Palin , Director of Development Service SUBJECT: REPORT FROI PLANNING CO!_MISSTON O;: ZONE CHANGE NO. 84-3A At the meeting of June 19, 1984 staff advised the Commission of the action taken by the City Council in regard to the subject zone change request at your meeting of June 18 , 1964 . At that time, the Council approved for adoption R3-20 zoning for only Lots 3-10 and 36-43 along Koledo Lane within the Oakview Redevelopment l�rea. The remainder of the properties within the none change area uvre to be reviewed by the Planning Commission . Due to the lateness of the hour i:. was not possible for the Commission to review and discuss a possible treatment for the remainder of the properties originally included in the zone change. Staff has been directed to return the matter to the Planning Commission for its July 10, 1984 meeting , and a report will be forthcoming to the City Council after that review. City Council approved a General Plan Land Use Element, Amendmerr_l- charminq the land use designation in the Oakview Area from Medium C-crisity Residential to Medium High Density Residential. They amendment• was intended to ter i ng the General Plan designatioi into consistency with the existing R's zoning and to permit the deVelol. ment of the proposed i;oledo Lane Improvement il;oject within t)le Oakview Redevelopment Area. The Council was ccncerned , however, that the arendment would permit higher densities to occur in the Oakview Area than presently exist . BecauGe of this concern , LUE H3 -3 was approved on the condition that a zone change limiting densities to 20 ur: '_s per acre (123 -20 ) be initiated for the Oakview Area. 'Lone C:haiige No. 84 -3A has been prepared in response to that direction . 113 zoning , when utilized in ccnjunction with a General Plan designation of Medium High Density Residential , will permit a density of 25 uni. ts per acre. The Oal- view Area, which has berth R3 J zoning and a General Plan designation of Medi,,i„i High Density Residential , i.s presently developed to an overall density of 18 units pe: acres. The proposed Koledo Lane project is proposing additional units and rehabilitation of existing units and will have a density of 20 units per acre . They proposed zone change to R3-20 will peratit the rioledo Lane project to be completed and will limit densities in the remainder of. the Oakview Area to 20 uni:.s per acre. The Planning Commission, however , in its review of the zone change request wan concerned about permi t t inq the density that R3- 20 zoning would allow. They felt that deansitien of 25 units px:r acre -2- 6-6-84 - RC« could result if density bonuses were requested . The Planning Commission therefore recommended that the zone change ordinance be amended to specify R3-16 zoning with a mai:imum allowance of up tc 20 units per acre with a density bonus . Staff does not concur with :her Planning Commission ' s recommendation. The existing overall density in the Oakview Area , at lit units per acre, already -exceeds the Planninq Comminsion' s proposed R3-16 zoning . Further , the City has not solicited or received affordability commitments from the holedo Lane property owners for the improvement: project which will be developed at 20 units per acre. The 20 unit per acre density incentive is to encourage upgrading of the neighborhood rather than ensured affordability. As such, R3- 20 zoning is the minimum zuni.ncl necessary for the project to continue. ENVIRONMENTAL STA'tuS : ?.one Change No. 84 - 3 was originally e ssessed through Environmental Impact Report No . 83-2 which was adopted Lby they City Council on November 26 , 1993 .
