time .
ALTERNATIVE ACTION :
The City Council may consider denying Zone Change No. 93-5 which
would retain the existing (Q)C3 zoning on the subject property.

Because the :notion failed to adopt Ordinance No. 2637 , the Q-C3 General
Business District zoning was retained on the subject property .
Since that time, the property owner has refiied a request to change the
zoning on Lots 1 and 3 of Huntington Beach Tract 17th Street Section from
QC3 to Townlot Specific Plan, Area One , Section B. If Zone Change No.
84-2 is approved on Lots 1 and 3 , the applicant would be permitted to
develop 3 dwelling units on the site . As required by Section
9356 .9 (b) ( 2 ) , acces; to these dwelling units must be to%en from the
public alley at the rear of the parcel. Attached for your review is a
detailed history of the subject property.
In 1978, the zoning on the subject property and the two adjoining
properties was changed from Townlot Specific Plan to Q-C30 creating a
small area of commercial zoning surrounded by residential zoning . As
indicated on the Gene;-al Plan, the intended character of the area is
medium density residential. In 1971 , the Planning Commission addressed
the issue of allowing commercial uses within the Townlot area by adopting
Resolution No. 1078. This resolution of intent stated that any
commercial development along 17th Street should be at least one-half
block in size and accompanied by a comprehensive development plan . The
subject property and the two adjoining lots do not meet this size
criteria . Hot -ver, the Planning Commission and City Council felt that
thu conceptual plan original1% submitted at the time of the zone change
to 0-:-C3 was a ,:omprehensive .olution to any parking circulation and
access problemE- on the sLte .
The . applicant' s ourrent request would rezone half of the Q-C3 property to
Townlot Specific Plan, leaving an isolated 0. 1:3 acre parcel with
commercial. zoning. This is not an acceptable site for the type of
coordinated one-half block commercial development envisioned by the
Planning Commission in the Townlot area . Changing the zoning on Lots 1
and 3 . would also constitute spot zoning and would make the two adjoining
properties difficult to develop . Staff analysis indicates that the
applicant' s two parcels and the adjacent two parcels he rezoned to
Townlot Specific Plan in order to avoid an isolated "spot" zoning of Q-C3
on the interior parcels .
Residential- Zoni'ng on the properties would be more consistent with the
intent of; the �General Plan for this area . Properties across . l7th Street
are currently developed resioential . The vacant land north of the
subject property is also zoned for . residential . The tavern across olive
Avenue , is a legal nonconforming use which would have to be developed as

approval of the tone viliange request.

Paul Columbus , affected property owner , said that his request for �
continuance is meant to gave him time to cori5ult with his attorney
on the matter. it is his feeling that the proposed zone change will
have a deleterious effect on his lots and is a perceived abridgem,,nt
of his property rights .
Jim Severance., resident of Huntington Beach, inquired about a prior
resolution which had proposed consideration of commercial zoning
in the area if a full half block could he consolidafed . fie also
fstated that there seemed no purpose to having a Irownlot plan and
then no%: utilizing it .
There were no other persons to address the matter , and the public
hearing was closed.
Staff explained that the resolution referred to had said that the
Cicy "may" consider commercial zoning in the event of half-block
consolidation alone! Seventeenth Street - it had not guaranteed that
action.
Commission discussion included the comparative desirability of com-
mercial versus residential zoning on the property, the adequacy of
notice of this hearing to all concerned persons , and possible
findings for the zone change .

SECTION 4. This ordinance shall take effect thirty days
